DMK MLA S Kathiravan defends his father's hospital, asks why he needs to profit from transplants

TIRUCHY: After the state government decided to permanently cancel the kidney transplant licence of Dhanalakshmi Srinivasan Medical College and Hospital for its alleged involvement in a kidney trafficking racket, Manachanallur DMK MLA S Kathiravan, whose father owns the hospital, became emotional and asked why would he need profit from kidneys. 'We are only doing this as a service. I have a thousand ways to earn money,' he said. Kathiravan was addressing the party cadre and residents during his Makaludan Kathiravan campaign on Monday. 'I'll tell you the truth – no media has spoken about this. I have saved the lives of 252 people,' he said while responding to a man from the crowd who posed the question to the DMK MLA. The MLA detailed that each surgery required four doctors – three surgeons and one urologist – along with an anaesthesiologist and around 20 supporting staff. He asked whether anyone could carry out such complex procedures without following the law and pointed out that permission must be secured from three separate authorities. Lamenting that his life-saving efforts are being dubbed as scandal, the MLA said each operation costs Rs 10 lakh-Rs 12 lakh, largely for medicines, while the hospital would receive only Rs 2 lakh-Rs 3 lakh. The investigation into the scam found forged documents, inducements to donors, and other violations of the Transplantation of Human Organs Act, 1994. A source close to the MLA added despite the health department under the DMK government taking action, they are exploring all possible legal options. Hospital gets only Rs 2L - Rs 3L for each op 'We are only doing this as a service. I have a thousand ways to earn money,' Kathiravan said. Sebi bans Wadhawan brothers for five years in DHFL fund diversion case

The Securities and Exchange Board of India (Sebi) has barred promoters Kapil Wadhawan and Dheeraj Wadhawan for five years from the securities market for alleged fund diversion from Dewan Housing Finance Corporation (DHFL). The former promoters have also been prohibited from holding any key position in a listed company. The ban on Rakesh Wadhawan and Sarang Wadhawan is for four years each, while former Chief Executive Officer and Joint Managing Director Harshil Mehta and former Chief Financial Officer Santosh Sharma have been debarred for three years each. Sebi has imposed a total penalty of Rs 120 crore on all of them, with Kapil and Dheeraj each fined Rs 27 crore—the highest among the penalties. The regulator alleged their involvement in a fraudulent scheme under which loans were disbursed to 87 'Bandra Book Entities' (BBEs) connected to each other and to the DHFL promoter group. Sebi noted that 39 BBEs, which received Rs 5,662.44 crore from DHFL, transferred 40 per cent of this amount into 48 companies linked to the DHFL promoters. As of March 2019, the net outstanding loans to BBEs totalled Rs 14,040 crore. The regulator said these large unsecured loans to related parties with extremely weak financials were 'blatantly mischaracterised' as retail housing loans. 'The disguised nature of the BBE loans also delayed regulatory intervention and eventually threatened market stability,' said Sebi Whole-Time Member Ananth Narayan. Sebi will determine the quantum of illegal gains or benefits from the scheme and may take further action. It added that, had DHFL presented accurate financial statements and excluded 'fictitious' interest income from loans to BBEs, the company would have reported losses every year between FY2007–08 and FY2015–16. Instead, it continued to post profits. 'To effect this elaborate deception, a fake virtual branch ('Bandra branch') and previously closed retail loan accounts were employed alongside three different accounting software systems, camouflaging the BBE loans as retail housing loans. In the initial years, well over 30 per cent of all loans of DHFL were to these BBEs,' the order said. Sebi noted that the publication of false financials misled stakeholders and compromised the integrity of share price discovery, inducing investors to remain invested under the belief that 'all was well' at DHFL. An interim order in the matter had been passed by Sebi in September 2020, imposing initial restraints.

Ex-lifeguard sentenced to jail ‘till last day of life' for raping 3-year-old student in Greater Noida school

Noida: A special Pocso court on Tuesday convicted and sentenced a former swimming pool lifeguard at a wellknown school chain's Greater Noida campus to life imprisonment "till the last day of his natural life" for sexually assaulting a three-year-old student in 2018. The court, which pronounced a double life term under IPC and the protection of Children from Sexual Offences (Pocso) Act, also held the school's management financially liable for failing to protect the child and ordered the two investigating officers of the case to stand trial for "abetting the assault". Judge Vijay Kumar Himanshu of the additional district and sessions court cum special Pocso court convicted the former lifeguard, Chandidas, under Section 376AB of IPC and Section 5(m) of Pocso (aggravated penetrative sexual assault on a child under 12). Chandidas, who is currently out on bail, was also handed another seven-year term under Pocso Act Section 9(f), read with Section 10, for abusing his position as a school employee. The child, then a nursery student, was raped by the lifeguard during swimming class at the school's splash pool on July 12, 2018. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 20 Pieces of Clothing you should Ditch over 40 Learn More Undo She had told her class teacher about the incident. On returning home, she complained of stomach pain and discomfort. She later told her mother that the "swimming pool uncle" had touched her private parts. A medical examination at Delhi's Guru Teg Bahadur Hospital confirmed penetrative sexual assault. An FIR was lodged the next day at Surajpur police station. Chandidas was arrested from the school principal's chamber. Special public prosecutor (Pocso) Chhavanpal Singh said the prosecution presented 12 witnesses and 14 documentary and electronic exhibits and sought the harshest sentence not just for Chandidas but also for the school, which "failed to act as a custodian of its students". The defence argued that the child's family had a grudge against the school and had "tutored" her into making allegations that were unsupported by medical evidence. The court, however, found the child's statements to police, a magistrate and in court consistent and credible, and corroborated by medical findings from GTB Hospital. The testimony of her parents further supported her account. The court described the school management as a "joint tortfeasor" (legal term for an entity committing a tort or a wrongful act), noting that its inaction and suppression attempts directly contributed to the child's trauma. It cited its powers under Section 33(8) read with Section 9 of the Pocso Act to impose the Rs 10 lakh penalty on the school. "Their attempt to suppress and influence the machinery is clearly apparent and palpable, which cannot be done without the active connivance of the school management society. Hence, the court feels that the school management shall be made vicariously liable for the lapses in terms of awarding compensation for the mental trauma suffered by the victim and her family," the judge noted. The court found the roles of the two IOs, Sita Singh and Rashmi Chaudhary, dubious in the investigation. The IOs had filed a closure report against the principal and class teacher despite evidence available on record. "This court finds there is sufficient evidence available on record to show that to shield the co-accused, the principal and class teacher, both the IOs conducted defective and motivated investigation. Therefore, through deliberate and intentional omission in discharge of duty, they have abetted the offence of sexual assault amounting to rape against the child," the court said in its ruling, declaring the two IOs co-accused under Section 17 of the Pocso Act.
