'Unique corruption in CBI, ED': Delhi HC sends CBI officials to custody
In an unusual development, the Delhi High Court has remanded three CBI officials to the custody their own probe agency in a corruption case and said it "shakes the edifice of the machinery" whose primary duty was to bring the culprits to book.
Justice Neena Bansal Krishna, in an order on April 25, said, "It is one of the unique cases of rampant corruption in CBI, ED and such other departments, which shakes the entire edifice of our executive and the investigating machinery which have the primary duty of investigations in crime and bring the culprits to face the penalty corruption." The complaint showed it was not a stand alone case of corruption by the government officials but reflected a "large conspiracy" amongst the officials of various departments who took bribes to give undue advantage or impact and interfere in investigations and the functioning of these departments.
"It is, therefore evident that in certain situations as in the present case which is to unearth the larger conspiracy, the custodial interrogation at the initial stage of investigation to unearth the material facts cannot be denied. Considering the gravity and the magnitude of the alleged conspiracy, two days police custody/remand of the three respondents is granted to CBI," the court said.
The order came on a CBI plea against a trial court order refusing custody of the three accused officials to the agency.
The complainant alleged the accused CBI officials demanded Rs 50 lakh as bribe from him to "settle" two cases involving him, which was subsequently reduced to Rs 35 lakh.
He further claimed another official in the Finance Ministry demanded illegal gratification of Rs 50,000 for influencing ED officers in another case.
While one of the CBI officials was caught red-handed accepting Rs 3.5 lakh bribe from the complainant on behalf of the other official, the ministry official allegedly accepted Rs 50,000 through GooglePay.
On April 10, the trial court remanded the accused persons to judicial custody and on April 15 denied the CBI's plea for their custody.
CBI sought a 10-day remand of the accused on the ground that the case related to senior CBI officials trying to manage the investigations of the agency and if the same was not thoroughly investigated, it would have far-reaching consequences.
The court order said investigation was still at infancy and to unearth the larger conspiracy, the interrogation of the three accused was imperative.
To say the interrogation intended to extract a confessional statement was not correct and those accused of grave offences could not be permitted to take the administration of justice for a ride, it added.

HP court orders attachment of govt property in over 27-yr-old land compensation case
Shimla, June 12 (UNI) Highlighting prolonged government inaction, the district judge (forest) Ajay Mehta has directed the attachment of key government properties, including the PWD rest house at Tara Devi, two official vehicles from the PWD headquarters, furniture, computers, and heaters, over non-payment of land compensation to farmers for the past 27 years. The case pertains to land acquired in 1998 by the Public Works Department (PWD) Rohru division for the construction of the Baidhar-Thana-Tikkar road. Approximately 15 bighas were acquired, including apple orchards, and the land acquisition officer had initially assessed compensation at Rs. 6,252 per apple plant. Unsatisfied with the award, landowners from Tikka -- Diwan Chand, Bhajan Das, Inder Singh, Narain Chand, Bahadur Singh, Nihal Chand, Jagdish, Mohan Chand, Jai Krishan, and Rameshwar -- moved court in 2012. In 2017, the additional district and sessions judge ordered an enhanced compensation of Rs 26,575 per plant. However, the state failed to implement the order or deposit Rs 2.5 crore compensation, prompting the petitioners to file an execution petition in 2020. The court noted that despite three prior orders to attach government property, no action was taken to disburse the compensation. It further observed that both the secretary (PWD secretariat) and the Land Acquisition Officer (Winter Field, Shimla) failed to cooperate with court proceedings. While the state government has now sought an additional four months to deposit the dues, the next hearing has been scheduled for June 18. The court has made it clear that the attachment orders will remain in force until then. Mithi river desilting: Actor Dino Morea appears before ED
Mumbai, Bollywood actor Dino Morea on Thursday appeared before the Enforcement Directorate here in connection with a money laundering probe linked to an alleged ₹65 crore Mithi river desilting scam, officials said. Morea, who had been summoned by the ED for questioning, reached the federal agency's office at Ballard Estate in south Mumbai at around 10.30 am, an official said. The ED on June 6 conducted searches at more than 15 locations in Mumbai, and Kochi in Kerala, including the premises of Dino Morea in Bandra area here, those linked to his brother Santino, some Brihanmumbai Municipal Corporation officials, and contractors among others, official sources earlier said. The searches were conducted in Kochi as one of the companies that provided desilting equipment to the BMC Matprop Technical Services Pvt Ltd is based in this city, they said. The investigation is being conducted under the Prevention of Money Laundering Act , the sources had said. The ED case stems from a Mumbai Police Economic Offences Wing FIR filed in May against 13 persons, including contractors and civic officials, for an alleged ₹65.54 crore scam in tenders awarded from 2017-2023 for desilting of the Mithi river which flows through Mumbai and acts as a stormwater drainage channel for the metro city. The Uddhav Thackeray-led undivided Shiv Sena controlled the cash-rich BMC from 1997 till the party's split in 2022. After the expiry of the general body in 2022, the civic body was controlled by the state government, which was then headed by Eknath Shinde. It was alleged by the police in its complaint that BMC officials tailored the tender for the desilting contract in such a way that it benefited a particular supplier of machinery, and the contractors reportedly generated fraudulent bills for transporting the sludge out of Mumbai. The 49-year-old actor and his brother were questioned by the Mumbai Police EOW in this case last month also. The Morea brothers, it is understood, were questioned by the police about their alleged links with alleged middleman Ketan Kadam, arrested in the case along with another accused, Jai Joshi, apart from some financial transactions made in a company linked to Santino. Kadam and Joshi, according to police, were involved in the renting out of 'silt pusher' machines and multi-purpose amphibious pontoon machines to contractors who were carrying out Mithi river desilting work. In 2021, the ED had attached Morea's assets as part of a money laundering investigation linked to an alleged bank fraud case against Gujarat-based pharmaceutical company Sterling Biotech and its promoters. The plan to desilt the river was planned by the Mumbai civic authorities following the 2005 floods, which brought the city to a grinding halt.
