HC directs Khurda collector to dispose of trust plea against eviction within 1 month

Cuttack: Orissa high court on Tuesday directed the Khurda district collector to dispose of within a month a grievance petition filed by a temple trust regarding eviction proceedings from the Khandagiri caves located on the outskirts of Bhubaneswar.
Justice S K Panigrahi ordered that "no coercive action shall be taken against the petitioner till the disposal of the grievance petition", restraining eviction proceedings initiated by the authorities.
The dispute arose after Maa Barabhuja Temple Managing Trust, which oversees worship and welfare activities in the area, submitted a grievance petition to the commissioner-cum-secretary of the general administration (GA) department on Oct 28, 2024, seeking alienation or lease of 0.156 acres of scheduled land across five plots in use by the trust.
Despite its cultural and religious significance, eviction notices were served on the trust by the authorities on Nov 8 that year.
The Khandagiri caves, protected by the Archaeological Survey of India since 1912, are a heritage site dating back to 2nd century BC and associated with Jainism. However, over the decades, the caves have also become the site of Hindu religious practices. Cave numbers 8 and 9 are used for the worship of Barabhuja Thakurani and Mahavir (Hanuman), while Jangleswar Mahadev is worshipped in another cave.
The annual 'Magh Saptami Mela', organised every Feb by the state govt in collaboration with the trust and local organisations, draws thousands of devotees, including monks who stay in the caves. The trust, recognised by the commissioner of endowments, also manages free facilities such as toilets, kitchens and rest areas at the base of the hill.
Despite the the Board of Revenue forwarding the trust's petition to the Khurda collector on Dec 6, 2024, no action has been taken, the trust stated in its petition.
Taking note of the facts and submissions, Justice Panigrahi disposed of the petition with a directive to the collector to take appropriate action "within one month from the date of production/presentation of a certified copy of this order".
The order comes as a temporary relief to the trust and the local religious community, allowing the continuation of their longstanding activities while their claim is under official consideration.

'If PM Modi listens to his 200 speeches that he has given so far in Bihar, he will be ashamed to come to Bihar. He made hundreds of promises, he will be ashamed of what to say to the people of Bihar... He is not coming to Bihar to provide employment, reduce inflation, eliminate poverty, but just to do the politics of Hindu-Muslim, the politics of hatred,' Yadav told ANI earlier today. Prime Minister Narendra Modi is set to visit Bihar tomorrow (June 20), where he is scheduled to address a public gathering in the Siwan district of the state. Earlier, as Deputy CM Vijay Kumar Sinha urged people to attend the event in large numbers, he said that PM Modi will highlight the resolution for 'Viksit Bihar' and give a message for 'freedom from nepotism.' 'The hero of development, the country's successful Prime Minister Narendra Modi is coming to Bihar on June 20. Along with the resolution of 'Developed Bihar', he is coming to give the message of freedom from nepotism to the country. There is a humble request to all of you to reach Siwan in maximum numbers and support the Prime Minister in this movement to free Bihar from the politics of destruction,' Sinha said on Wednesday Regarding nepotism, the RJD leader claimed that while the BJP criticises others of family-politics, half of the ministers in the state cabinet are dynasts, while also repeating his claim of NDA being a 'National Daamaad Aayog.' 'They keep abusing us about family politics, but their alliance is filled with dynastic politicians, and the same thing is true even in their party (BJP). In Bihar, over 50% of the ministers are dynasts... NDA in Bihar means 'National Daamaad Aayog'. PM Modi has fitted everyone's son-in-law in the 'Aayog',' the RJD leader said. We all know new parties are being formed in Bihar under the RSS quota. All the new parties that have been formed will be seen nowhere once the election is over in Bihar,' the RJD leader said. Prashant Kishor is the founder of the Jan Suraaj Party, started on October 2, 2024. Kishor, an election strategist turned politician, had announced in July of 2024 that his party would be contesting all the assembly election seats. Meanwhile, Kishor hit out at Tejashwi Yadav's nepotism jibe, claiming that Yadav only wants to see Nitish Kumar's son in politics so he can also raise allegations of nepotism instead of facing the allegations himself, with Yadav being the son of former Bihar CM Lalu Prasad Yadav. Kishor told reporters in Gopalganj, 'Tejashwi Yadav and his family face allegations of nepotism. Tejashwi Yadav wants that if Bihar CM Nitish Kumar's son also joins politics, he will say he is not the only one who faces allegations of nepotism. As far as I know, Bihar CM Nitish Kumar's son will not join politics and was not going to.' (ANI)

Hyderabad: Telangana Jagruthi President and BRS MLC Kalvakuntla Kavitha on Wednesday said that if the state government fails to implement 42 per cent reservation for Backward Classes (BCs) in the upcoming local body elections, her organisation would stall the election process by filing hundreds of nominations in every village across the state as a form of protest. Addressing a press conference here at her residence on Wednesday, Kavitha criticized Chief Minister A Revanth Reddy for failing to raise the BC reservation bill issue with Prime Minister Narendra Modi, despite having visited Delhi numerous times. She sarcastically remarked that Revanth could earn a Guinness World Record for the most visits to Delhi without achieving any results. MLC Kavitha alleged that the Chief Minister was not genuinely committed to securing approval for the BC Bill. Kavitha ridiculed the BJP's plan to organize a 'Telangana Vikasit Yatra' in support of the BC Bill. She stated that unless the BJP clearly supports the BC Bill, people will not trust their political moves, regardless of how many rallies they organize. She expressed condolences on the death of Telangana Maoist leader Gajjala Ravi in an encounter and extended sympathies to his family.

KOCHI: Expressing concern over the selection process for appointing teachers in government-aided schools, the Kerala High Court has observed that prima facie, it appears there is a significant nexus between the managements and the educational authorities regarding teacher appointments, which are not based on merit but rather on considerations other than merit. Justice D K Singh noted that it seems the manager has absolute discretion to appoint anyone qualified as a teacher at the school without following any selection process or advertising the posts. Furthermore, how these appointments are approved by the educational authorities when the due process of selection is not ensured raises questions. The court directed the Director General of Education to file an affidavit explaining the steps taken to establish a fair selection process for teachers in government-aided schools, aiming to stop the malpractice prevalent in these appointments. If the affidavit is not submitted by June 20, the court has instructed the Director General of Education to appear in person before the court. The order was issued while considering a petition filed by a group of teachers challenging the levy of contributory pension in the NPS Scheme from their salaries.
