
J&K Opposition slams Omar govt for not addressing concerns on reservation — ‘deliberate denial of justice'
Government sources told The Indian Express Wednesday that the report had been forwarded to the Law Department for review.
Introduced in April last year by the Lieutenant Governor-led UT administration, the UT's reservation policy amends Rule 4 of the J&K Reservation Act of 2005 to increase reservation for reserved category in the state to 67 per cent from 43 per cent, with 3 per cent horizontal reservation to ex-servicemen. This has meant that only 33 per cent was left for the general category of candidates – a change that has been vehemently opposed by various political parties as well as students.
Student groups from the 'Open Merit' or general category have been demanding a rationalisation of this reservation for over a year. The protests prompted Chief Minister Omar Abdullah's government to announce a subcommittee to look into the issue.
PDP leader Waheed Para said Thursday that the J&K government had promised to resolve the reservation issue through a subcommittee report.
'That deadline has passed, leaving thousands of students heartbroken and disillusioned, their trust in the system shattered and their futures put on hold,' Para said.
Terming the delay in addressing concerns of the protesting students 'a deliberate denial of justice,' Para said: 'These students have already endured violence, lockdowns, and lost opportunities. Now, as they seek fair representation and rationalised reservation, the government is pushing them further to the margins'.
The Pulwama MLA said that the ruling National Conference government has the power to 'strike down' the BJP-imposed policy with a single administrative order, 'but the party that promised to reverse BJP's damage is now complicit in continuing it.'
Meanwhile, People's Conference chairman Sajad Lone Thursday accused the government of being 'clueless' on reservation and stated that they have 'no intentions of doing anything.'
'Coming to this draft proposal. To the best of my knowledge, anything sent to the cabinet should be vetted by the law department. It is not the other way round. You can't send something to the cabinet which is outside the domain of law. It looks like another round of time-wasting tactics,' Lone said.
The protests were among the first challenges faced by the elected government in J&K. Chief Minister Omar Abdullah had met with students protesting outside his residence in December 2024.
In April, the government-appointed cabinet subcommittee began deliberations with student groups and in the first week of June, the minister concerned Sakeena Itoo announced that the subcommittee had compiled its report and it would be presented before the UT cabinet. However, after the cabinet met Thursday, the findings of the report were not made public and sent to the law department for review.
The reservation policy has also been challenged in the High Court of J&K and Ladakh.

The building permission was fraudulently issued in the name of Ghulam Qadir Sofi, who had died in 2008, but was actually misused by his son Mohammad Arif Sofi to raise a commercial building in violation of approved drawings. He also used manipulated revenue records to encroach adjoining state land, with the active support of the accused public servants,' he said, adding that the investigation conducted by police station ACB Srinagar, on the basis of oral and documentary evidence, has fully substantiated the charges levelled against the accused officers/officials and private beneficiaries. 'The conspiracy between the accused government functionaries and the beneficiary was proved beyond doubt.' After obtaining the requisite sanction for prosecution of public servants from the government the chargesheet against 14 accused persons, including 12 public servants and two private beneficiaries was produced before the of court of additional judge anti-corruption Srinagar for judicial determination. The next date of hearing of the case has been fixed on October 7.

"Draconian Act": Congress Slams Centre Over Constitution Amendment Bill
New Delhi: Congress leader Adhir Ranjan Chowdhury on Wednesday criticised the 130th Constitution Amendment Bill that sought to allow the removal of the Prime Minister, Chief Ministers, and ministers if they were held on serious criminal charges. The Congress leader accused the ruling BJP of using its majority in Parliament to push through the bill with the intention of targeting the opposition. He called the move "draconian" and politically motivated. The 130th Constitution Amendment Bill seeks to remove the Prime Minister or Chief Ministers who are facing allegations of corruption or serious offences and have been detained for 30 consecutive days. Speaking to ANI, the Congress leader called the bill a political weapon and said, "The intention of the ruling side to pass this bill using its majority is not right. This will be used as a tool to target the opposition. This is a draconian act." He further questioned the timing of the bill, linking it to ongoing debates over the allegation on the Election Commission of 'vote theft'. "At a time when questions are rising against the Election Commission, there is panic in the ruling party, and this issue has now been raised to divert attention from it?" Adhir Ranjan told ANI. Earlier in the day, slamming the BJP government over the introduction of the 130th Constitution Amendment Bill in Lok Sabha, Tamil Nadu Chief Minister MK Stalin said that legislation, if passed, will allow the ruling party at the Centre to register false cases against Chief Ministers of the opposition parties and it will shake the democratic foundations of the country. Amendment new strategy by neo fascist politics: CM
T'puram: Chief minister Pinarayi Vijayan said that Sangh Parivar was employing a new strategy to target non-BJP state govts and the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025– introduced in Lok Sabha on Wednesday – can only be seen as part of the central govt's political decision. "This is a continuation of the vendetta politics using central investigative agencies. There was a longstanding attempt to destabilize state govts by weaponizing central agencies. As part of that, chief ministers and ministers who hold constitutional responsibilities in the country were imprisoned for extended periods. The frustration over their refusal to resign is what prompted the hasty introduction of this amendment," he said. The attempt is to trap individuals in fake cases, imprison them and disqualify them—this is the new experiment of neo-fascist politics, said Vijayan. "BJP members must explain under what constitutional morality those arrested in corruption cases become sanctified upon joining their party. The move to destabilize state govts is a continuation of efforts to undermine the constitutional rights of states and establish that governors have veto power over legislatures," he said. Vijayan said strong protest should arise from all democratic believers against the anti-democratic moves of Sangh Parivar targeting political opponents. There must be a united move against this amendment, which paves the way for political misuse, he added. Meanwhile, opposition leader VD Satheesan said the proposed amendment in the Constitution Bill, goes against the basic principles of Indian laws and the opposition will strongly protest against this move. Under existing laws, a person is guilty of an offence only when a court of law convicts him or her. "Piloting this bill itself is against natural justice. It is against the principles of law, basic principles of law, because when a person is convicted by a court after a long procedure of trial, then only he/she will be a convicted person; till then, there is a feeling that he/she is an innocent person," said Satheesan. The opposition leader said with this, any central govt can use central agencies to register cases against any ministers of the state govts that are ruled by opposition parties. This can be misused for political gains. This is against the basic principles of law and against natural justice, he said.
