Municipal meltdown: Hlabisa blames debt crisis on failing revenue collection

Municipalities are drowning in debt largely because they cannot collect the money they are owed, according to Cooperative Governance and Traditional Affairs Minister Velenkosini Hlabisa.
Hlabisa made the remarks Monday at a national dialogue in Midrand, north of Johannesburg, under the theme "Every Municipality Must Work – A Call to Collective Action."
More than 300 representatives from political parties and municipal councils gathered to reflect on the relevance of the 1998 White Paper in the context of local government performance.
Hlabisa emphasised that the gathering was intended to facilitate open dialogue rather than deliver firm decisions.
'As we embark on this critical process, we recognise the crucial role political parties play in shaping the future of our local government system,' Hlabisa said.
'Local government is where policies become services, promises become infrastructure, and governance becomes tangible.'
He said that while some municipalities are performing well, most are underperforming, plagued by financial mismanagement, poor governance, and over-reliance on consultants.
'All 257 municipalities in South Africa are governed by political parties, either through majority or coalition governments,' he said.
'We therefore recognise the central role of political parties and value your input as we seek to improve the White Paper on Local Government.'
Many municipalities in the country are facing tough times, with many re-dealing with financial pressure, outdated infrastructure, poor service delivery, and leadership challenges.
These problems often come as a result of weak financial management, corruption, a shortage of skilled staff, and too much political interference.
Hlabisa said the failure of municipalities to generate sustainable revenue, particularly in under-resourced or geographically disadvantaged areas, has left many unable to meet basic obligations like paying salaries or contributing to pension and medical aid schemes.
'A one-size-fits-all approach will not solve these issues,' he said.
'We need a differentiated strategy and must consider running municipalities like businesses - with appropriate funding, structures, and remuneration for councillors.'
Meanwhile, Auditor-General Tsakani Maluleke has voiced support for the ongoing review of the 1998 White Paper on Local Government.
'I just want to put on the table that our reflection as an auditor office is that the 1998 White Paper was fantastic.
'It's good to review it…but that must be followed by a very bold and courageous assessment and recommitment to implementing it. And implementing it as I see it, it's going to take political parties genuinely thinking about who were deployed to take on the rule and responsibilities in the municipal space.'
IOL News previously reported that Maluleke's 2023 and 2024 local government audit report, tabled in Parliament last week, echoed Hlabisa's concerns.
Only 41 municipalities received clean audits. While 59 municipalities improved since the 2020 and 2021 financial years, 40 regressed.
Maluleke said that 99 municipalities received unqualified audit opinions, meaning their financial statements were credible.
However, many had significant compliance and performance reporting issues. Of these, 71 failed to submit quality financial statements and relied on auditors to correct errors.
In total, 219 municipalities spent R1.47 billion on consultants for financial reporting, yet 130 still submitted flawed financials - which highlighted the ineffective spending.

Reports detail 'wide range of misconduct' The 39 forensic reports mentioned by Lesufi on Sunday follow the 47 reports announced by the premier on 24 June. 'The released reports detail investigations into serious offences and improper behaviour across multiple departments. They cover a wide range of misconduct, from criminal acts to minor breaches of conduct,' he said on Sunday. The Gauteng premier said the reports will not be released at this stage, to avoid 'harming the enforcement or implementation of the recommendations'. 'We are aware that releasing certain details early might disrupt ongoing legal cases or make it harder to follow the recommendations, including putting whistleblowers' identities and safety at risk.' Probe into rot at North West's Madibeng local municipality
A whistleblower's report has led to a formal probe into allegations of corruption and nepotism at Madibeng. Many years of maladministration, including allegedly unlawful appointments of officials and acts of nepotism at Madibeng local municipality in North West will come under scrutiny during a three-month investigation ordered by Minister of Cooperative Governance and Traditional Affairs, Velenkosini Hlabisa. The Citizen has, over the years, reported on many cases of alleged nepotism and unprocedural appointments of senior officials under mayor Douglas Maimane. Whistleblower raises alarm on irregular appointments The problem was also reported to the public protector several times by a concerned resident. North West MEC for cooperative governance, human settlements and traditional affairs Oageng Molapisi is set to undertake the probe after Hlabisa's instruction. The matter was brought to the minister's attention by a whistleblower who raised alarm about endemic cases of irregular appointments of municipal officials and service providers. Spotlight on the appointment of Quiet Kgatla A prominent alleged irregular appointment was that of municipal manager, Quiet Kgatla. Attempts to have Kgatla's appointment reversed were frustrated by some councillors, apparently including Maimane, who stayed away from meetings, forcing the council not to quorate. A number of council sittings collapsed due to stayaways by some councillors when the matter was on the agenda. NOW READ: Court reinstatement of suspended Madibeng manager Quiet Kgatla Internal audit flags unqualified appointees and favouritism A recent internal risk-based audit review that found Kgatla had been irregularly appointed as he did not possess the prescribed qualifications – a bachelor's degree in public administration or political science, social sciences or law. However, the official, in addition to his matric certificate, possessed other qualifications – a BCom degree, BCom (honours) and CA (SA). The recruitment process was handled by Maimane's office. The audit expressed concern about possible favouritism or nepotism leading to questions about fairness and an equal opportunity recruitment process. The audit found that four other candidates were not shortlisted, although they met all the requirements for the position. It suggested that the matter be referred to Maimane to resolve. It was recommended that the Madibeng council reconsider Kgatla's appointment as it contravened the Local Government: Municipal Systems Act. The legislation provides for an appointment to be declared null and void if the person does not have prescribed skills, expertise, competencies or qualifications. Bypassing of supply chain processes leads to suspensions The audit also found Kgatla's appointment was done outside the corporate support services. In another case, three senior officials were suspended pending an investigation of possible misconduct. The officials, Ofentse Masilo, chief financial officer, Morufa Moloto and director of human settlements, Walter Phala, allegedly bypassed the supply chain management process and hired service providers irregularly last year. Allegations of nepotism linked to mayor's family It was previously reported by The Citizen that Maimane allegedly hired members of his family to administrative positions in his office, including his daughter while a son was allegedly offered municipal contracts. He did not deny that his daughter was an employee in his office, but his son vehemently denied ever receiving any municipal contract. Molapisi confirmed that he had invoked Section 106 of the Municipal Systems Act to investigate allegations of maladministration and malfeasance in Madibeng. He appointed a law firm to conduct the probe pertaining to irregular senior appointments and service providers. The MEC said the probe would start in three months. 'The allegations are of a serious nature and we expect councillors and officials of the municipality to cooperate and assist in providing the necessary information that will assist the investigation,' Molapisi said. Grim report on state of KZN municipalities - more than half at risk

Image: Supplied Only 19 of the 54 municipalities in KwaZulu-Natal are stable while 28 are deemed 'at risk' and seven are 'in distress,' according to a report looking into the state of municipalities in the province. The report was tabled during a meeting between the Department of Cooperative Governance and Traditional Affairs (Cogta) and municipalities held in Durban on Monday. Top government officials stated that if a municipality is unstable, it affects service delivery to communities, something that should be avoided. The provincial treasury has indicated that it has experts ready to be deployed to any struggling municipalities. The report, titled Back to Basics, examined the state of local government between last year and March this year and was finalised in May this year. It is part of Cogta's ongoing work to monitor the performance of municipalities by undertaking a comprehensive analysis of their state. This includes identifying common and specific challenges impacting the stability and functionality of municipalities in delivering services to communities. The assessment outlined the process for this evaluation, stating that key performance indicators were allocated a weighting, and points were assigned according to the actual performance against these indicators. The KZN assessment revealed the following findings in terms of categorising municipalities: 19 municipalities were found to be 'stable' and require normal monitoring; 28 municipalities were categorised as 'at risk' and require close monitoring and Section 154 support; Seven municipalities were categorised as 'in distress' and require high-priority, hands-on targeted intervention. The report stated, 'Since the advent of a democratic local government, there have been many government support programmes aimed at advancing service delivery and institutional support to municipalities, the latest being the Back to Basics programme and the District Development Model.' 'The national government has also allocated significantly large sums of money in the form of grants to build municipal capacity and to address the municipal infrastructure backlog over the years. Despite the valuable service delivery milestones that have been achieved since the dawn of democracy and the support provided, it is clear that local government still remains in distress and has not reached the sustainability stage as envisaged by the White Paper in 1998.' Many assessments have been undertaken, and generally, at the forefront of local government challenges are the following: Poor political and administrative interface and weak leadership Intra and inter-political party differences negatively affecting municipal stability, governance, and service delivery Poor communication and accountability to communities Ageing infrastructure and minimal budget allocated to infrastructure maintenance leading to violent service delivery protests Escalating maladministration, fraud, and corruption, with weak consequence management Insufficient municipal capacity due to inadequate skills in people occupying critical positions Poor financial management and negative audit outcomes Service delivery backlog and non-payment for services, leading to municipal financial distress. However, the assessment recorded good work being undertaken by a majority of municipalities in KwaZulu-Natal. Many councillors and officials work under extremely difficult conditions, yet they continue to perform well. However, the assessment has found that there are still stubborn governance, administrative, financial, and service delivery challenges that consistently prevent the achievement of the objectives of developmental local government. Marlaine Nair, the chairperson of the Cogta portfolio committee, said the instability of municipalities directly affects service delivery. 'As the Cogta Portfolio Committee, we are calling on the Department of Cogta to not just provide support to municipalities in need but also ensure that there is swift consequence management to avoid repeat irregularities and ongoing corruption and maladministration. Corruption must be rooted out. 'We also call on councillors to properly perform their oversight duties. We cannot have councillors turning a blind eye and accepting write-offs of billions without proper reasoning or the tabling and support of unfounded budgets,' she said. Finance MEC Francois Rodgers expressed concern about poor fiscal management at the local government level, stating, 'As Treasury, we have always made it clear that we have a task team that can and will assist municipalities when it comes to fiscal compliance, but the reality is that we need the political buy-in from the mayor and council. Often, where we do try to assist, like in uMkhanyakude, we don't get that.' Acting Cogta HOD, Dr Joey Krishnan, said the MEC in his Budget policy speech announced measures aimed at stabilising and improving the seven distressed municipalities. 'We are focusing on targeted support to municipalities for them to do what is expected of them. This includes financial experts and other forms of technical support including the Provincial Project Management Unit, which will ensure that catalyst projects are implemented to unlock growth. 'We are also rolling out the cluster model which brings the department closer to these municipalities. As we saw yesterday (Monday) through these cluster engagements, accountability and service delivery take centre stage with other key stakeholders such as Eskom, the Water Board, and the AG, amongst others being afforded the opportunity to engage directly with municipalities with the aim of resolving bottlenecks,' said the acting HOD.
