Issues related to federalism raised under Presidential reference: Sidharth Luthra

New Delhi: Former Additional Solicitor General Sidharth Luthra on Thursday said the reference made by President Droupadi Murmu, in the aftermath of the Tamil Nadu Bills case, raises critical issues related to federalism.
The Presidential reference made under Article 143 of the Constitution has thrown up the question: Can a Governor or the President sit over a legislation, and can it render governance null and void? said Luthra.
'The issue here is not just about the powers of the President, the Governor, the Centre and the State. It's a federalism issue,' he said.
The constitutional expert said the question that needs to be answered is: Can the authorities stop the right of a citizen to good governance?
There's also the issue of how we are going to deal with the rights of the citizens to have governance. 'After all, citizens elect their representative, MPs and the party in power. The citizen expects governance from them. A part of governance is the making of laws, and if a Governor sits over a bill, are we not denying citizens of governance?' he said.
Luthra said the principle of separation of powers and the scope of the Supreme Court's power under Article 142 are the other key issues that the Constitution Bench will now have to decide under President Murmu's reference that has invoked the top court's advisory jurisdiction.
Pointing to a similar reference made after the 2G spectrum auction, Luthra said, 'The current reference is not covered by the opinion given by the SC under its advisory jurisdiction in the previous case.'
After the 2G airwave allocation was struck down by the SC, the government at that time, under reference, had sought the top court's views on the way forward and get a sense about the powers of the Centre, he said.
Luthra said the current reference made by the President is significant due to the underlined issues that it raises.
'Please don't just look at the questions that have been raised, but the underlined issues raised. The scope of the powers of the Supreme Court under Article 142 has also been raised,' he said.
'This reference, to my mind, is to determine what the way is going forward and to what extent the Supreme Court directs governments, Governors and the President to act and to the extent that they will determine and sit over the jurisdiction of Governors and the President,' he said.
The constitution expert said, 'Do keep in mind that the decisions of Governors and the President, in the context of remission, have already been made justiciable on very narrow parameters.'
Article 142 of the Constitution grants the Supreme Court the power to pass any order necessary for doing complete justice in any case or matter pending before it.
In the aftermath of the Supreme Court verdict in the Tamil Nadu Bills case, President Murmu, in a reference made under Article 143 of the Constitution, has asked the top court to consider whether timelines can be imposed on Governors to act on Bills in the absence of a constitutionally prescribed time limit.

T Rabi Sankar, Deputy Governor of the Reserve Bank of India (RBI), has been appointed as a part-time Member of the Sixteenth Finance Commission on Saturday. The appointment of Sankar is consequent to the resignation of one of the full-time Members of the XVIFC, Ajay Narayan Jha, on personal grounds. The Department of Economic Affairs of the Finance Ministry in a notification said, "In pursuance of clause (1) of article 280 of the Constitution read with the provisions of the Finance Commission (Miscellaneous Provisions) Act, 1951 (33 of 1951), the President is pleased to appoint T Rabi Sankar as a part-time Member of the Sixteenth Finance Commission." He will be a part-time Member of the Sixteenth Finance Commission from the date of appointment to the date the Commission submits its report or 31 October 2025, whichever is earlier. Sankar is currently overseeing the key portfolios of the FinTech Department, the Financial Markets Operations Department, and the Financial Markets Regulation Department at the Reserve Bank of India (RBI). Sankar has played a pivotal role in the launch of the Central Bank Digital Currency (CBDC). In April, the Appointments Committee of the Cabinet (ACC) approved T. Rabi Sankar's reappointment as Deputy Governor of the Reserve Bank of India (RBI) for one year. Sankar was Executive Director of the Reserve Bank before being elevated to the post of Deputy Governor in 2021. T. Rabi Sankar, a seasoned central banker, joined the Bank in 1990 and has held various positions at the Reserve Bank of India. As Executive Director, he oversaw the Department of Payment and Settlement Systems, the Department of Information Technology, Fintech, and the Risk Monitoring Department at the RBI. The government appointed Arvind Panagariya as the Chairman of the 16th Finance Commission in 2023. The commission makes recommendations about the distribution of the net proceeds of taxes between the Union and the States. The Finance Commission is constituted by the President under article 280 of the Constitution, mainly to give its recommendations on the distribution of tax revenues between the Union and the States and amongst the States themselves. Two distinctive features of the Commission's work involve redressing the vertical imbalances between the taxation powers and expenditure responsibilities of the centre and the States, respectively, and equalisation of all public services across the States.

COLOMBO: Sri Lankan President Anura Kumara Dissanayake ordered a police probe into the release from prison of a convicted criminal under a purported pardon from him, a statement from his office said on Saturday. The probe was ordered after an individual named W.H. Athula Tilakaratne, serving a sentence at Anuradhapura Prison, was released under the presidential pardon granted on Vesak 2025 despite his name not being among 388 inmates recommended for amnesty, the statement from the president's office said. Article 34 (1) of the Sri Lankan Constitution says the president can pardon convicted prisoners. A list of inmates recommended for pardon is forwarded for approval by the president after a review by the Ministry of Justice. The Presidential Secretariat said a serious irregularity may have occurred in connection with this incident, according to the statement.

RBI Deputy Governor T. Rabi Sankar has been appointed as a part-time member of the 16th Finance Commission, the finance ministry said on Saturday (June 7, 2025). The appointment, the ministry said, 'is consequent to the resignation of one of the full-time members, former Finance Secretary Ajay Narayan Jha, on personal grounds'. "The President has appointed T. Rabi Sankar, Deputy Governor, Reserve Bank of India (RBI), as a part-time Member of the 16th Finance Commission (XVIFC)," the ministry said in a statement. 'Mr. Sankar will hold office from the date of assuming charge until the submission of the Commission's Report or October 31, 2025, whichever is earlier,' it added. The commission, chaired by former Vice-Chairman of Niti Aayog Arvind Panagariya, has four members and is assisted by Secretary Ritvik Pandey, two joint secretaries and one economic advisor. Retired bureaucrat Annie George Mathew and economist Manoj Panda are full-time members of the commission, while SBI Group Chief Economic Advisor Soumya Kanti Ghosh is a part-time member. The government constituted the 16th Finance Commission under the chairmanship of Panagariya on December 31, 2023. The panel would submit its report to the President by October 31, 2025. The report would be for five years commencing on April 1, 2026. Besides suggesting tax devolution between the Centre and states and revenue augmentation measures, the commission will review the present arrangements for financing disaster management initiatives with reference to the funds constituted under the Disaster Management Act, 2005. The Finance Commission is a constitutional body to provide suggestions on centre-state financial relations. The erstwhile 15th Finance Commission under N.K. Singh had recommended that states be given 41% of the divisible tax pool of the Centre during the five-year period 2021-22 to 2025-26, which is at the same level as was recommended by the 14th Finance Commission under Y.V. Reddy.
