A bench of Justices P S Narasimha and R Mahadevan, however, said the substitution of the property would be subject to nine conditions as suggested by ED.
"We have heard Dr Abhishek Manu Singhvi, senior counsel appearing for the petitioner and considered the matter in detail. The petitioners, namely, M/s. M3M India Pvt. Ltd. and M/s. M3M India Infrastructure Pvt. Ltd. have also filed an affidavit agreeing to the conditions. While we allow the substitution of the property as indicated...the same shall be subject to the conditions...." the bench said.
The top court's order came on a plea filed by M3M Group challenging the Punjab & Haryana High Court's order refusing to substitute their provisionally attached property.
One of the conditions submitted by ED before the top court states that M3M Group should establish clear and marketable title along with undisputed ownership of the assets proposed for substitution, supported by verifiable documentary evidence, to the satisfaction of the court.
"The substituted assets must be free from all encumbrances, including mortgages, liens, pledges or any third-party claims or security interests and a certificate to this effect must be submitted by the petitioner. The petitioner must provide a notarised undertaking that the substituted property will not be sold, transferred, or otherwise alienated during the pendency of proceedings," the condition said.

In a major relief for many vehicle owners in the capital, the Supreme Court on Tuesday ordered that no coercive action be taken for four weeks against owners of diesel vehicles over 10 years old and petrol vehicles over 15 years old. The directive came from a bench comprising Chief Justice of India BR Gavai and Justices K Vinod Chandran and NV Anjaria, which was hearing a Delhi government plea seeking review of the court's 2018 order imposing the ban. Current rules, set by the apex court in 2018, categorise diesel vehicles older than 10 years and petrol vehicles older than 15 years as end-of-life, effectively barring their use. While issuing notice returnable in four weeks, the bench observed that in the past, people often drove their cars for 40–50 years. Delhi govt questions ban's rationale The Delhi government has argued that the ban is not based on any scientific study or environmental impact assessment. It cited tighter pollution-control regulations, wider enforcement of the Pollution Under Control (PUC) system, and the nationwide adoption of Bharat Stage-VI (BS-VI) emission norms from 2020. It warned that, under the existing rule, even BS-VI-compliant vehicles could be forced off the roads in a few years without scientific justification. The government further contended that the measure causes arbitrary hardship to residents whose vehicles meet PUC norms. SG seeks halt to coercive measures Appearing for the Delhi government, Solicitor General Tushar Mehta urged the court to stop coercive steps such as vehicle seizure. 'I have a vehicle I use only for commuting between my home and court. After 10 years, it will have just 2,000 km on the odometer. Another vehicle used as a taxi may clock 1 lakh km in two years but continue running. Yet, I would have to sell my car simply because 10 years have passed,' Mehta argued. The court will take up the matter after four weeks.

Sebi flags ₹77,800 cr as difficult-to-recover dues in FY25 annual report
The Securities and Exchange Board of India (Sebi) has identified approximately ₹77,800 crore as 'difficult to recover' dues in its annual report for the financial year 2024-25, marking a nearly 2 per cent increase from the previous year. These dues remain unrecovered despite exhaustive recovery efforts. Of the total, over ₹61,200 crore pertains to cases pending before court-appointed committees, while ₹12,300 crore relates to parallel proceedings pending in state PID courts, the National Company Law Tribunal (NCLT), the National Company Law Appellate Tribunal (NCLAT), and the Supreme Court. Sebi clarified that categorising dues as difficult to recover (DTR) does not prevent officials from pursuing recovery if circumstances change. In the report, Sebi Chairman Tuhin Kanta Pandey underscored the regulator's commitment to simplifying regulations, easing norms for foreign portfolio investors (FPIs), and enhancing investor awareness. Pandey said Sebi will undertake a comprehensive exercise to rationalise existing regulations, mindful that excessive or overlapping rules increase compliance costs. He added that Sebi aims to streamline the regulatory framework for FPIs to facilitate smoother operations and promote long-term foreign capital inflows. Recent initiatives include easier registration for FPIs investing solely in Indian government securities and a proposed single-window clearance system — 'SWAGAT-FI' — for low-risk FPIs. 'Efforts will focus on streamlining processes, removing regulatory bottlenecks, and strengthening engagement with FPIs and stakeholders. Investor education, including cyber-fraud awareness, remains a top priority,' Pandey said. Other key focus areas this year include easing compliance requirements for stockbrokers, simplifying offer documents, reviewing restrictions on asset management companies, and implementing reforms for alternative investment funds. Sebi is also reviewing the margin trading funding (MTF) framework, including eligible securities. As of August 8, the MTF book stood at ₹92,000 crore, according to NSE data. The regulator has constituted a committee to review Takeover Regulations, tasked with simplifying and strengthening the framework in line with judicial rulings and global best practices. Sebi also conducted a nationwide investor survey to shape its investor awareness strategy and has bolstered cybersecurity and technological infrastructure. Inspection activities surged significantly last year, with 312 stockbroker inspections in FY25, up from 146 in FY24. Inspections of investment advisers and research analysts also rose sharply to 207 and 149, respectively, compared to 21 and 15 the previous year. Settlement application filings jumped to 703 in FY25 from 434 in FY24. Regarding pending cases, as of March 2025, 520 matters awaited resolution at the Supreme Court, while 960 were pending at the Securities Appellate Tribunal (SAT).
