
Calls for EU to intervene in row over charges for hand baggage on budget airlines
Campaigners are calling for EU lawmakers to intervene in the row over whether budget airlines should be allowed to charge customers who want to take hand baggage on to a flight.
Last week European consumer groups called for Brussels to investigate the pricing policies of seven airlines, including Ryanair, easyJet and Wizz Air.
Airlines were 'exploiting consumers', said Agustín Reyna, director general of BEUC, an umbrella group for 44 consumer organisations, and were 'ignoring the EU top court who ruled that charging [for] reasonably sized hand baggage is illegal'.
'Haven't we all experienced the fear of our hand baggage not fitting in the airline's sizers and being charged extra fees?' he said.
Whereas once travellers worried about the weight of suitcases going in the hold, now it is shrinking hand baggage allowances that cause anxiety in airport queues.
In recent years it has become common practice for travellers to face a fee if they want to carry on all but the smallest of bags, with charges varying between airlines.
Passengers with Ryanair, for example, can carry a small bag that fits under the seat for nothing. However, if a gate check reveals it is oversized the fee is £60. A larger cabin bag can be added to a flight booking for £6 to £36 depending on the route but, again, if it is deemed too large it costs £75 to stow.
Spain has become a battleground for the issue. Last year its Consumer Rights Ministry fined five budget airlines, including Ryanair, a total of €179m for charging passengers for hand luggage and seat reservations. This month a Spanish judge ordered Ryanair to refund a passenger €147 (£124) in hand luggage charges racked up across five flights, including a return trip from Spain to the UK.
In the ruling, Judge Raquel Martínez Marco said 'carry-on luggage is an essential element of passenger transportation' and therefore 'cannot be subject to a price supplement'. The case was backed by Spanish consumer rights organisation Facua, which has been decrying the 'illegal surcharge' since 2018.
Kenton Jarvis, easyJet's chief executive, suggested passengers were happy to pay for the service they wanted. He said a third of its customers 'take no ancillaries, and therefore are happy taking the free [smaller] cabin bag'. Expecting them to pay for people who want bring a larger cabin bag 'doesn't feel very consumer friendly', he said.
Jarvis added that free cabin bags were previously a 'big logistical headache' for easyJet because they could not all fit in the overhead lockers. This led to delays and passengers being inconvenienced by having their bag put in the hold. 'That's why it is good to just ask the traveller to pay for what they want,' he said.
Ryanair's chief executive, Michael O'Leary, said it would not be changing its policies: 'The Spanish have a mad minister who's decided that as General Franco passed some law 30 years before Spain joined the European Union, passengers are free to bring as much baggage as they want,' he said.
'It's a clear breach of European regulations,' he said. 'The European Commission have already told Spain it's illegal.'
Any attempt to intervene would be in breach of the regulation that guarantees airlines the freedom to set prices and policies free from political interference, O'Leary added.
'In the short term, you have a couple of the consumer agencies in Spain taking decisions at local court level and trumpeting these,' he said. 'It's not going to change. We're not changing our policy. It will get referred to the European courts; we'll be appealing those rulings. In reality, there isn't that demand from passengers.'
Reyna said that given the current review into EU legislation governing air passenger rights there was an opportunity to clarify what services should be included in a basic ticket price.
'Our data shows that consumers expect to see a small item and a piece of hand luggage when buying basic tickets,' he said.
'Policymakers should also define hand luggage's 'reasonable size and weight' to avoid surprises at the airport and ultimately reduce the number of disputes costing consumers and airlines time and money.'
Kevin Bodley, a consultant at law firm Steele Raymond, who specialises in aviation law, said the Spanish ruling 'had delivered a clear message against hidden airline fees'. While neither the Spanish judgment nor future EU laws are binding in the UK they could still 'influence legal reasoning and consumer rights discussions in the UK', he said.
'The end result suggests the emergence of an increasing level of protection to passengers at the expense of the airlines,' Bodley said. 'However, this may well be cancelled out by the need for airlines to increase overall fare levels to cover this at the ultimate expense of travellers.'

Holidaymakers to Portugal can now use airport e-gates, says Labour
Faro airport in Portugal has begun to let British passengers use e-gates, the UK Government has announced. Downing Street expects British holidaymakers will be able to use the technology in their 'millions' after Prime Minister Sir Keir Starmer struck an agreement with EU leaders last month. Nick Thomas-Symonds, the Cabinet Office minister, whose brief includes EU relations, said at the despatch box on Thursday that the deal 'makes life easier for holidaymakers'. The Prime Minister's official spokesman said: 'Yesterday, Portugal opened e-gates at Faro airport to British citizens, which will mean millions more Brits going to the Algarve will be able to use e-gates in time for the summer holidays.' He added: 'We're obviously continuing to work with other countries and other airports to ensure Brits can use more e-gates as soon as possible, and that work continues. 'It's obviously good news to see a very significant airport, I think, for British holidaymakers, opening e-gates to British citizens yesterday.' When he unveiled the deal last month, Sir Keir said that 'for holidaymakers wanting to get out this summer, they will want to know that they can do so easily and without delay and chaos'. The Prime Minister called on 'all EU member states to help make this a reality without delay'. Since Brexit, UK nationals have been unable to use e-gates in most Schengen Area countries. Passengers from the UK face warnings that passport controls on arrival to Portugal ' may take up more time, as the passport will have to be stamped and there are additional questions that may be asked by the border control officers', according to the Faro airport website. The Government has said the deal will smooth over 'legal barriers to e-gates use for UK nationals', once a new stamp-free biometric Entry/Exit System launches, due in October this year. Taking a question about steps 'to improve relations with the EU', Mr Thomas-Symonds told the Commons: ' The historic deal that we signed with the EU on May 19 is in our national interests – good for bills, borders and jobs. 'It slashes red tape and bureaucracy, boosts British exporters and makes life easier for holidaymakers. 'Indeed, I'm delighted to confirm this morning that Faro airport in Portugal will start the rollout of e-gate access to UK arrivals this week.'

JP Magnier handed €50,000 in 'brown' envelopes to estate agent in land sale, court hears
The High Court has heard that billionaire bloodstock magnate John Magnier's son, JP, handed over two "brown" envelopes containing a total of €50,000 in cash to an estate agent involved in a failed €15 million property deal which were delivered to the beneficiaries of the estate as a show of "appreciation". The court also heard that a solicitor involved in the proposed conveyance of Barne Estate, Co Tipperary, the subject of a legal action by John Magnier - who alleges a €15 million deal was reneged upon by the vendors - has told the High Court that an agreement was in place between the parties before an exclusivity document was signed. Advertisement Joseph Fitzpatrick, of Smithwick Solicitors, was giving evidence in the hearing on Thursday and told counsel for the Barne Estate that he secured an exclusivity agreement signed by both sides to run from August 31st to September 22nd after hands were allegedly shaken on the deal. Lawyers acting for Mr Magnier, founder of the world-famous Coolmore Stud, have claimed before the High Court that a US-based construction magnate, Maurice Regan, the preferred buyer, engaged in a "full-frontal assault" on Mr Magnier's claimed deal to buy the 751-acre tract. Mr Magnier's proceedings claim that Barne Estate reneged on the alleged deal, preferring to sell the land at the higher price of €22.25 million to Mr Regan, the founder of the New York building firm JT Magen. Mr Magnier – along with his adult children - wants to enforce the alleged deal. Advertisement The Magnier side says the deal was struck at an August 22, 2023, kitchen meeting at Mr Magnier's Coolmore home. They also claim an exclusivity agreement that was in effect from August 31 to September 30 stipulated that the estate would not permit its representatives to solicit or encourage any expression of interest, inquiry or offer on the property from anyone other than Mr Magnier. Barne Estate has been held for the benefit of Richard Thomson-Moore and others by a Jersey trust. The Magnier side has sued the Barne Estate, Mr Thomson-Moore and three companies of IQEQ (Jersey) Ltd group, seeking to enforce the purported deal, which they say had been "unequivocally" agreed. The Barne defendants say there was never any such agreement, as they needed the consent of the trustees to finalise any agreement, and subsequently they preferred to sell the estate to Mr Regan. Mr Magnier's son, JP, told Paul Gallagher SC, for the Magnier side, that his father asked him to get €50,000 in cash on September 8, 2023, and to put it into two envelopes to be given to the Thomson-Moores. He said the money was an "appreciation" for letting the Magnier side onto the Barne land, for their loyalty in honouring the deal and because they were allegedly "cash strapped". JP Magnier said he put the money into two envelopes and gave it to the estate agent at Barne Estate for them to be passed on to the Thomson-Moores. Advertisement On September 11, 2023, however, he said the estate agent met with JP Magnier and "pushed" the envelopes in his direction, saying that the Thomson-Moores were concerned that their farm manager may have seen the original transaction. Niall F Buckley SC, for the Barne side, asked what colour the envelopes were and was told by JP Magnier that they were brown. Mr Buckley put it to JP Magnier that the envelopes were to keep the Thomson-Moores "sweet", as John Magnier was concerned they were going to pull out of the deal. JP Magnier said his father never said that to him. "I take it you didn't ask for a receipt?" asked Mr Buckley. JP Magnier replied: "No." Advertisement "Doesn't that say it all," remarked Mr Buckley. "Knowing what you did about my clients' family circumstances and the need for them to provide for their child and given the vast amount of land you have, did it ever occur to you to let this one go?" "It wouldn't be my call," said JP Magnier. Mr Fitzpatrick told Martin Hayden SC, for the Barne Estate, that the exclusivity agreement was not to further any negotiation but to keep the "status quo" of the alleged sale agreement in order to further the preparation and receipt of the contracts. However, a week before the exclusivity agreement expired, the Thomson-Moores said they were taking tax advice, he said. "We invited them to a meeting and that was refused, then the extension of the exclusivity was refused. It was clear they had no intention of signing with us and were running down the clock," said Mr Fitzpatrick. The case continues in two weeks' time before Mr Justice Max Barrett.
