Father's Day 2016 shooting case continues in federal court

SYRACUSE, N.Y. (WSYR-TV) — Day five of the Gary Porter trial continued in federal court on Monday.
The 41-year-old was shot and killed by Syracuse Police Officer Kelsey Francemone on Father's Day of 2016. The shooting happened on the city's west side at an apartment complex near Skiddy Park.
A grand jury cleared Francemone of criminal wrongdoing, saying her actions were justified. But nearly a decade later, the case has not been put to rest. Porter's daughter filed a lawsuit against Francemone, alleging she was reckless and malicious.
A detective with the Syracuse Police Department took the stand on Monday. The defense questioned him about evidence found at the crime scene, including shell casings.
The trial will resume on Tuesday.

Boxer Gervonta Davis will not face domestic violence charges

Boxer Gervonta Davis will not face misdemeanor charges for battery-domestic violence because the alleged victim, Davis' former girlfriend, and the alleged witness, the woman's mother, failed to cooperate, according to the Miami State's Attorney Office. Davis, 30, was arrested July 11 and the charge stemmed from an alleged incident with his former girlfriend, who is the mother of his two children, on Father's Day, June 15, in Doral, Florida. "This case was dropped as the victim is declining to prosecute per her … attorney," Ed Griffith, Public Information Officer for the Miami State's Attorney Office, told USA TODAY Sports by email. "Her sentiments were directly confirmed by the Assistant State Attorney handling the prosecution. "The witness to the incident, who is the victim's mother, also failed to cooperate and failed, after being subpoenaed for a prefile conference on Thursday (Aug. 7). Followed up attempts to contact the witness via phone were unsuccessful. The incident itself was not observed by the police officer who had been called to the scene eliminating him as a possible witness to what had transpired." With the dropping of the criminal charge, the $10,000 bond required as a part of the pretrial release was dismissed, according to Griffith.

As California Gov. Gavin Newsom called for a special election for redistricting, numerous federal agents conducted a raid nearby. Just as California Gov. Gavin Newsom was announcing a special election for state redistricting at a cultural center in Downtown Los Angeles, numerous federal agents showed up nearby. While Newsom was inside the Japanese American National Museum on Aug. 14, stating his proposed changes to California's congressional districts to counter Texas Republicans' plans to create more GOP-friendly districts in their state, a group of federal agents was conducting immigration enforcement patrols in L.A.'s Little Tokyo district. Newsom and his press office both took to social media to announce the agents' presence, with an homage to President Donald Trump's punctuation and rhetoric. 'BORDER PATROL HAS SHOWED UP AT OUR BIG BEAUTIFUL PRESS CONFERENCE! WE WILL NOT BE INTIMIDATED!' the post said. U.S. Border Patrol Sector Commander Gregory Bovino told KNBC-TV that the agency was conducting roving immigration enforcement patrols in the area. Bovino told the station that one person was taken into custody and detained for being in the U.S. illegally. Los Angeles Mayor Karen Bass later told news media on site, "There's no way this was a coincidence," noting that the news conference featuring Newsom, Attorney General Rob Bonta and Sen. Alex Padilla, among others, was well-publicized. "They decided they were going to come and thumb their nose in front of the governor's face," Bass said. "Why would you do that? That is unbelievably disrespectful. It's a provocative act. They're talking about disorder in Los Angeles, and they are the source of the disorder in Los Angeles right now." The Department of Homeland Security did not immediately return USA TODAY's request for comment about the patrol in the area.
