Lokpal gives clean chit to Madhabi Puri Buch in Hindenburg case

The Lokpal on Wednesday (May 27, 2025) disposed of all three complaints against Madhabi Puri Buch, former Chairperson of Securities and Exchange Board of India (SEBI), in the Hindenburg case, granting a major relief for Ms. Buch as well as the market regulator she once headed.
A full bench of the Lokpal headed by Chairperson Justice A.M. Khanwilkar delivered the judgment.
'We have concluded that the allegations in the complaints are more on presumptions and assumptions and not supported by any verifiable material and do not attract the ingredients of the offences in Part Ill of the Act of 1988, so as to direct an investigation therefor. Accordingly, these complaints are disposed of,' the bench said in its order. The Act here refers to the Prevention of Corruption Act, 1988.
Referring to Hindenburg report, it said that the complaints were essentially founded on the report 'by a known short seller trader whose focus was to expose or corner Adani Group of Companies'.
'As noted in our order dated 20.09.2024, that report by itself cannot be made the sole basis to escalate action against the RPS [Ms. Buch],' the order stated.
'The complainants, being conscious of this position, advisedly attempted to articulate allegations independent of the stated report but the analysis of the allegations by us ended with a finding that the same are untenable, unsubstantiated and bordering on frivolity,' the order said.
'The scope of inquiry at this stage is not to verify the veracity or otherwise of the information received but only to ascertain whether the information reveals any cognizable offence,' the Lokpal observed.
Stating that this being a case of corruption alleged against a public servant, the bench added they had to reckon the plea or the comment offered by the concerned public servant with care and circumspection.
As per the order, the subject matter of these complaints was identical, though filed by separate complainants.
Five allegations
Broadly, there are five allegations against Ms. Buch: She and her husband invested a substantial amount in a fund linked to investments in Adani Group of companies, the group facing scrutiny before SEBI for stock price manipulations.
She failed to disclose the investments in obscure funds to the Board of SEBI and the Supreme Court-appointed Expert Committee.
She gained quid pro quo in the garb of consultancy services fees by AAPL, a firm in which she had 99% of ownership, and through her husband Dhaval Buch, from entities such as the Mahindra & Mahindra Group and Blackstone Inc., firms having regulatory cases pending before SEBI when she was a wholetime Member or Chairperson of SEBI.
She gained quid pro quo in the garb of rental income from Carol Info Services Private Limited, allegedly linked to Wockhardt Ltd, a firm under investigation by SEBI for insider trading.
She gained undue advantage by selling her ESOPs (employee stock ownership plans) from ICICI Bank over a period of five years from 2017 — though the same had been vested in RPS in 2013 — during which period ICICI Bank had regulatory issues pending before SEBI and any adverse action against it would have influenced the market price of the ESOPs of Ms. Buch.
She made a pretence of recusal from matters of M&M Group and Blackstone Inc., but nothing prevented her from influencing the other wholetime Members and the Board of SEBI for a favourable outcome of cases pending and under investigation by the regulator against the entities, and which she did owing to her official position.
Ms. Buch had denied all the allegations. The Hindu had contacted her for a comment on the Lokpal order and her comment is awaited.
'Unnecessary to analyse reported decisions'
'We may also make it amply clear that for the findings reached in this decision on the relevant facts, it is unnecessary to dwell upon the purport of Section 50 and 51 of the Act of 2013 for action taken in good faith. That aspect has already been implicitly answered in favour of the RPS [Ms. Buch],' the order said. The Act here refers to the Lokpal and Lokayuktas Act, 2013.
'The parties have relied upon reported decisions. However, we do not deem it necessary to burden this order by analysing the same, as the factual matters have been analysed and dealt with in this order keeping in mind the ingredients of the offences under Act of 1988 invoked by the complainants. We have unreservedly answered the same in favour of the RPS [Ms. Buch],' it pointed out.

As Chief Minister Omar Abdullah said he will launch a signature campaign to seek statehood for Jammu and Kashmir, the opposition, in a scathing attack, said he 'owes an apology and not a signature campaign'. Saying that signature campaigns have no legal or constitutional sanctity, the opposition questioned his 'reluctance' in passing a resolution for statehood in the assembly. 'Omar Abdullah owes an apology, not a signature campaign for normalising 5th August. With 50 MLAs behind him, he has reduced the fight for J&K's statehood to token gestures, after seeking votes door-to-door on the promise of restoring pre–5th August status,' senior Peoples Democratic Party leader Waheed Para said. 'This is not just a retreat, it is a betrayal. The people gave him a historic mandate to fight for Article 370 and statehood, not to stage political theatre.' Para said that if Omar has already surrendered, he 'must admit it and apologise to every citizen of J&K for selling promises he never intended to keep'. In his Independence Day speech, Omar said, 'We will have to leave the offices, and now we will have to raise our voice to those doors where our decisions are being made. Till now, through letters, resolutions, and meetings, we have raised our voice. Now we are going to raise our voice from every village of J&K to Delhi.' 'My intention today is that the Supreme Court has given us eight weeks… Henceforth, my colleagues and I will not sit idle. We will not get tired. 'Can CM sahib please, once and for all times to come, explain his reluctance to have a resolution for statehood passed in the Legislative Assembly. Let us approach the Supreme Court as a constitutional entity.' Calling the door-to-door signature campaign 'theatrics', Lone assured unconditional support for the statehood campaign. 'I would strongly assert that pass a resolution in the state Assembly. That is the most dignified way to approach the Supreme Court,' Lone said. MUMBAI: The Bombay high court on Thursday reprimanded a section of residents of the Jaku Club slum pocket in Santacruz East for blocking the redevelopment of their settlement for nearly four years and directed the Slum Rehabilitation Authority (SRA) to evict them under police protection and vacate the site within two weeks. HC paves way for Santacruz slum redevelopment stuck for 4 years 'Any defiance to the rule of law must be dealt with…an iron hand so that the faith of the people in the judicial system is maintained,' the division bench of justices Revati Mohite Dere and Dr Neela Gokhale said, upholding a petition filed by Siddhivinayak CHS, a proposed co-operative housing society formed by the slum dwellers, and Arihant Construction, the developer appointed by the society for redeveloping the settlement. The petitioners had sought directions to the SRA to implement its own order dated February 16, 2024 and eviction notices issued to slum dwellers on March 19, 2024 under the Maharashtra Slum Area (Improvement, Clearance and Redevelopment) Act, 1971 and begin eviction proceedings against non-cooperative slum dwellers. Any obstruction to implementation of the court's order would be treated as 'interference with the administration of justice' and 'dealt with accordingly', the court warned. According to the order, the Jaku Club neighbourhood, declared a slum in 1977, is spread over seven plots and houses 362 families. Among these, 271 families were found eligible for free rehabilitation in the redevelopment project, which was granted a commencement certificate in September 2021. Out of the 271 families eligible for rehabilitation, 152 families vacated their premises after receiving rent from the developer, to the tune of ₹17,000 per month. The developer has deposited over ₹6.5 crore with the SRA as transit rent for the 271 eligible families , with annual expenses estimated at ₹2.95 crore, the order said. Slum dwellers opposing eviction had filed multiple petitions challenging the SRA's notices dated February 16, 2024 and March 19, 2024. The court had dismissed these earlier, saying redevelopment could not be delayed until every eligibility claim was decided as it would make execution of the project impossible. In June 2024, while dismissing one such petition, the high court noted that interests of even pending claimants were protected through deposited rents. When the claimants filed an application subsequently to recall the judgment in, the high court came down heavily on the 'pattern' of last-minute litigation aimed at stalling demolition drives, calling it an 'abuse of judicial process' and imposing a fine of ₹10,000. In September 2024, the Supreme Court dismissed a special leave petition against the high court order. Despite these court orders, the SRA was facing threats and intimidation from some residents and had been unable to secure police help to evict them, SRA officials told the court. The bench expressed deep concern and directed the Vakola police station to provide necessary assistance to the SRA in evicting slum dwellers and vacating the property within two weeks.

Mumbai: Four men were arrested by the cyber police for an investment fraud where, perhaps for the first time, a victim was summoned overseas by scammers to assure him of the safety of his investments. The victim, a 62-year-old suburban businessman, gradually figured out that something wasn't right, but it was too late. He had already lost Rs 5.24 crore to the scammers. Police investigations have revealed that some of the accused were previously involved in duping over 30 people from Mumbai, Pune, Bengaluru, Kerala and Chennai in different frauds running up to Rs 65 crore. The accused, R Menon, 35, Manikandan, 32, H Pandi, 38, and a fourth individual were arrested from Chennai by west region cyber police. The elderly businessman was scammed by these men over nine months. One of the accused approached him in Oct 2024, claiming to be employed with a Dubai-based investment firm that offered great returns on investments. He connected the complainant over the phone with Menon, the "firm's director." Menon told the complainant that he would receive 10% returns per month and, additionally, shares of the same value as his investment would be transferred to his demat account. But instead of the firm's bank account number, he was provided with the personal account number of Manikandan (another accused) for making payment. When he pointed out the issue, he was told Manikandan was the firm's employee and would eventually transfer all the investors' money into the firm's bank account in bulk. In Dec 2024, the scammers told the complainant that his investment earned a profit. He could withdraw about Rs 90,000. This strengthened his faith in the firm. He received an email purportedly from "SEBI" about shares being transferred into his demat account. Till Feb, the complainant paid Rs 5.24 crore in total. In March, the scammers invited him to Dubai to assure him of the safety of his investments. But when he flew to Dubai, he discovered that the firm's office did not exist. He then dialled Menon, who claimed he was in the US. The complainant smelt a rat and demanded a full refund. "The accused then sent him fake cheques, demand drafts, letters from the I-T department, and an email from a trading platform to con him into believing that his money was being refunded and shares were transferred in his name. But none of it actually happened," said a police officer. After a probe, police officers sourced some of these fake documents to Menon's phone. A team led by DCP Purushottam Karad and comprising senior inspector Suvarna Shinde and sub-inspector Vijay Ghorpade seized watches and other material from the accused.
