The Madras High Court recently quashed the chargesheet against a man initially accused of impregnating a 13-year-old girl, after a DNA test conclusively ruled him out as the biological father. The court directed a fresh investigation—without arresting suspected individuals merely for DNA testing—to identify the real culprit.
A bench of Justice K. Murali Shankar, while hearing a revision petition filed by the accused man, pointed out the glaring lapses in the police investigation, especially the fact that no DNA test was conducted before filing the final chargesheet despite the allegation involving pregnancy of a minor.
The accused had been charged under Sections 5(l), 5(j)(ii), 5(n) read with 6 of the POCSO Act, along with Section 506(i) of the IPC, based on a complaint filed by the minor's mother in September 2020. The girl, a Class 10 student, was found to be six months pregnant, and named the accused—her cousin—as the person who allegedly lured and sexually assaulted her three times under the promise of marriage.
A trial ensued, and after charges were framed, the accused moved the court seeking a DNA test to disprove paternity. The DNA report from the Forensic Sciences Department, dated February 28, 2022, clearly stated that he was excluded as the biological father.
Despite this, the trial court declined his discharge petition under Section 227 CrPC. Challenging that, the accused approached the high court.
Justice Shankar criticised the 'casual and mechanical" nature of the original investigation, observing that the police made no effort to identify who actually fathered the child. 'The prosecution proceeded as if the petitioner alone was the culprit. There is no explanation why a DNA test was not conducted before filing the chargesheet," the court said.
While acknowledging that a negative DNA report alone does not absolve an accused if other evidence exists, the court emphasised the need for a thorough re-investigation, especially in view of the gravity of POCSO offences. It noted that either there were two different perpetrators (one who assaulted and one who impregnated the girl), or the sole accused may not have been involved at all.
Crucially, invoking its powers under Section 482 CrPC, the court ordered the Pudukkottai Superintendent of Police to appoint a Deputy Superintendent-ranked officer to re-investigate the matter and submit a fresh final report within three months. The investigating officer has been permitted to conduct DNA tests on new suspects without arresting them, provided standard safeguards are followed.
The court clarified that the present accused was not exonerated and that his role should also be reassessed during the re-investigation.

Reading out the operative part of the judgment, Justice Chandran said the top court has confirmed the high court's September 2022 order and dismissed the appeal filed by Delkar's son, Abhinav. The FIR, lodged at Mumbai's Marine Drive police station on March 9, 2021, invoked sections 306 (abetment of suicide), 506 (criminal intimidation), 389 (putting a person in fear of accusation to commit extortion) and 120-B (criminal conspiracy) of the Indian Penal Code, along with the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It alleged that Delkar, a prominent tribal leader from the Dhodia Patel community and a seven-term Member of Parliament from Dadra and Nagar Haveli, was subjected to sustained harassment by the local administration to wrest control of an educational institution he ran and to deter him from contesting the next election. Delkar, 58, was found dead on February 22, 2021, in a hotel room on Marine Drive in Mumbai. A suicide note and minutes of a parliamentary privileges committee were recovered from the spot. His son, Abhinav Delkar, recorded a statement that was treated as the FIR. Nine persons, including Patel, were named as accused in the FIR. Quashing the FIR in 2022, the high court held that the allegations, at best, reflected Mohanbhai S Delkar's impressions of humiliation and ill-treatment and were not backed by material showing any specific, proximate acts of instigation or intentional aid, elements necessary to make out abetment under Section 306 IPC. The high court noted material placed by the petitioners to show that Delkar was accorded due protocol at public functions, and found no prima facie instance of harassment rising to the level of a criminal offence. The high court added that it was a fit case for quashing 'to prevent abuse of law.' The high court, while quashing the case, accepted the arguments of the accused that Delkar was never disrespected at public functions and that proper protocols were observed in keeping with his stature. It ruled that the allegations of humiliation and harassment were 'impressions carried out by the deceased' and that the FIR lacked any prima facie evidence of a 'positive act' required to establish abetment under Section 306 of IPC. The nine persons named in the FIR included Praful Patel and some officials and police officers in the Dadra and Nagar Haveli administration. Mohan Delkar, a prominent tribal leader, first entered Parliament in 1989 and represented Dadra and Nagar Haveli six times consecutively until 2009. After a brief interlude, he returned as an Independent lawmaker in 2019, defeating Bharatiya Janata Party (BJP)'s Natu Patel by 9,001 votes. His wife represents the constituency in the Lok Sabha, having joined the BJP with their son Abhinav in 2024.

BENGALURU: Halasuru Gate police arrested two building owners in connection with the death of five people, including a couple and their two children, in Saturday's fire mishap. The owners had allegedly constructing a four-storey building unscientifically, in violation of fire and other safety norms. The accused are Balakrishnayya Shetty and Sandeep Shetty, both friends and natives of Mangaluru. The fire broke out in a building located on Rajanna Lane, Nagarathpet, around 3am Saturday. At least 12 people managed to escape, while Madan Kumar Purohit and Suresh Kumar were found charred to death on the ground and second floors of the building. Madan's wife Sangeeta Kanwar, and their two children Mitesh and Vihan, were trapped on the third floor as Madan had locked the house from outside. After nearly 12 hours of operation, Fire and Emergency Services personnel and State Disaster Response Force recovered the three bodies. Police said the two owners were arrested on Saturday night, based on a complaint filed against the duo by Madan's elder brother. During the probe, it was revealed that the owners had obtained permission only for a G+2 structure, but had built two more floors illegally. They had also violated fire safety norms and failed to obtain mandatory certificates from BBMP and Bescom. Forensic Science Laboratory and Bescom teams visited the spot on Sunday and collected evidence. Further action will be taken after receiving reports from the Fire and other departments. The fire is suspected to have been caused by a short-circuit, police said, adding that the duo is remanded in judicial custody. They were booked under Section 105 (culpable homicide not amounting to murder) and other sections of the BNS.

Ongole: The District Educational Officer of Prakasam District, A Kiran Kumar, has ordered criminal charges under the POCSO Act 2012 against Pilli Hazarathaiah, a Physical Education teacher at Zilla Parishad High School, Woollapalem, following confirmed allegations of misconduct with girl students. The case emerged after Kotikalapudi Jayaram, President of the BC Reservation Protection Committee, filed a complaint on July 16, 2025, alleging that the teacher misbehaved with and abused girl students. The complaint also claimed the accused obtained his promotion using fake certificates. Based on the complaint, DEO Kiran Kumar constituted a three-member inquiry committee on July 28, comprising the Deputy Educational Officer of Ongole Division, Mandal Educational Officer-II of Singarayakonda, and the Girl Child Development Officer of Samagra Siksha, Prakasam District. After a thorough investigation, the committee submitted its report on August 6, confirming that the allegations of student abuse were substantiated. Based on these findings, the DEO has instructed the Deputy Educational Officer, Ongole Division, to file a criminal case at Singarayakonda Police Station under the POCSO Act.
