A Texas bill targeting squatters would also hurt renters, leaving some homeless
More than 11 million Texans are renters. Renters and their families comprise more than 37% of the population. In 2023, approximately 400,000 families, or 3.5% of Texas renters, faced eviction.
According to the Eviction Lab at Princeton University, there are approximately 291,290 renter households in Travis County. Of those, approximately 13,384, or 4.6%, were the subject of an eviction filing in the last year. Similar Texas statistics illustrate possible renter peril statewide.
Texas rules require that an eviction hearing or trial be held in as little as six days after the tenant is served with a petition. Two bills making their way through the Texas Legislature would cut that time to just four days in an expedited process and allow a landlord to ask a judge to award back rent without evidence of the debt.
Proponents of House Bill 32 and its companion bill, SB 38, claim the bills target squatters. The Texas Apartment Association, a trade association of the rental housing industry, maintains the bill would close loopholes exploited by squatters and make removing them easier and less expensive.
But squatters are not tenants. They are trespassers — people who occupy dwellings without permission of the owner. The number of Texas squatters is unknown, but according to the National Rental Home Council, in 2024 there were just 475 in the Dallas-Fort-Worth area, or less than 0.1% of occupants in rental housing.
Yet the so-called anti-squatters bill would also apply to the 99.9% of people in rental housing who occupy their homes by virtue of a written or oral lease. It would almost certainly increase evictions across the state, cause housing instability and negatively impact tenants' physical and mental health.
Current Texas law already provides a fast track for landlords, requiring a tenant to appear before a judge more quickly than in any other type of civil matter. Typical response time in justice courts is 14 days. The law already gives tenants only six to 10 days to respond after being served with the petition, enabling a judge to quickly determine who is entitled to the premises and how much money, if any, a tenant may owe.
Reducing response time to four days means a tenant served with eviction papers on a Thursday night would have to respond in writing to the court by the following Monday.
Even when alternative housing can be found, tenants who are unable to respond in time are likely to find that the court has entered a judgment for back rent that is just like any other court judgment to collect a debt.
We understand Texas landlords face a growing problem with squatters, and we believe the Texas Legislature should explore all available options. Any relief should be targeted to address the harm caused by the 0.1% of occupants of rental housing characterized as squatters. The Legislature could easily limit the bills' expedited process to squatters and even provide more stringent criminal penalties.
Regardless of what course the Legislature chooses, it should not come at the expense of the due process rights of 11 million Texas tenants by giving them only four days to respond to an eviction suit.

Earlier this month, President Donald Trump said he would like to gain five congressional seats through a midterm redistricting effort in the state. The proposed changes mostly impact Democrat-held districts in the state's major metropolitan areas. What they're saying "Texas Republicans have finally revealed their new redistricting map, and unsurprisingly, it is drawn to represent Donald Trump, not the voices of Texans," Texas Democratic Party Chair Kendall Scudder said. "It is illegally drawn in a way that silences the voices of minority communities across Texas. When Donald Trump knows he can't win, he cheats, and Texas Republicans just proved they are unable to stand up to their wannabe dictator. Texas congressional districts should belong to Texans, who choose their representatives, but this proposed map lets the representatives pick their voters instead. This is designed for Donald Trump, not for Texans. Texas Democrats will use every available method to oppose this racist, desperate power grab. Nothing is off the table." Dallas-Fort Worth changes The new map targets three Democrat-held districts in the Dallas-Fort Worth area of the state. In District 33, the seat held by Marc Veasey, the new map would remove all the portions of Tarrant County that he currently represents. The new map would also reshape District 32, which is currently held by Democrat Julie Johnson. The revised district would favor Republicans. The district currently held by Casar would no longer include Travis County, while the district held by Doggett would no longer include a portion of Williamson County. Both Casar and Doggett issued statements on the new map Wednesday, which essentially merges the two districts. What they're saying "Merging the 35th and the 37th districts is illegal voter suppression of Black and Latino Central Texans. By merging our Central Texas districts, Trump wants to commit yet another crime— this time, against Texas voters and against Martin Luther King's Voting Rights Act of 1965," Casar said. "United, we will fight back with everything we've Trump is allowed to rip the Voting Rights Act to shreds here in Central Texas, his ploy will spread like wildfire across the country. Everyone who cares about our democracy must mobilize against this illegal map." Doggett called the map a move by Trump to maintain "his one-man rule." "This is designed to eliminate accessibility, accountability, and a strong voice for our shared values," Doggett said. "For years, Republicans have failed in their attempts to use redistricting to get rid of me. If we continue working together, they will fail again. Houston-area changes In Houston, the new map reshapes four currently Democrat-held districts. The biggest change to the districts would be in the seat currently held by Rep. Al Green. The new map would shift the district from covering southern Harris County and instead move it to the eastern part of the county. Could Texas Democrats leave the state to block quorum? What's next As the debate on redistricting continues, Texas Democrats are considering their options to hold off the vote. Democrat lawmakers could break quorum, a strategy used in 2021 when lawmakers flew to Washington, D.C., over changes to election laws. However, in 2023, the state legislature passed a law saying that those who break quorum face a $500 fine each day they're absent. Sources confirm to FOX 4 that some Democratic donors have offered to pay the fines. Wilson says this is teetering on the line of violating campaign finance laws. The move would come with other challenges as well. If Republicans wait to pass final flood relief measures until redistricting has been considered, and Democrats leave the state, breaking quorum could hold up both bills. Letters: Why would Illinois want to be like Texas? Consider these statistics.
The editorial on Texas tax cuts would have us believe everything is bigger in Texas due to its low taxation. Yet, I can name a few basic benefits we should all expect to be afforded in a prosperous society, which are, in fact, very scarce in Texas. Want to live in a state where you're assured of basic quality health care? Don't move to Texas, which, unlike Illinois, refused the Affordable Care Act's Medicaid expansion and, as a result, has the highest uninsured rate in the country, according to the U.S. Census Bureau's American Community Survey. Want to live in a state that provides your children access to a quality education? Again, don't move to Texas, where, according to the Education Data Initiative, Texas invests one third less in their pupils than Illinois. ACT scores were five points higher in Illinois compared with Texas in 2024, according to the ACT. Want to live in a state that acknowledges the effects of climate change and does all it can to protect you from its pernicious effects? Moving to Texas will put you on a collision course with climate change's dangers, as evidenced by the millions of Texans left without power in the freezing winter during the deadly 2021 energy grid crisis due to a lack of regulatory oversight. Additionally, more than 130 lives may have been saved in the recent flash flood disaster in Texas had its leaders chosen to invest in siren networks and flood alert systems. While the Tribune Editorial Board would have you believe Texas' lower taxation leads to a windfall of savings for its residents, when accounting for the higher median incomes of Illinois residents and Illinois' superior social safety net, this claim turns out to be weak. A 2023 Council for Community and Economic Research report showed that while Texas's nominal cost of living was 7% to 10% lower than Illinois, the difference in effective purchasing power for the average family was only 2% to 3% lower. The CNBC article states that 'according to the United Health Foundation, Texas has the nation's lowest number of primary care doctors per capita, the second-lowest number of mental health providers, and it consistently has the highest rate of people without health insurance. The state has among America's strictest abortion bans, and crime is on the high side.' And regarding the abortion bans, was the editorial board aware of the following statistics? According to the Johns Hopkins Bloomberg School of Public Health, 'between 2021 and 2022, infant deaths in Texas rose from 1,985 to 2,240. … This corresponds to a 12.9 percent increase in infant deaths in Texas versus a 1.8 percent increase in infant deaths in the rest of the U.S. during the same period.' Public education, according to the World Population Review? Texas is 40th; Illinois is 17th. So go ahead, editorial board, continue to glorify tax cuts and encourage Illinois to become more like Texas, a state that chooses policies that kill people by default. Me? I will continue to cheer on our governor and other local and state officials who use the taxes they raise to give Illinois citizens a solid quality of Brandon Johnson has ruled out a property tax increase and instead is looking for 'progressive revenue.' The mayor once was a teacher, but he seems incapable of learning lessons from history. The facts are clear: High taxes drive people out of cities and states. Tens of thousands of residents left Illinois each year from 2019 to 2024, and high taxes were a major reason for many. Illinois only avoided losing population due to immigration, largely people from Venezuela. In the old Soviet Union, the system controlled where people could live and work. China has the system of household registration, severely limiting educational and job opportunities and access to services to residents who do not stay in their assigned permanent residency. Thankfully, in the United States, people are free to choose where to live. The mayor was cagey about what specifically 'progressive revenue' means. It is worth considering what taxes Chicagoans already pay. In addition to federal and state taxes, the sales tax in Chicago, a portion of which goes to the state, is 10.25%, among the highest of American cities. Property taxes are already higher than the national average. There are real estate taxes, utility and telecom taxes, amusement taxes, hotel taxes, restaurant taxes, alcohol taxes, a shopping bag tax and cannabis taxes. Businesses are struggling because of high taxes. Tax the wealthy? Fueling the exodus of wealthy taxpayers will further weaken the tax base. Wealthy corporations? Boeing, Caterpillar, Citadel, Tyson Foods and others have already left. A bailout from Springfield or Washington is a pipe dream. Borrow more money? The debt per taxpayer is already among the highest in the country. There is only one responsible option for Chicago: Cut expenses. Unfortunately, the mayor lacks the nerve to do Harvey grapples with mounting debt, it recently made the difficult — but fiscally responsible — decision to lay off 10% of its workforce. And what has Mayor Brandon Johnson and Gov. JB Pritzker done to address the finances of Chicago and the state, respectively? Johnson has not addressed this city's bloated workforce. Instead, he told the city's contractors to reduce their charges and advocated for the Bring Chicago Home initiative, which would have raised the real estate transfer tax on the wealthy and corporations, spurred their departures and ultimately reduced the city's tax base. Likewise, Pritzker has not addressed this state's dismal pension and financial outlook. He has yet to address this state's number of governmental bodies — more than 8,500 — and attendant costs, which are more than even more populous states. Instead, our governor advocated for a graduated income tax scheme, which would have had the same effect as Bring Chicago Home, and now he simply baits President Donald Trump in national forums. Chicago needs to reduce municipal expenditures by examining and eliminating its bloated workforce, and it further needs to consider the need for 50 wards and aldermen and the attendant expenses. And Illinois needs to get its financial house in order by consolidating and/or eliminating some of its more than 8,500 governmental bodies. The elimination of bloated workforces and governmental bodies would be to the benefit of overburdened and overextended taxpayers and thus would be in the public interest.

Advocates for transgender Texans hold rally against private spaces ban bill
AUSTIN (KXAN) — Representatives of several activist groups held a press conference Wednesday to oppose a special session bill, which they say would create an 'unenforceable' ban on transgender women's use of restrooms and shelters. 'Women and survivors of violence have been repeatedly used as justification to exclude trans women from public restrooms. Now, women from all walks of life are coming together to say, 'not in my name,'' reads a Tuesday press release from liberal advocacy group Equality Texas. Previous: Texas' special session on floods, taxes, THC, redistricting could also spend time targeting transgender life The rally included speakers from Texas AFL-CIO, Black Freedom Factory, Austin LGBTQ Chamber, Human Rights Campaign, Democrasexy, the Transgender Education Network of Texas, Texas Freedom Network and Equality Texas. Former candidate for Texas governor Wendy Davis is also scheduled to speak. 'We know that trans women are four times more likely than cisgender women to be the victims of violent crimes,' the release reads. 'There is no way to police bathrooms without subjecting women and girls to invasive investigations demanding 'proof' of gender.' The press conference was livestreamed. What's in the bill House Bill 32, filed by Rep. Valoree Swanson, R-Spring, is titled the 'Texas Women's Privacy Act.' It would require the state's political subdivisions to prevent people from using sex-segregated 'multiple-occupancy private spaces' that don't align with their sex assigned at birth. The law would apply to restrooms in government buildings and public schools, as well as jails and prisons. Gender definition bill passes in Texas Senate, heads to governor 'A political subdivision or state agency shall ensure each multiple-occupancy private space in a building the political subdivision or state agency owns, operates, or controls is designated for and used only by individuals of the same biological sex,' HB 32 reads. 'A political subdivision or state agency shall take every reasonable step to ensure an individual whose biological sex isopposite to the biological sex designated … does not enter the private space.' The bill would allow Texas's Attorney General to investigate and fine any political subdivision for violations. As introduced, HB 32 wouldn't allow for fines or legal actions against individual persons. Lt. Gov. Dan Patrick announced this week that Senate Bill 7, authored by Sen. Mayes Middleton, R-Galveston, will be his chamber's companion to the bill. 'This is about safety,' Middleton said. 'This is about privacy.' It hasn't been filed yet. Both bills fall under Gov. Greg Abbott's special session topic of 'legislation protecting women's privacy in sex-segregated spaces.' 'It's ridiculous, [opponents of this type of legislation] are literally arguing that we need to put the rights of men pretending to be women above those of women themselves,' Middleton said. 'It's not right. It's not common sense.' HB 32 was one of the first bills filed ahead of the session. Prior attempts ended in failure, lacked evidence The text is near-identical to SB 240, which Middleton filed during the regular session of the legislature. It passed in the Texas Senate but died in the Texas House. During floor debate, Democratic senators asked for evidence supporting his bill's necessity. Middleton didn't provide any and instead repeatedly called it 'common sense.' He also pushed back against the idea of commissioning a study related to the topic. State Sen. Mayes Middleton running for Texas Attorney General Back in the 2017 regular session of the state legislature, bill with a similar goal failed. Lois Kolkhorst, R-Brenham. It was also met with requests for her to provide data or evidence of a problem. 'In the crimes that I've looked at, in the most intimate settings, none have identified as a transgender,' Kolkorst said during a 2017 committee hearing on her bill. A more narrowed focus during special legislative sessions Research and data nonpartisan nonprofit Texas 2036 said it's not uncommon for similar legislation to be filed. 'There are a number of reasons why a bill may not pass during a regular session,' Jordan Wat, director of government affairs at Texas 2036 said. 'Maybe time ran out on that bill while it was being considered in one of the chambers. Perhaps there were some procedural issues related to it. Maybe the political winds were just not there.' Watt said similar legislation filed that previously failed, can be more successful in special sessions, depending on the topic. 'Because there's a bit more focus,' Wat said.
