Mother stabbed four-year-old son to death hours after school pick-up, court told
There were also signs of attempted strangulation, the court heard.
Keziah Macharia, 43, has been charged with murdering Kobi on or about December 20 2023 but she has been deemed unfit to stand trial.
Mrs Justice Thornton said there should be a 'fact-finding hearing' to decide if Macharia killed Kobi but not if she murdered him.
She told jurors not to 'consider her state of mind and whether she is at fault', which would be needed for a murder verdict.
Ben Dooly and Macharia started a relationship after meeting in 2018 and their son Kobi was born on September 21 2019, prosecutor Mukul Chawla KC said.
The couple lived together with Kobi in Macharia's first-floor flat in Montague Road, Hackney, but the relationship deteriorated after his birth, he added.
Mr Dooly moved out and started sleeping on the sofa two or three days a week but this ended after he met his current girlfriend, Sasha Sasheva, the court heard.
Macharia was 'very unhappy' with Kobi spending any time with Ms Sasheva, Mr Chawla said, adding that Ms Sasheva blocked Macharia on her phone and on social media because of messages she received.
Mr Dooly last saw Kobi alive at his school nativity play the day before the alleged attack, jurors heard.
CCTV played to the court shows Macharia collecting her son from Nightingale Primary School, Hackney, by car at around 4.30pm on December 20.
Kobi could be seen leaving the building wearing a coat and carrying a red balloon, accompanied by Macharia.
'You see nothing of distress or anything out of the ordinary in terms of her demeanour', the prosecutor said.
He added: 'It appears that at some point that evening the defendant started drinking alcohol; when she started drinking and how much she drank cannot be established'.
The court heard that at 10.42pm Macharia sent a WhatsApp message to Mr Dooly that said: 'Hi Ben, good Luck with the biteme_cups five days before Xmas!
'I hope you and Sasha enjoy your lives together. I can't live knowing that she'll have the same surname as my son Kobi, and I will not be in your life anymore. Have a Merry Christmas and a Happy New Year. Goodbye x'
Bite Me cups was Mr Dooly's recently established business, the prosecutor added.
Macharia then messaged Ms Sasheva's phone and said 'this is all your fault' and 'you will never have the same surname as my son', the court heard.
At 10.48pm, Macharia sent Mr Dooly WhatsApp messages less than a minute apart that said 'Kobi is dead' and 'you can thank Sasha for that', the prosecution said.
The pair contacted the police with Mr Dooly reporting he had just been told by the mother of his child that his son is dead, jurors were told.
The court also heard that Macharia at 10.49pm texted 'Kobi is dead' to a WhatsApp group chat recently created by a woman called Reena Life.
Police attended the property at 10.59pm and body-worn footage showed officers repeatedly banging on the door, ringing the bell, and shouting without receiving a response.
Macharia and Ms Life were on a WhatsApp call as police hit the door outside, jurors were told.
During the call, Ms Life heard the buzzer go and the two women talked about police arriving, Mr Chawla said.
Ms Life made notes of the conversation that said the defendant admitted killing Kobi, according to the prosecutor.
At 11pm, after the call ended, Macharia texted Ms Sasheva saying 'you bitch' and at 11.01pm messaged Mr Dooly to say 'I hate iger both (sic)', jurors heard.
Officers broke through the door and the prosecutor said: 'While the police were entering and coming up the stairs we can see the message that Ms Macharia sent by text to Ms Sasheva.
'As they're coming up the stairs there is another message, this time to Mr Dooly, you can tell it's typed in haste – 'I hate iger both', she clearly meant 'you both'.'
Jurors were shown footage of Macharia in blood-stained clothes sitting on the living room floor in front of the sofa.
As officers entered, she moved to a kneeling position and during her arrest, a knife could be seen behind her.
Police were heard asking 'who did this?' and Mr Chawla said 'she raises her hand to her chest, acknowledging it was her'.
Officers documented her saying she tried to take an overdose and harm herself, the prosecutor added.
Kobi was found in the bedroom, in his cot next to a double bed.
He was pronounced dead at 12.06am on December 21.
Macharia was taken to Stoke Newington Police station and had 'a very blunted muted affect' and intermittently sobbed, Mr Chawla said.
'She told officers repeatedly she just wanted her baby back, and she just wanted to see his sweet face', he added.
The only injuries that Macharia sustained were bruises consistent with her being arrested and placed in handcuffs, the prosecutor said.
The case continues.

‘Jealous' woman who murdered ex on Christmas Day jailed for minimum of 25 years
Kirsty Carless, 33, plunged a knife into 31-year-old father-of-six Louis Price's heart in the early hours of December 25 2024, in an attack 'motivated by anger and jealousy, and fuelled by cocaine and alcohol' after a friend sent her a picture of his dating profile, a trial at Stafford Crown Court heard. Sentencing her on Thursday in front of a packed public gallery, Judge Mr Justice Choudhury said Carless, of Haling Way in Cannock, Staffordshire, had 'destroyed the life of a young man and his family' when she fatally attacked him at his parents' home in Elm Road, Norton Canes. On Wednesday, after around a day of deliberation, a jury of seven men and five women found her guilty of murder and possession of an offensive weapon by unanimous verdicts in relation to the fatal stabbing. She was also found guilty of assault occasioning actual bodily harm by a majority of 11 to one in connection with an incident in November 2024 for which she was on police bail, but was cleared of intentional strangulation in relation to the same incident. Carless showed no reaction in the dock as Mr Justice Choudhury passed his sentence on Thursday said the defendant had shown 'no remorse' for what she had done and instead concocted a false story that she could not remember what had happened. The trial was told Carless had been at the pub drinking with a male friend on December 24 before they had sex three times at his home. She had been planning to stay the night when a female friend sent her a screenshot of Mr Price's Tinder profile at around 1.30am on Christmas Day, which sent her into what Mr Justice Choudhury called 'a jealous rage'. Carless then left the male friend's home, took a taxi back to her house, where she picked up a kitchen knife and got another taxi to Mr Price's parents' address, where she expected to find him with a woman but he was instead in a caravan in the back garden with friends. CCTV showed her running up the front path into the house and then 'stalking' him around the garden before he was later found with a single stab wound to the chest on the conservatory floor. Carless had called Mr Price 45 times between 2.15am and 2.44am while she waited for the taxi to take her to the address where he had been staying since their relationship ended – only breaking up what prosecution counsel Jonas Hankin KC called the 'barrage' of calls to impatiently phone the company to check where her taxi was. After arriving at the address, Carless asked the taxi driver to wait outside while she went into the property to stab Mr Price at around 3am. Less than two minutes after arriving at the scene, Carless was 'anxious and sweating' as she got back into the taxi and demanded the driver take her to her parents' home, where she admitted what she had done and her stepfather called 999. Mr Justice Choudhury said: 'Less than two minutes is all it took for you to take a life and ruin many others, including your own.' He added that Mr Price had only been inside the house for around six seconds, which meant Carless must have stabbed him 'on sight'. The judge said: 'The intention to kill was plain. You stabbed him in the chest, a highly vulnerable part of the body. 'Having stabbed him, you didn't stop there, you callously chased him around the garden brandishing a knife. You then fled, leaving him to die. 'You have showed no remorse for what you did, instead claiming falsely that you didn't remember.' The judge paid tribute to the 'dignity' of Mr Price's family, who all wore 'Justice for Louis' T-shirts as they watched the sentencing. In a victim impact statement, Mr Price's mother Eleanor said her son had been 'murdered by the woman he loved' and described him as a 'funny, beautiful man'. She said: 'Our hearts have been ripped apart. I brought Louis into this world and I should have left before him. 'Every minute of every day, I think about my boy. He was no angel, but thanks to Kirsty, he's now my angel. 'It is thanks to Kirsty that his children no longer have a dad. How can we ever get over something like this? We never will.' Mr Price's father Graham described him as 'my son, my fishing buddy, my best friend' and said his life had been taken by an 'act of evil'. He said: 'Louis lost his life, she took it from him. We will never forget Louis or forgive what has happened to him.' As Carless had been on police bail for assaulting Mr Price at the time of the fatal stabbing, Staffordshire Police made a referral to the Independent Office for Police Conduct, who decided not to investigate and the case was passed back to the force's professional standards department. In a statement, Staffordshire Police said: 'A number of positive actions were taken to mitigate the risks identified, which included arresting Kirsty Carless, imposing bail conditions to prevent her from having further contact with Louis Price, them living at separate addresses, and the submission of a public protection notice for consideration at a multi-agency risk assessment conference. 'No misconduct or learning was identified and officers updated Louis's father and explained the decision.'

Gang jailed for dealing cocaine to thousands of users in the City of London
The group, behind a line called Top Gear or City Gear, were sentenced at Inner London Crown Court on Thursday for selling the Class A drug between March 1 2022 and October 14 2023. Officers from City of London Police went through phone records to build a case against the gang, who ran one of the largest cocaine dealing operations in the Square Mile. Ledgers showed they racked up sales of 410 wraps of cocaine per week, worth more than £14,000. The drugs dealing line was originally set up during the Covid lockdowns and used the Top Gear logo on WhatsApp, City of London Police said. It was taken down after one member was arrested and police could begin analysing phone records. Detective Constable Matt Cooper said: 'This was a serious and sophisticated drug supply operation which would have resulted in large quantities of cocaine being sold over an extended period of time. 'This was one of the longest running and biggest cocaine lines in the City of London. 'We will continue to work tirelessly to disrupt and tackle serious and organised crime groups and these sentences demonstrate our commitment to putting criminals involved in drug lines and drug supply behind bars.' At Inner London Crown Court on Thursday, head of the gang Nathan Samuels, 57, of Cornwall Road, Waterloo, in central London, was jailed for nine years for the supply of cocaine. Three of the gang's couriers were also jailed for the supply of cocaine. Black cab driver Michael Redgrave, 56, also of Cornwall Road, was sentenced to two years and nine months; Aaron Bretao 43, of Skinner Street, Clerkenwell, central London, to three years; and Martin Gupta, 38, of Fairgreen Court, Barnet, north London, to four years and three months. Matthew Samuels, 33, of Rotherhithe New Road, Bermondsey, south-east London, admitted possession with intent to supply cannabis and being concerned in the supply of cannabis, and was found guilty of being involved in the supply of cocaine. He was sentenced to three-and-a-half-years in prison. Josh Atherton, 24, of Hemingford Road, Islington, north London, was given sentences suspended for two years, of two years for the supply of cocaine and four months for possession of a weapon for the discharge of a noxious liquid.
