{Haryana} Extend OPS to KU staff hired on posts advertised before NPS rollout: HC

The Punjab and Haryana high court has directed Haryana government and Kurukshetra University (KU) to extend Old Pension Scheme (OPS) benefits to faculty members, who were recruited against the posts advertisement prior to implementation of new pension scheme (NPS). The high court bench of justice Tribhuvan Dahiya also imposed a cost of ₹ 5 lakh on the government and the varsity for acting 'arbitrarily' and 'unreasonably' in the case of faculty members of KU.
The petitioners, recruited as lecturers, were demanding restoration of OPS and quashing of July 2023 communication of the state government, whereby varsities were directed not to act on a May 2023 communication regarding inclusion of those employees under OPS, who were recruited against posts advertised prior to NPS notification. These employees were recruited between May and November 2006 pursuant to advertisements in 2005 and 2006, when KU Employees Pension Scheme 1997 (OPS) was in effect.
Haryana introduced NPS with January 1, 2006 followed by the universities as well. In March 2023 Central government allowed OPS to the employees who were recruited against posts notified prior to implementation of NPS. Haryana also adopted the same in a May 2023 notification. However, in July 2023, a communication told varsities not to act on May 2023 notification—which effectively meant that such employees in universities would not get the benefit of OPS. It was in this background that these teachers had approached the high court.
The court said that once the state government allowed the category of employees appointed against the posts advertised prior to the date of notification of NPS to go back to the old scheme by exercising an option, the same benefit was required to be extended to varsity employees also. The court termed the government decision 'unreasonable' and 'arbitrary exercise of power' while adding ' such an about-turn without any rationale smacks of high handedness on the government's part, which is deplorable and cannot be acceded to. In this constitutional scheme of things no executive authority can anoint to itself absolute power to act to or not to act at will, without mentioning any justifiable reason,' the court observed.
The court also underlined that the university had an obligation to work for its employees welfare and it should have taken a step in that direction but appears to have 'abdicated the authority' and chosen to be a 'mute spectator'.
The court 'censured' the governments conduct while observing 'if it suits the government these employees are brought under new pension scheme meant for its employees, if it does not, they are treated as aliens and even the benefits available to the government employees under the same scheme are denied on the specious plea of not receiving proposal from the university in this regard,' the court added while referring to the argument from the government that no proposal came from the university to grant these employees OPS.
Now, the court has given two-weeks' time to complete the requisite formalities and has also given an extended deadline of eight weeks to implement the scheme. As of the fine imposed, ₹ 4 lakh are to be paid by the government and ₹ 1 lakh by the KU as litigation cost for five petitions filed by the employees.

GUWAHATI The Assam Public Service Commission (APSC) has decided to 'drop/delete/cancel' a Manipur-related controversial question in an examination conducted on August 8 to recruit agricultural development officers. In a letter to APSC Chairperson Debaraj Upadhaya on August 17, the Meitei Heritage Society (MHS) stated that question no 95 in the exam paper was malicious, disturbing, and misleading. The question was on the conflict between the Meitei and Kuki-Zo communities and the role of Arambai Tenggol and Meitei Leepun, two radical groups. 'Such a one-sided portrayal is unbecoming of a Public Service Commission, whose mandate is to recruit public servants committed to fairness, impartiality, and service to the nation without prejudice,' the MHS said. The MHS expressed serious concern for 'selectively targeting one community while ignoring publicly available data on the role of Chin-Kuki militants and their civil society organisations'. It cited reports by the National Investigation Agency, Central Bureau of Investigation, and a Supreme Court-appointed committee to make a point. 'Such misrepresentation not only tarnishes the image of a community but also undermines the credibility of the Commission,' the Meitei group said, requesting the APSC to issue a clarification acknowledging the biased nature of the question and declare the objectionable question null and void, ensuring it is not used for evaluation purposes. 'After considering our representation, the APSC informed us today (Tuesday) that it has decided to drop/delete/cancel question number 95,' an MHS spokesperson said.

To realise this, the government needs to expand support for production linked incentive schemes into high-technology and green manufacturing, where India has the potential to gain a strategic edge, the panel said in a report titled 'Roadmap for Indian Economic Growth In Light Of Global Economic and Geopolitical Circumstances', which was submitted with the Lok Sabha Tuesday. The US has levied a 50% tariff on most Indian goods, which, some analysts said, can potentially shave 0.3-0.8 percentage point off Indian growth if it persists. India, the panel said, needs to pursue new bilateral and regional trade pact to reduce reliance on a few markets and mitigate tariff panel advised regulators to be wary of the influence of foreign investors and their potential impact on market volatility, while lauding the government's efforts to attract foreign capital. It recommended that domestic economic resilience be prioritised and regulators need to continue streamlining regulations. CPSE listing, privatisation In a submission, the finance ministry told the panel that the Department of Public Enterprises (DPE) has been asked to identify central public sector enterprises (CPSEs) for closure or privatisation in the non-strategic sector, in consultation with relevant ministries. The DPE will then get in-principle nod from the Cabinet Committee on Economic Affairs to move with any such plan. The panel called on the government to expedite the ministry also said the economy must ideally grow around 8% at least for a decade, for which the investment rate must rise to 35% of GDP from the current 31%.
