Tensions rise during cross-examination in Oyster Bay murder case

The bail application by murder accused Rob Evans got off to a rocky start on Tuesday morning when his lawyer and the magistrate clashed in court over his line of questioning.
Defence attorney Paul Roelofse was busy with his cross-examination of the investigating officer when magistrate Deidre Dickson questioned whether he was speculating.
During the drawn-out bail bid in the Humansdorp regional court, WO Xolile Kato had testified about the crime scene and the investigation which followed when 36-year-old Vanessa van Rensburg's body was discovered on the floor of her boyfriend's holiday home.
Evans is accused of murdering Van Rensburg at the Oyster Bay house during the Easter weekend.
Kato had testified earlier on the extent of Van Rensburg's injuries, and had painted a picture of the crime scene which included shards of a broken glass and a whisky bottle which he believed to have been the murder weapon.
On the 10th day of the formal bail bid on Tuesday morning, Roelofse continued his cross-examination of Kato in a bid to poke holes in the state's case.
He pressed Kato on his earlier claim that there had been no sign of forced entry at the house.
He also asked whether Kato had checked if the garage door was intact.
Kato admitted that he had not inspected the garage door, and that he had in fact not even gone into the garage during the course of his investigation.
Roelofse then put it to him that another person could have entered the house through the garage.
Kato responded that this was unlikely as the interleading door between the garage and the house had been locked from the inside.
When Roelofse tried to question him further on the status of the garage door, Dickson interjected to warn him that he was 'leading the court into speculation not supported by evidence'.
She said this would not assist her in deciding if Evans should be granted bail.
Roelofse insisted his questions were important because the state had argued that there was no forced entry, suggesting that Evans had been the only other person inside the house at the time.
He said he needed to test this properly because the possibility remained that another person could have been inside the house at the time of Van Rensburg's death.
Dickson then ordered Roelofse to cease his current line of questioning, and to instead focus on what the state had presented to the court as evidence.
After the heated exchange, Roelofse asked for an adjournment.
The bail application continues.

A project manager working on the multimillion-rand Sanral project to upgrade the R335 between Motherwell and Addo has been kidnapped. The man, employed by one of the companies contracted by Sanral, was abducted on Wednesday morning. Police spokesperson Brigadier Nobuntu Gantana said the Swartkops police were notified of a kidnapping on Addo Road near Monument Crossing at about 10.30am. A case of kidnapping is being investigated. ' It is alleged that a 37-year-old male was busy on a construction site on Addo Road when a white Mercedes sedan stopped next to him. 'Two [men] got out and then forced him into the Mercedes and drove off with him. 'One of the [men] also took [the victim's] white Toyota Hilux bakkie, which was found abandoned again in Ikamvelihle a short while later. 'No ransom demands have been made yet,' Gantana said. Eastern Cape premier Oscar Mabuyane has previously spoken out about attacks on the construction project. During his state of the province address in 2024, he revealed that 'construction mafias' had threatened to stop the upgrade, demanding R450,000 a month in protection fees. The road is a vital citrus export route from the Sundays River Valley municipality to Nelson Mandela Bay's two ports. The project is divided in two, with the first phase cutting across wards 53, 54, 55, 56 and 23 in Motherwell. The second phase is from Addo to Ngqweba (formerly Kirkwood). A source close to the project said the assailants had visited the area for the second time in the space of a week. 'Last week Friday, the site manager for phase two of the project [had a gun pointed at him] by unknown people who came on site and made some demands. 'Since that incident, the site manager left and has not returned to work,' he said. 'And now today the project manager employed by the same company has been abducted. 'This has been an ongoing problem here in Motherwell. 'At one point last year people came and demanded a monthly protection fee of R450,000 which meant the project had to temporarily be stopped for safety reasons.' A second source said they were concerned for the kidnapped manager's safety and the repercussions this would have for the project. 'From what I heard, the guys came last week and shot in the air and on the road to scare people. 'The fear by residents and councillors is that the project might have to be closed because threats are not happening for the first time and people's lives are at risk. 'Even Mabuyane has spoken publicly about these threats on construction companies, but they don't seem to have stopped,' the insider said. The Herald

Police, assisted by the FBI, arrested a couple in Bloubergstrand for allegedly sexually abusing their daughters aged three and eight to produce child pornography in Cape Town. The 47-year-old woman and 48-year-old man were arrested at a 'residence identified through joint investigative efforts' on Tuesday, said police spokesperson Lt-Col Amanda van Wyk. 'The suspects face many charges, including the production of child sexual abuse material (commonly referred to as child pornography), rape, sexual assault and sexual grooming. 'The victims were rescued during the operation and have been placed in a place of safety,' said Van Wyk. The arrests were carried out by a multidisciplinary team including members of the national and Western Cape serial and electronic crime investigations units, the department of social development, supported by the FBI and homeland security investigations. Van Wyk said several electronic devices were seized during the bust and the investigation continues. Fifteen bricks of cocaine worth an estimated R18m have been seized with several firearms from a storage facility in the Cape Town CBD. The police raid on a self-storage facility in Roeland Street on Tuesday also led to the arrest of a 40-year-old man for allegedly dealing in drugs and the unlawful possession of unlicensed firearms and ammunition. 'Armed with intelligence about drugs and firearms being stored at the address, the officers operationalised the information and pounced on the self-storage facility where they found the suspect at one of the units,' said spokesperson Capt Frederick van Wyk. ' They conducted a search of the unit upon which they discovered 15 bricks of cocaine of about 15kg [1kg each] with an estimated street value of R18m as well as one AK-47 rifle, an Uzi, five 9mm pistols and an assortment of ammunition.' The suspect is expected to appear in the Cape Town magistrate's court soon. The bust was the culmination of an intelligence-led operation by members of the police anti-gang unit, crime intelligence and provincial organised crime detectives. Western Cape police commissioner Lt-Gen Thembisile Patekile said the drugs and firearms could have caused havoc in the wrong hands in communities where gang and gun violence are prevalent. TimesLIVE
