SC cancels pre-arrest bail of former AP CID chief Sanjay

Vijayawada: The Supreme Court on Thursday cancelled the pre-arrest bail granted to former CID chief N Sanjay by the AP high court in the case registered by the anti-corruption bureau (ACB) over allegations of misappropriation of funds, and asked Sanjay to surrender before the magistrate concerned within three weeks. The high court earlier granted him anticipatory bail in the case, following which the state govt approached the SC challenging the pre-arrest bail. The apex court found fault with the 49-page order given by the high court, observing that a 'mini trial' was conducted in the anticipatory bail petition. The ACB registered a case against Sanjay, a 1996 batch IPS officer, over allegations of causing undue favour to a company by paying Rs 59 lakh without fulfilling the contractual obligation of developing a website and mobile app for the fire dept when he was working as DG of fire services. Similar payments were made when he was the CID chief, to another company, on the pretext of spreading awareness on the SC/ST Act. A vigilance and enforcement enquiry concluded that about Rs 2 crore was misappropriated in the two cases, following which the ACB registered an FIR. The Supreme Court observed that there is prima facie material in the documents submitted and the high court erred in its judgement while granting anticipatory bail. Setting aside the HC order, the apex court directed Sanjay to surrender before the court, adding that the investigation agency can seek his custody by filing an appropriate petition before the trial court. The top court also clarified that Sanjay can file a fresh bail application before the trial court, if required.
