Jury awards $2.25 million to parents of decapitated baby whose autopsy was shared on social media

NBC News12 hours ago

A jury in Fulton County, Georgia, awarded $2.25 million in damages to the parents of a baby who was decapitated during delivery and whose autopsy was posted on social media without his parents' consent.
The parents, Treveon Taylor and Jessica Ross, will receive $2 million in compensatory damages and an additional $250,000 in punitive damages against the pathologist who posted the video, Dr. Jackson Gates, and Medical Diagnostic Choices in Atlanta. The parents sued Gates in September 2023 for alleged invasion of privacy, fraud and intentional infliction of emotional distress.
"While we are pleased that a jury punished Dr. Jackson Gates for his reprehensible behavior, nothing can ease the pain that the parents, Jessica Ross and Treveon Isaiah Taylor, Sr., have experienced in losing their baby boy in such a horrific way," attorneys for the family said in a statement Wednesday.
Gates did not immediately immediately respond to an NBC News request for comment.
The baby was deceased at the time of his delivery on July 10, 2023, the lawsuit stated. On July 12, Ross contracted Gates to conduct an autopsy for $2,500.
Ross and Taylor did not permit Gates to share images of the autopsy, through the contract or verbally, according to the lawsuit.
Gates uploaded multiple videos to his Instagram account that month showing "in graphic and grisly detail a postmortem examination of the decapitated, severed head of Baby Isaiah," as well as the baby's body, the suit stated. At the time, Gates' social media account showed a history of posting photos and videos of other autopsies. That account has been taken down but he has at least one other account on YouTube.
'After the decapitation of their baby, Gates poured salt into the couple's already deep wounds when he betrayed them,' the family's attorneys said.
Gates told NBC News in March 2024, after he was initially found liable in the case, that he had not violated the Health Insurance Portability and Accountability Act (HIPPA) due to a clause that allows physicians to inform the public when there are safety concerns in health care.
'I have not violated HIPAA, it is not required by a physician to get consent to report a crime or some sort of health issue to the public,' Gates said at the time. 'I've been doing this for 15 years, publishing my autopsy cases to explain to the public the victimization of those persons who have died.'
The parents sent a cease-and-desist letter in August 2023 for the videos of their child to be immediately removed; they filed a lawsuit against Gates the following month.
Ross and Taylor also sued the facility where the delivery took place, Southern Regional Medical Center, and obstetrician Dr. Tracey St. Julian — who is a member of a private practice and not the hospital — for "ridiculously excessive force" used during the delivery of their son.
The baby did not properly descend during labor, likely due to shoulder dystocia, a condition that occurs when a baby's shoulder is caught behind the mother's pubic bone, according to the lawsuit against the medical providers. St. Julian tried to deliver the baby vaginally using different methods, including excessive traction resulting in decapitation, skull and facial bone fractures and other injuries, the suit states.
Ross asked for a Cesarean section "while the baby was viable," the parents' attorney Roderick Edmond said at a news conference in 2023, and instead was told to keep pushing for three hours. The baby was ultimately delivered through an emergency C section, which the lawsuit alleges St. Julian failed to perform in a "timely and proper manner" and resulted in the child's death.
Southern Regional Medical Center denied the "allegations of wrongdoing" at the time and said in a statement, "This unfortunate infant death occurred in utero prior to the delivery and decapitation."
In February 2024, the Clayton County Medical Examiner's Office ruled the baby's death a homicide caused by 'actions of another person,' stating his death resulted from a fracture of cervical vertebrae in the spine.
St. Julian's practice and lawyers did not immediately respond to a request for comment, nor did Southern Regional Medical Center.

The court was told the pair had been in a relationship for around six months between December 2021 and May 2022 but remained "on and off" after it ended. Giving evidence, Chloe described their relationship as "narcissistic" adding: "You are addicted to the highs and lows. It is euphoric." During her evidence, the influencer said: "I genuinely thought I'm going to die." She told the court she was left with six bite marks and as a result she needed a tetanus shot and antibiotics. Chloe later went to hospital where it was found one of the bite marks on her neck had "turned septic", it was said. Jurors previously heard a slew of messages were recovered from Lawrence's phone that were sent just before the accusations of assault. He told her: 'I'll do everything in my power to f**k you up. "You're a lying little w****, you said you were coming to me an hour-and-a-half ago." Giving evidence in court, Lawrence claimed Chloe had confided in him that her boyfriend Guccuk was violent towards her - and that at one point he had seen her with a red mark on her face. Lawrence claimed: "She had a mark on the side of her face. It looked like a footprint. It was a round mark. It was a red round mark. "She always described the relationship as violent. She said he used to beat her up, things of that nature." Asked by Tom Wyatt, defending, whether he had ever bitten anyone, Lawrence replied: "Absolutely not. I'd never even had a fight". The defence lawyer said no one was suggesting Chloe was not assaulted but claimed Guccuk was responsible for her injuries. Mr Wyatt added: "She couldn't risk losing the man who paid for her lifestyle." Francesca Allen, 28, who appeared on series five of Love Island, dated Lawrence in 2018 and wrote a character statement as part of Lawrence's defence. Following his initial arrest, Lawrence had wept and said: "This is ridiculous. She's ruining my life. I asked her to leave." Lawrence later gave police a prepared statement in which he confirmed his relationship with Ms Othen began in January 2022 and ended four months later "because she aborted my child". 8 Ricky Lawrence denied assault and was cleared of all charges Credit: Dan Charity 8 Chloe has hit out on Instagram after the ruling saw Lawrence walk free Credit: Instagram 8 She questioned the 'justice' of the situation despite Lawrence being cleared Credit: Instagram

Colorado man charged again with first degree murder of wife who went missing in 2020

A Colorado man suspected of killing his wife was charged Friday for the second time with first degree murder in her 2020 death, the Twelfth Judicial District Attorney's Office said in a release. Barry Morphew was previously charged with first degree murder, among other charges, in May 2021 in the killing of his wife, Suzanne Morphew, who was last seen on Mother's Day in 2020. But those charges were dropped without prejudice — meaning charges could be filed again at a later date — in April 2022 as prosecutors were closing in on finding the woman's remains. Officials took Morphew into custody Friday in Arizona, the District Attorney's office said, but the office is working to extradite the man back to the San Luis Valley in Colorado. It was not immediately clear whether Morphew is being held in jail or he has obtained legal representation. Iris Eytan, the attorney who represented Morphew in the earlier charges, did not immediately respond to a request for comment. It was not immediately clear if she is still representing him. Suzanne Morphew was last seen on May 10, 2020, near County Road 225 and West Highway 50 in Maysville, about 100 miles west of Colorado Springs. She was on a bike ride at the time. A 49-year-old mother of two, Suzanne Morphew was reported missing from her Chaffee County home that same day. Also that day, her mountain bike and helmet were discovered on the side of a county road in Salida, Colorado, near the family's home. Her husband had repeatedly denied his involvement in her death and pleaded not guilty to the initial charges. One week before Morphew was set to stand trial on the initial charge of first degree murder in his wife's disappearance, prosecutors dismissed the charges because they said they had zeroed in on an area where they believed her remains to be, but weather in the region was prohibiting officials from recovery efforts, slowing down the case. Suzanne Morphew's remains were finally uncovered in September 2023, officials said at the time. They were found during an unrelated search near Moffat in Saguache County. An April 2024 autopsy determined she died by homicide, which reported that drugs normally used as animal tranquilizers were found in her system. Suzanne Morphew "died as a result of homicide by unspecified means in the setting of butorphanol, azaperone, and medetomidine intoxication," the El Paso County coroner's report, obtained by NBC News at the time, said. "The drugs are marketed as a compound injectable chemical immobilizer for wildlife providing pharmacologically reversible analgesia, sedation, and immobilization," according to the report. Prosecutors had said they believed Morphew used a tranquilizer gun in his wife's murder. They had also said he was the only one with motive to kill Suzanne Morphew, because she was having an affair, believed her husband was having one, too, and had plans to file for divorce. Days before her disappearance, Suzanne Morphew texted her husband that their relationship was "done," according to the initial arrest affidavit from 2021. "Let's handle this civilly," she said, according to the affidavit. "It had become clear that Barry could not control Suzanne's insistence on leaving him, and he resorted to something he has done his entire life — hunt and control Suzanne like he had hunted and controlled animals," the affidavit said. Morphew also filed a $15 million lawsuit against authorities who accused him of killing his wife in May 2023. At the time, the couple's daughters spoke in support of their father. The District Attorney's office in the Friday release said the investigation into Suzanne Morphew's death has been ongoing. "Federal, State and local law enforcement have never stopped working toward justice for Suzanne," said Twelfth Judicial District Attorney Anne Kelly.
