A preliminary probe by the Office of Congressional that preceded the House Ethics inquiry deemed the move 'permissible' because the Bronx and Queens Democrat 'opted to treat a long-term significant other as synonymous with a spouse' which was '[c]onsistent with prior decision.'

But House Ethics said in a unanimous decision that it was 'not based on any law or precedent then in existence,' since the spousal privileges only apply to members who are legally married.
The 26-page report also found that at the same time AOC 'was seeking to take advantage of exceptions to the Gift Rule only applicable to spouses and/or certain relatives, she was not disclosing Mr. Roberts's financial interests as is required of Members who are legally married.'

The far-left rep has co-sponsored a bill this Congress that would also ban stock trades for spouses, though Roberts would have a carveout given their relationship status if the legislation passes.
Additionally, Ocasio-Cortez had 'listed Mr. Roberts as her 'spouse' on paperwork filed with the House relating to privately sponsored travel, although the two were not legally married at the time of the gifted travel,' the report added.

New York Gov. Kathy Hochul (D) vowed Monday to explore 'every option' to redraw the state's congressional maps in response to Texas's midcycle redistricting push. 'There's a phrase, 'You have to fight fire with fire.' That is a true statement of how we're feeling right now,' Hochul told reporters alongside New York State Assembly Speaker Carl Heastie (D) and several Texas Democrats. 'And as I've said, another overused but applicable phrase, 'All's fair in love and war.' That's why I'm exploring with our leaders every option to redraw our state congressional lines as soon as possible,' she continued, noting state legislative leaders were 'on board.' 'We're already working on a legislative process, reviewing our legal strategies, and we'll do everything in our power to stop this brazen assault,' she added. Texas state House Democrats fled their state Sunday to deny Republicans a quorum — the minimum number of lawmakers needed in order to conduct business — blocking the House from passing a map that would offer the GOP five additional pickup opportunities. The current maps in Texas already given Republicans a strong partisan advantage. A Texas House panel had advanced the maps last week, teeing up a vote on the House floor. Texas Democrats traveled to Illinois, New York and Massachusetts, all of which are Democratic-led states. Speaking to reporters Sunday night, Illinois Gov. JB Pritzker (D) said the state would protect Texas Democrats who are facing arrest — in addition to incurring a daily $500 fine — over breaking quorum. New York, where House maps were struck down by a court in 2022 for giving a partisan advantage to Democrats, faces a conundrum over middecade redistricting. For one, the Empire State uses a redistricting commission to draw its maps, though they are subject to the state Legislature's approval. A second issue is that any amendment to the state constitution requires it to be passed in two consecutive sessions before going before voters, meaning New York Democrats wouldn't be able to change their maps in time for the 2026 cycle. Hochul acknowledged those constraints, saying, 'it is not the timeline that I would have preferred.' 'We're going to also look at litigation strategies,' Hochul said. 'We're in close conversations about options there, and so I would say this — we're considering all options right now.' Hochul notably agreed with the idea that the redistricting commission approved by voters in 2014 should be disbanded or changed. Texas Gov. Greg Abbott (R) on Monday ordered the arrest of the Democrats who fled the Lone Star State in an effort to halt the advancement of new congressional maps that could benefit Republicans in next year's midterms. 'Texas House Democrats abandoned their duty to Texans,' Abbott said in a statement. 'By fleeing the state, Texas House Democrats are holding hostage critical legislation to aid flood victims and advance property tax relief. There are consequences for dereliction of duty. 'Speaker Dustin Burrows just issued a call of the Texas House and issued warrants to compel members to return to the chamber. To ensure compliance, I ordered the Texas Department of Public Safety to locate, arrest, and return to the House chamber any member who has abandoned their duty to Texans. This order will remain in effect until all missing Democrat House members are accounted for and brought to the Texas Capitol.' Democrats' refusal to show up was part of a rapidly escalating political contest over a controversial attempt by the state GOP to pass a highly unusual mid-decade partisan redistricting plan aimed at giving Texas Republicans five additional seats in Congress — while destroying several Democratic districts. In a separate statement, Abbott said he was also directing the Texas Rangers to investigate the Democrats over potential bribery in connection to donations they were allegedly receiving from donors to offset the $500 daily fines the lawmakers are facing. 'Today, I ordered the Texas Rangers to immediately investigate fleeing Texas House Democrats for potential bribery and any other potential legal violations connected to their refusal to appear for a quorum, conduct business, and cast votes,' Abbott said. Multiple Democratic governors are supportive of their colleagues' interests in redrawing their state's Congressional maps to benefit Democratic Party candidates ahead of the 2026 midterms, responding to a push from President Trump and others to draw new lines in Texas to be more favorable to GOP candidates. Kansas Gov. Laura Kelly (D) said she is supportive of California Gov. Gavin Newsom (D) and other Democratic governors who have shown openness to altering district maps to benefit Democratic candidates next year. 'I have never believed in unilateral disarmament, and so while I may not want to participate in certain activities, if I have to, in order to level the playing field, I would support my Democratic colleagues who decide to answer in kind,' Kelly said in an interview with ABC News that was published Saturday morning. 'If the other side is going to pursue this, regardless of the obvious unconstitutionality of it, then I don't think we have any other choice but to go there. You just don't go to the front lines without your bullets,' Kelly told the outlet, adding that her 'preference' would be for the courts to step in. Kelly, the chair of the Democratic Governors Association, along with Wisconsin's Gov. Tony Evers (D) and other Democratic governors, was in Madison, Wisc., for a summer policy retreat. Trump wants Republicans to pick up five seats in Texas. Redistricting typically happens every 10 years, but the effort by Texas could help Republicans yield five spots and ultimately help the party hold the majority in the House. On Saturday, the Texas House Select Committee on Congressional Redistricting advanced proposed congressional maps that would give the GOP an opportunity to snatch five House seats next year. Democrats have pushed back, including Texas Democrats who have accused the GOP of 'trying to rig the midterms.' Evers, who said that Wisconsin will not be changing its Congressional lines, argued that Democrats need to do more to push back against Republicans. 'We're not changing our maps. Here in the state of Wisconsin, we worked hard to get fair maps, and we're going to continue to do so … in my heart of hearts, this is where we have to be. But when … you have a gun against your head, you got to do something,' Evers said, according to ABC. Minnesota Gov. Tim Walz (D), who was ex-Vice President Harris's running mate during the 2024 presidential election, said that Democrats are not dealing with a 'normal administration.' 'We're playing with one that is throwing all the rules out. I think it is incumbent upon states that have the capacity or the ability to make sure that we are responding in kind,' Walz said on Friday, according to the Milwaukee Journal Sentinel. 'It is a terrible spot we're in as a county, but not responding is going to make it even worse.'
