
Nurse at centre of trans doctor row accused of racism after suspension lifted
Charlotte Myles, a service manager at NHS Fife, said she had reviewed a decision to suspend Sandie Peggie over the row with Dr Beth Upton, who was born male but identifies as female.
Ms Myles told a tribunal in Dundee that senior figures at Victoria Hospital in Kirkcaldy 'expressed unhappiness' at her decision to allow Ms Peggie to return to work.
She said they claimed that the nurse was homophobic, had been 'racist towards a doctor' and that she supported Donald Trump's views on gender.
She said Dr Kate Searle, who was Dr Upton's line manager, alleged there were 'patient safety issues' with allowing Ms Peggie to resume her nursing job.
It was claimed that Ms Peggie had walked away from patients when Dr Upton arrived to treat them, including one who required resuscitation.
But none of the allegations were reported at the time they were said to have occurred or were supported by documentation, she said.
Ms Myles said they instead came from 'second, third-hand information' and the doctor who was the alleged subject of the racist comment did not recall it having been made.
She said Ms Peggie 'wasn't happy' with the homophobia claims as 'I believe she has a daughter who is gay'. Nicole Peggie tweeted on Monday that her mother was 'my best friend'.
Ms Myles said that the lack of evidence meant she did not consider the allegations when reaching her decision to end the nurse's suspension.
She said claims that the nurse shared Mr Trump's views on gender were 'tittle tattle' and Ms Peggie was entitled to her private opinions if they did not harm patients.
The Scottish Tories said: 'The scale of the witch hunt conducted against Sandie Peggie by her employers becomes ever more apparent and indefensible.'
The row centres on an encounter between Ms Peggie and Dr Upton on Dec 24, 2023. The nurse experienced a sudden and heavy period and feared that it had bled through to her scrubs.
Ms Peggie entered the female hospital changing room to find Dr Upton and challenged their presence. Within hours, a bullying complaint was lodged by Dr Upton and the nurse was suspended.
In May 2024 Ms Peggie submitted a formal claim to an employment tribunal against NHS Fife and Dr Upton for sexual harassment, belief discrimination and victimisation.
The nurse complained of being required to share a single-sex space with someone she believed to be male and being victimised for holding a gender-critical belief that biological sex is immutable.
It emerged last week that Ms Peggie had been cleared of gross misconduct by an NHS Fife disciplinary hearing. However, the tribunal is scheduled to continue for another seven days, with Dr Searle giving evidence on Tuesday.
After being asked to review the nurse's suspension on Feb 27 2024, Ms Myles said she concluded there was no risk to patients in Ms Peggie returning to work.
But she said senior staff at the hospital 'weren't particularly happy with my decision' when she informed them.
She name-checked Dr Searle and Dr Margaret Currer, who are both consultants in emergency medicine, and Esther Davidson and Louise Curran, two nurses who are Ms Peggie's line managers.
After Dr Searle made the patient safety and racism allegations, Ms Myles said she challenged her whether they had been 'escalated and reported appropriately when these events happened'.
Dr Searle said they had not and Ms Myles warned her that 'if these events had happened and there's been a failure to report' them, the doctor would be 'culpable' for any future incidents.

Ms Myles said Ms Davidson and Ms Curran had made similar allegations and she again asked them for the dates when the incidents occurred and whether they had been escalated.
But she said they 'couldn't give me an accurate response' and it was 'all hearsay', leading her to take no action. Ms Peggie had received no previous complaints from patients or staff.
Asked about Ms Curran's allegations, she said: 'Again, it was just very similar and, like you said, tittle tattle of being a supporter of Donald Trump and sharing his views on gender.
'But again, that's somebody's personal view. As long as it doesn't impact on patients and it doesn't impact on the workforce and actually doesn't cause harm to anybody within the board, then people are entitled to have their private views.'
Ms Myles said Ms Peggie was alleged to have called a consultant a 'p---' but it 'took a while' for Ms Davidson to recall the identity of the alleged victim, who 'doesn't recall the comment'.
The tribunal also heard that the nurse rejected a proposal to work at the Queen Margaret Hospital in Dunfermline so she and Dr Upton could avoid each other.
Nicole Peggie, the nurse's daughter, responded to the homophobia allegations on X, saying: 'Jeez, do I need to go back under oath to clear this up?
'My mum is my best friend, has and always will be. Her only concern is if I'm happy.'
Tess White, the Scottish Tories' shadow equalities minister, said: 'It's plain wrong that she was urged to work at a different hospital after pointing out that her right to access a single-sex space was being denied, while the lack of evidence for the racism allegation thrown at her suggests it was a crude smear.'

Hospital At Home: Virtual ward service 'life-changing' for elderly patients
Elderly patients say the NHS's Hospital at Home programme has changed their lives by allowing them to receive safe medical care in the comfort of their own homes. A new report from Healthcare Improvement Scotland has found that the expansion of its 'virtual ward' service across Scotland has saved over £50m and kept around 15,500 people from staying in hospital for treatment over the past year. The programme is designed to treat patients at home, often with remote monitoring using technology, without the need to be separated from family and friends. It also helps to reduce the risks associated with hospital admissions, such as increased risk of catching infections and a decrease in mobility and independence. Among those who have benefited is Norman Cumming, 77, from Chapelhall, who was born with brionchiectasis. Over the years, he developed asthma and was diagnosed with Chronic Obstructive Pulmonary Disease (COPD) in 1990 – a progressive, incurable lung condition. Symptoms include shortness of breath, frequent chest infections, and fatigue. Supplied/NHS Scot The pensioner takes daily medication and uses an inhaler, but occasionally needs to visit his GP clinic for nebuliser treatment, where medication is delivered as a fine mist to help ease his breathing. His wife Tina, 64, told STV News: 'This past year has been the worst it's been. It takes a lot out of him – he gets tired easily, his breathing is affected easily. This last spell, with the hot weather, he has really struggled with that. 'He sometimes has to sleep all day to rebuild his energy.' The couple were first told about Hospital at Home while visiting their GP clinic in December 2024. 'I thought it was a brilliant idea,' Norman said. 'In hospital, you've got to wait for attention. At home, I know there's someone there for me if I need help. 'It's a safe environment, and I'm not worrying about picking up other infections.' Tina added: 'Norman was absolutely delighted – obviously any infection he gets causes more damage to his lungs. 'It eases the pressure on us by being at home – Norman gets really agitated in hospital and likes the comfort of his own bed. He also loves drawing and painting, which he can't do in hospital.' The couple have used the Hospital at Home Service four times since January. Each time, care was provided for between one and two weeks. On the first visit they were provided with monitoring equipment, including a blood pressure cuff and thermometer, linked to a mobile phone that sent readings to the care team four times a day. Norman was also able to receive nebuliser treatment and oxygen support without leaving the house. The couple are encouraged to call for help whenever they need it, with a nurse sent to their home if required. Tina said: 'At first I was a bit wary because I'm not very techy, but it was so straightforward. They reassured us we could call any time, and they really meant it. 'For me, it's just easier being here with him. When he's in hospital I'd be up and down every day, juggling work and everything else. Now I can support him if needed. 'Without this service, he'd be in hospital longer, he'd be more anxious, and it would take him longer to recover.' Norman said: 'It has made a big difference to our life. The staff are so helpful and cheery – they always comes in with a smile on their face. They are fantastic.' Bill Denholm, 85, from Stenhousemuir was recently treated by NHS Forth Valley's Hospital at Home team. His wife Marion, 82, said: 'There are no words to adequately describe the care and attention Bill received. 'We've had doctors, advanced nurse practitioners, physiotherapists, occupational therapists, a dietitian and a speech and language therapist all visit our home to provide the care and treatment he required so he didn't have to go into hospital. 'This meant he was able to stay in familiar surroundings with his family and still receive the same type of care he would have in hospital. I also felt very supported as I could contact the Hospital at Home team direct if I had any worries or concerns. 'I can't praise the Hospital at Home service enough. It makes so much more sense to treat people in their own homes if you can rather than occupy a bed in a busy hospital. It's definitely a win-win for everyone involved.' The report estimated £39m has also been saved due to reduced healthcare usage in the six months following hospital at home discharge. More than 1,600 patients were treated on average each month, up from 1,400 on the previous year, with around 15,470 people prevented from spending time in hospital. More than 650 extra hospital beds and almost 500 care home admissions would have been required over the year if hospital at home services did not exist. Belinda Robertson, associate director of Improvement at Healthcare Improvement Scotland, said: 'It seems that Hospital at Home is very much here to stay. We are finding that more NHS boards are not just increasing the numbers receiving acute hospital care at home, but that their services are maturing, becoming more efficient and being set up in such a way as to ensure they are sustainable. 'Making sure that Hospital at Home services are sustainable in terms of resources and capacity has been one of our main focuses over the past year, and we're delighted to see Scotland's NHS boards achieving this. 'For patients, the benefits of being able to be treated in the comfort and familiarity of their own homes is clear to see and this is set to continue.' The Hospital at Home service mostly provides care for frail, older people in their own homes who may be suffering from acute illnesses and health conditions such as respiratory and cardiac issues, infections, or require treatment after a fall. First Minister John Swinney recently announced funding of £85m which will allow 2,000 beds across Scotland to be made available through the Hospital at Home service. Health secretary Neil Gray said: 'This report shows we are delivering personal, efficient and reliable care to patients across the country. Our expansion of Hospital at Home means more people will benefit from first-class NHS care in the comfort and familiarity of their own homes. 'By increasing capacity to 2,000 beds by December 2026, we're on track to create the largest 'hospital' in Scotland – bringing care closer to where people live and need it most. 'I am delighted to see the positive impact Hospital at Home is having across Scotland, particularly for elderly patients who can now receive high-quality care without the need to travel to hospital. I am grateful to all of the partners who are delivering this service and look forward to its further expansion in the months ahead.' The Lost Elms by Mandy Haggith review – cultural history of a noble tree
Just as the Spanish flu pandemic of 1918 did not originate in Spain, so Dutch elm disease is no fault of the Netherlands. It acquired the name thanks to the pioneering efforts of three Dutch scientists – Marie Beatrice Schol-Schwarz, Christine Buisman and Johanna Westerdijk – who identified the beetle-transported fungus that causes it in the 1920s. Nor is the so-called 'English elm' (Ulmus minor) really English, inasmuch as it is thought to have been transferred here from Italy, so Reform UK party enthusiasts should probably agitate to repatriate all such specimens. More confidently thought native to these isles is the wych elm (from the Old English for 'supple') or Scots elm, which has long been thought to have healing and protective qualities. Our scholarly guide to this noble plant, Mandy Haggith, delves enthusiastically into such lore. The 17th-century English herbalist Nicholas Culpeper said that elm was connected to the planet Saturn and that its leaves could fix broken bones. Modern 'healers' promise that drinking a decoction of elm bark can purge phlegm and stop diarrhoea. Haggith cites a present-day 'Massachusetts-based herbalist and druid' who claims that slippery elm milk is good for insomnia. It would be unkind to call this sort of thing merely barking. The author insists that 'a western scientific worldview' (in other words, a scientific worldview, shared by scientists in China and India) 'is absolutely not the only way forests can be thought about', which is fair enough. But the fake cures of the 'wellness' industry are not without their own ecological downsides: as Haggith writes later, fashionable pseudo-remedies gone viral on TikTok or whatever can inspire the stripping of bark from healthy trees at injurious scale. Happily, elmwood was not only the preserve of quacks; it was also a sought-after material in shipbuilding (most of the hull of the fast clipper Cutty Sark was made of rock elm), and long before that for making spears and bows: an iron age Celtic tribe was known as 'the ones who vanquish by the elm' (Lemovices). Medieval London, Bristol and other cities had running water delivered by mains pipes of elm. And elm is also the source of a famous insult: when the great Samuel Johnson claimed that there was no Gaelic literature, a poet responded with the Gaelic for 'your head is made entirely of elm, especially your tongue and your gums'. Luckily, although Dutch elm disease has killed hundreds of millions of trees since the early 20th century, the species is not lost, or even on the brink of extinction. Brighton, Haggith sees, is managing the blight well through city-wide surveillance and timely surgery. And the fossil record suggests that elms have previously suffered waves of pandemic disease before bouncing back. There will be time for more poetic mentions of elms of the kind the author rather exhaustively collects towards the end. ('Robert Frost was a big fan of elm trees …') But the greater part of this book's devotion, and its delight, is reserved for living specimens in their habitats. Two rows of elms, Haggith notes, can form a 'corridor for wildlife, dog walkers and feral children', or 'a church-like nave, an arch-shaped cloister that draws the eye' towards a monastery in Beauly. A cheerfully self-described 'tree-hugger', she is inspired to her best writing by close observation of the trees themselves. On an elm growing horizontally out of the rock near a Scottish loch: 'I stand beneath it, neck craned in awe, looking up into the lush green profusion of its living community. It is winter, so all this greenery isn't the tree's own leaves, but photosynthesising life using it as a climbing frame'. Elsewhere she finds beauty even in a diseased log, happily noting the 'beautiful doily pattern made by the brood-chamber and feeding passages of the grubs'. And her enthusiasm is contagious.
