Sosma accused in Geng TR case granted bail on medical grounds in rare Federal Court ruling
The court also imposed conditions for the two men to wear electronic monitoring devices and remain within the compound of their respective homes.
The decision was made in a 2-1 majority by a three-member panel led by Federal Court judge Tan Sri Nallini Pathmanathan.
She said the majority were of the view that S. Hemanathan, 31, and N. Nithiyan, 39, had made out their case primarily due to their health conditions, coupled with the inability of the prison system to attend to or care for prisoners who need special medical attention.
'They are prohibited from travelling outside of their residential home without reasonable consent of the police and must report to the nearest police station once every two weeks. Also, they may travel to hospitals for treatment of their medical conditions with the permission of the police, which should not be unreasonably withheld,' she said.
Justice Datuk Hanipah Farikullah supported the majority ruling, while Justice Abu Bakar Jais dissented.
Earlier, defence counsel Datuk Rajpal Singh had urged the court to allow bail on medical grounds.
He said Nithiyan suffers from ischemic heart disease, hypertension and dyslipidemia, which could lead to life-threatening cardiovascular failure without consistent treatment, while Hemanathan, who uses a wheelchair, suffers from diabetes, hypertension, dyslipidemia and high cholesterol, and has not received consistent treatment in prison.
Deputy Public Prosecutor Ng Siew Wee argued that both men had received necessary treatment and their conditions were under control.
Hemanathan and Nithiyan were charged in the Sessions Court in May last year for being members of an organised crime 'Geng TR' in Sunggai Janggut Seafood Restaurant in Jalan Bagan Sungai Janggut, Jeram, Selangor between November 2019 and May 2024.
They were charged under Section 130V of the Penal Code, read together with the Security Offences (Special Measures) Act (Sosma).
Their case was transferred to the High Court in Aug last year, and the trial is fixed to begin in October next year. — Bernama

About 20% would not have their applications approved, he said. 'I know it's not ideal, but I've seen many specialists in Sabah who initially didn't want to go there. Now it's their 10th year and counting,' he told reporters today after launching a book on the Covid-19 pandemic and its effects on Malaysia. Dzulkefly said not all placements can rely on arrangements for mutual transfers. On Thursday, the Dewan Rakyat was told there were 650 vacancies for permanent posts in Sarawak, but only seven medical officers have opted to take up these posts. Dzulkefly encouraged doctors, especially those posted as couples, to consider the long-term benefits of serving in East Malaysia. Asked what steps the ministry was taking to solve the high number of transfer requests, the minister said Putrajaya was exploring offering better incentive schemes to retain doctors in Sabah and Sarawak. 'We are trying to see what other incentives can be offered. We know this is an issue we can't completely avoid, but we will do our level best to manage it.' No queue jumping in Rakan KKM Dzulkefly gave an assurance there would be no queue jumping in the Rakan KKM programme, which offers 'premium economy' services at selected public hospitals. Under the programme, specialists can offer paid elective services, with the income reinvested to improve the health service. 'This isn't about jumping queues for emergency cases. It's about giving people an option for elective procedures while retaining top talent,' he said. He said a briefing on the programme would be held as some information on the initiative had been misinterpreted. Two weeks ago, the Malaysian Medical Association had questioned if wealthier patients would get faster access to health services, and urged the ministry to clarify the programme and if it would strain an already overstretched health service.

Driver on rampage hits 2 cars, 2 motorcycles in George Town
The driver crashed into a car on Jalan Perak and continued his rampage until he reached the Tun Dr Lim Chong Eu Expressway, police said. GEORGE TOWN : A driver on a rampage collided with two cars and two motorcycles before he himself was hospitalised along with four others here last night. Five people were seriously injured and one slightly hurt in the incident that stretched from Jalan Perak to the Tun Dr Lim Chong Eu Expressway, police said. Northeast district police chief Abdul Rozak Muhammad said the car driven by the 50-year-old man hit the back of another car driven by a 44-year-old woman at the Jalan Perak traffic light junction at about 8.30pm. 'The man continued driving and hit two motorcycles at separate locations on Jalan Perak before rear-ending a second car on the Tun Dr Lim Chong Eu Expressway,' he said in a statement today. He said the driver suffered serious injuries. Also seriously injured were the two motorcyclists and one pillion rider, and the driver whose car he crashed into on the Tun Dr Lim Chong Eu Expressway. He said the case is being investigated under Section 42 of the Road Transport Act 1987 for dangerous driving.

2 motorcyclists killed in Kota Tinggi accident

(PDRM pic) JOHOR BAHRU : Two motorcyclists were killed in an accident involving three vehicles at Km60.5 Jalan Sungai Rengit, Kota Tinggi, early today. Kota Tinggi district police chief Yusof Othman said the two men, aged 18 and 19, sustained serious head injuries and were pronounced dead at the scene. He said police received information regarding the crash, which involved two motorcycles and a lorry, at 1.24am. 'The accident is believed to have occurred when both motorcycles crashed into the rear of the lorry. However, the case is still under investigation. 'The victims' bodies were taken to the Kota Tinggi Hospital, while the lorry driver has yet to be traced,' he said in a statement. Yusof appealed to witnesses to contact traffic investigation officer Fairuz Abd Malek at 012-7415886.
