According to court documents reviewed by PEOPLE, on Wednesday, July 16, counsel for both parties met and conferred, mutually agreeing to reschedule Lively's deposition for Thursday, July 31, after it was initially scheduled for Thursday, July 17.
A rep for Lively did not reply to PEOPLE's request for comment. PEOPLE has reached out to Baldoni's lawyer for comment.
The deposition was scheduled to take place in an undisclosed location after the actress was granted a protective order on Monday, July 14.
The change of dates comes amid Lively's lawsuit against Texas-based publicist and social media specialist Jed Wallace being dismissed on jurisdictional grounds earlier the same day.
The actress filed a civil rights complaint against Wallace, the operator behind Texas-based crisis-management firm Street Relations, Inc., in December 2024, claiming that he was hired by Justin Baldoni's PR team (publicists Melissa Nathan and Jen Abel) to assist in an alleged smear campaign against her.
While Lively claimed Wallace "weaponized a digital army around the country from New York to Los Angeles to create, seed and promote content that appeared to be authentic on social media platforms and internet chat forums," Judge Lewis J. Liman granted Wallace's motion to dismiss without prejudice.
The judge's dismissal allows the plaintiff to refile the same claim or charges at a later time. This means Lively has until July 31 to file an amended complaint or sue Wallace in a different jurisdiction, according to court documents obtained by PEOPLE.
A source with knowledge of the situation tells PEOPLE both sides wanted more time after the judge's ruling on Wednesday.
In response to the dismissal, Lively's rep said in a statement shared with PEOPLE, "Ms. Lively respects the Court's decision, which has nothing to do with the merits of her allegations about Mr. Wallace's role in the smear campaign and relates solely to the procedural question of whether he is subject to jurisdiction in New York or elsewhere."
"We currently are evaluating our numerous options for holding Mr. Wallace accountable for the pivotal role he served in the retaliatory effort that Justin Baldoni and the Wayfarer Parties paid him at least tens of thousands of dollars a month to perform," the statement added.
In December 2024, Lively accused It Ends With Us director-costar Baldoni of sexual harassment and retaliation, allegations he has adamantly denied.

His counterclaims against Lively and her husband, Ryan Reynolds, which involve allegations of extortion and defamation, were dismissed by Judge Liman in June 2025, and his legal team opted not to refile amended versions of those claims.
Attorneys for both Lively and Baldoni have indicated that they plan to testify during the trial scheduled to take place in March 2026 in New York.

"We've both been in NYC for about 15 years and for me, going home to Laguna to get married feels very full-circle." Although the wedding was small, it was everything Bosworth and Natale envisioned. "We wanted an understated, but colorful luncheon that felt inviting instead of stuffy. When your reception is in your backyard and you invite guests to jump in the pool, you need to be laid back about it all," the expectant mother says. "Gorgeous florals" were a non-negotiable for the couple's celebration. Gary Samuelian executed the striped design and stunning arrangements "perfectly." Adding "just the right touch of fun" was a mix-and-match of colorful china, drinkware and florals "in unexpected places." "Even though we celebrated our luncheon in my parent's backyard, we knew it should still feel elevated, unique, and special," Bosworth says. "Hosting at home can present a unique set of challenges, and one of my big concerns was leaving very little for my parents to manage once the wedding was over," Bosworth says. "We pulled it off with a great team and help." As they exchanged traditional vows, Bosworth wore a wedding dress designed and tailored by Hailey Desjardins. She was styled by Thomas Carter Philips, and did her hair and makeup herself. Meanwhile, Natale opted for a Brunello Cucinelli suit. "When we set our date in July, we didn't know if our planned IVF cycle would be successful. I bought a dress (or two) early on in the hopes one would still work if we got lucky," Bosworth says. "Three weeks before my wedding, nothing fit and I put into a call to my stylist friend, Thomas Carter Phillips, who works with an incredibly talented tailor, Hailey Desjardins, to build me a dress from scratch." She continues: "At that point, I was more than three months pregnant, had gained weight from the transfer medications and was starting to show. We decided a classic look that accentuated my bump would be best. My finished dress got delivered at 8 p.m. the night before I left for our wedding, and I could not be more grateful to Tommy and Hailey for saving me in one the most extreme pinches of my life." 'Gwyneth: The Biography,' Amy Odell's thorough portrait of Gwyneth Paltrow, splits her life and career into two distinct periods: the rise (and fall) of the quintessential '90s Hollywood 'It girl,' and her transformation to wellness mogul with the creation of lifestyle brand Goop. In both phases, she struggles with likeability in the press and from the public, often coming across in interviews as elitist and out of touch with 'normal' Americans. But that hasn't stopped her from succeeding on both fronts. Blond, glamorous and patrician, Paltrow is the ultimate nepo baby, the daughter of actor Blythe Danner and TV producer Bruce Paltrow, acting from an early age at the Williamstown Theatre Festival in Massachusetts. In the first half of the book, Odell charts Paltrow's rise from chain-smoking party girl at elite New York private school Spence to Hollywood 'It girl.' Trump says he has not been asked to pardon Maxwell following Epstein interviews
US President Donald Trump has said he has not been asked to pardon disgraced British socialite Ghislaine Maxwell following her 'truthful' answers to government questions about sex offender Jeffrey Epstein. Maxwell was found guilty in December 2021 of luring young girls to massage rooms for paedophile financier Epstein to molest between 1994 and 2004. The US Department of Justice met with the 63-year-old convicted sex-trafficker last week – interviews in which her lawyer David Markus said his client would 'testify truthfully'. The US government faced a backlash from Mr Trump's support base following words from Attorney General Pam Bondi that there was no evidence Epstein had a 'client list'. Following the criticisms, Deputy Attorney General Todd Blanche met with Maxwell over the course of two days – with Mr Blanche saying: 'No-one is above the law and no lead is off-limits.' Mr Markus previously said the disgraced socialite had not been offered a pardon as part of the interview process. In a short statement ahead of the meetings, the lawyer said: 'I can confirm that we are in discussions with the government and that Ghislaine will always testify truthfully. 'We are grateful to President Trump for his commitment to uncovering the truth in this case.' Questioned on whether he had been asked to pardon Maxwell, the US President told reporters on Monday: 'Well, I'm allowed to give her a pardon, but nobody's approached me with it. Nobody's asked me about it. 'It's in the news – that aspect of it – but right now, it would be inappropriate to talk about it.' During her three-week trial in 2021, jurors heard prosecutors describe Maxwell as 'dangerous', and were told details of how she helped entice vulnerable teenagers to Epstein's various properties for him to sexually abuse. She was sentenced to 20 years in prison at the federal court in the southern district of New York (SDNY) in June 2022. Epstein was found dead in his cell at a federal jail in Manhattan in August 2019 while he awaited trial on sex trafficking charges. The death was ruled a suicide.
