2 bills aimed at improving community safety advance in WA State Legislature

OLYMPIA, Wash. - In a significant legislative development, House Bill 1252, which seeks to reform pre-trial release policies for both adults and juveniles as well as enhance judicial accountability, took a major step forward as it successfully passed out of the House Community Safety Committee with a commanding vote of 8 to 1.
The backstory
The revised legislation mandates that judges provide a written explanation for their decisions regarding the pre-trial release of suspects who flee from law enforcement, and for individuals charged with violent crimes or offenses involving firearms.
Currently in Washington state, there is a presumption of release for defendants. After a preliminary court appearance, anyone charged with a noncapital offense should be released on personal recognizance pending trial. This presumption can be overcome though, if the court finds that the defendant is likely to fail to appear, commit a violent crime, or intimidate witnesses or interfere with justice. Before imposing bail, judges must consider less restrictive options.
However, recent decisions by judges to release suspects pending trial for violent crimes have left family members of victims feeling frustrated.
HB 1252 stipulates that judges can only order the release of these high-risk individuals on electronic home monitoring if such monitoring includes real-time oversight coupled with an immediate law enforcement response.
"The electronic monitoring that is used by courts in the state of Washington for defendants pre-trial is not actually monitored. So, there is no real time monitoring and there is no real time response to anything, geographic restriction violation, curfew violation. About 10% of the time defendants cut the strap, no real time response," said Representative Lauren Davis (D-Seattle), who sponsored the bill.
Local perspective
She pointed to a horrific case in December, in which a 17-year-old, despite being under electronic monitoring, traveled after his curfew and disemboweled a 14-year-old boy in Snohomish County.
"Electronic home monitoring creates a deceptive illusion of safety," said Davis. "What I'm striving to eliminate is the misguided belief that there exists a safe middle ground where a defendant charged with a violent or firearms-related offense can be released into the community."
Proponents of the legislation assert that it will significantly bolster public safety, while opponents voice concerns that it could result in higher incarceration rates, particularly impacting juvenile offenders.
Another public safety bill sponsored by Representative Davis was unanimously approved to move forward out of committee. House Bill 1668, which seeks to impose stricter penalties on felons who evade community custody requirements. This situation arises when individuals released from prison fail to report to their community corrections officer as mandated or violate the terms of their release.
"There were only 78 convictions for escape even though there were 11,000 high level sanctions for the Department of Corrections," said Rep. Davis.
Under the new provisions, the potential confinement period for such offenders who are convicted of escape from community custody would escalate from a minimum of 0 to 90 days to an average range of 14 to 18 months in prison.

Boxer Nahir Albright told reporters that Davis headbutted him and left a large bump over his right eye. He said the incident took place when Davis and his younger brother, Keon, confronted Albright after Albright beat the oldest of the Davis brothers, Kelvin, by majority decision at the Scope Arena in Norfolk, Virginia. The weekend already had soured for Davis, who on Friday weighed in 4.3 pounds more than the maximum for his WBO lightweight world title defense scheduled for Saturday. That led to the cancellation of the bout against Edwin De Los Santos and the WBO title was stripped from him. Then came the alleged incident described by Albright. 'I was in my locker room and celebrated my victory with my team,'' he told reporters in a videotaped interview. '…Keyshawn and his little brother (Keon) came in and they started looking at me and was like, they saying something about his older brother. They was mad and he grabbed me, pushed me back. 'I'm grabbing his head. He moved his head towards my head.'' Then came the headbutt, according to Albright. 'So yeah, that's what happened,'' he said, the incident was not sparked by any exchange of words. '…Their locker room is right next door to mine, so I guess they heard us happy and all that kind of stuff, and they came in and started trouble.'' Of the confrontation, Albright told ESPN, 'Now we've got to settle that'' and said he wants to fight Keyshawn Davis in the ring. Davis beat Albright by unanimous decision in 2023 but the result was turned to a no contest after Davis tested positive for marijuana – a banned substance in Texas, where the fight was held. But late Saturday, the talk centered on controversy outside of the ring. For Davis, instead of being featured in the main event in his hometown of Norfolk, it all went awry. Davis, 26, showed up Saturday at the Scope Arena with his son of less than a year and cheered on his two brothers. Keon, 23, won his fight via a second-round TKO. But Kelvin, 28, got pummeled by Albright, who won the 10-round bout by majority decision. During the altercation, Albright said, his coaches eventually interceded. 'My coaches grabbed (Keyshawn Davis) and then I think security came in and grabbed him,'' Albright said. Later, Albright said, Davis charged after Albright's older brother. 'It just got crazy,'' he added. But Albright said he thinks Kelvin Davis, the brother he beat in the ring Saturday night, was trying to break things up. 'It's a little unfortunate, but nothing could take away the feeling of being a champion tonight,'' he said, referring to the vacant Silver US WBC Jr. Welterweight title he won. 'I ain't going to let nothing ruin my night.'' ESPN reported that the Davis brothers did not comment.

PEORIA, Ill. (WMBD) — A Far North Peoria man spent two hours sending sexually explicit text messages to a 16-year-old girl earlier this year. That's what Assistant State's Attorney Terry Muench said during a brief hearing Thursday in Peoria County Circuit Court where Mario E. Davis, 34, was charged with one count of grooming. Davis appeared in court twice Thursday. The first time was in the morning, when a judge found probable cause to proceed on the charges. The second time was in the afternoon before Judge Mark Gilles who ordered him held pending the outcome of his case. Muench said a reason to hold him was that Davis had called Peoria police hours after he texted the teenage girl to claim his Snapchat account was hacked or that someone was posing as him. He even, the prosecutor said, went so far as to change the name of his account. That change came after she had screen recorded their conversation. that matters as users of Snapchat are notified when someone takes a screen shot of their image or text. The judge noted that Davis was a threat to minors, the 'most vulnerable people in society,' and the harm that could come to a child would be beyond repair. Nothing that could be done to ensure that he would not continue this activity online, Gilles said. 'Children are at a high risk with this defendant if he's not detained based upon what I have heard today,' Gilles said, noting that Davis' past criminal record did have a misdemeanor charge of tattooing of a minor and obstructing justice. The prosecutor pointed out twice in open court that the entire conversation was found on Davis' cellphone when he was arrested this week. Muench said an investigation into Davis began in mid-February after a parent reported her child had gotten the illicit messages. The girl, who knew Davis as her older sister had worked with him, spent two hours in the early morning hours of Feb. 12, talking to him after she accepted a friend request from him. The conversation started innocently but quickly turned sexual. The girl did tell him that she was 16 and Davis, Muench said, kept going with the conversation. After serving several search warrants on several social media accounts, they arrested Davis Tuesday at an address in the 7700 block of North Grand Prairie Drive. Detectives were able to confirm that the account used to communicate with the girl was registered to Davis. Also, GPS data from Snapchat indicated that the conversation occurred in or around Davis's residence, said Anna Perales of the state's attorney's office. While it wasn't clear where he was arrested, Davis runs a tattoo shop called Ink Capital, which is located on that block. He will next appear in court on June 18. Copyright 2025 Nexstar Media, Inc. A Clay County deputy is out of a job after being accused of stealing $4,000 during an arrest. Action News Jax reported last month about accusations filed following the arrest of Willie Davis Jr. in September. He said deputies seized $6,900 from him when he was arrested. Davis' attorney said when he picked up his belongings, some of that money had disappeared. Jail records show only $2,900 was put in Davis' account. Clay authorities confirmed that deputy has been fired. 'We hold all of our deputies and employees to the highest standards and this probationary deputy failed to meet those standards,' Clay County Sheriff Michelle Cook said.
