Sebi said it is upgrading its surveillance to investigate instances of derivatives manipulation

Securities and Exchange Board of India (Sebi) Chairman Tuhin Kanta Pandey on Monday said that the markets regulator is upgrading its surveillance to examine cases of derivatives manipulation. His remark comes days after Sebi found New York-based hedge fund Jane Street was manipulating stock indices.
"There may not be many more such cases," said Pandey, as quoted by news agency Reuters.
Earlier, Sebi had banned New York-based Jane Street and its group companies from the domestic market for allegedly manipulating the Nifty Bank index. Pandey had warned on Saturday that market manipulations, such as those allegedly committed by Jane Street, will not be tolerated.

Mumbai: A sessions court recently rejected a police request for custody of an alleged financial scam mastermind, Shaileshkumar Pandey, and instead remanded him in judicial custody while ordering his return to Kolkata. The court decision hinged on the finding that Pandey was illegally detained and produced before the court beyond the permissible 24-hour period from his initial custody. Pandey was presented before the court on June 30 in connection with a case registered by the Economic Offences Wing (EOW) under sections of the IPC and the MPID Act, involving alleged offences of cheating, criminal breach of trust and criminal conspiracy. The EOW alleged Pandey helped a co-accused, Prasanjit Dad, open 200 bank accounts to collect investment funds, earning a commission of Rs 18 crore to Rs 20 crore. The defence lawyers, Nilesh Mishra and Zakir Hussain (appearing via video conference), submitted that Pandey was taken into custody by the EOW from Presidency Correctional Home, Kolkata, on June 28 at 2.20 pm. They argued that despite this, he was shown as arrested only on June 30 at 10.20 am, and subsequently produced in court beyond the 24-hour limit. The court referred to a recent Bombay high court judgment and iterated that the 24-hour period for production before a magistrate commences from the time an accused is taken into physical custody, not from the time an arrest memo is prepared. While the prosecution highlighted an order which directed Pandey's production forthwith, "excluding the time taken during transit", the city court noted that the EOW failed to move any transit remand application after taking custody of Pandey. This omission, the court observed, meant the detention during transit was not legally authorised. "In short, accused is taken in custody at 14.20 pm on June 28, and in view of ratio laid down…, the period of 24 hours began to run from said time," the court stated in its order. "Accused is produced beyond 24 hours before this court from actually taking into custody. Thus, in my view, accused is illegally arrested and produced beyond 24 hours. Hence, he cannot be further detained either in police custody." The court rejected the EOW plea for police custody and remanded Pandey to judicial custody until July 7, specifically for the purpose of his return to Presidency Correctional Home in Kolkata. The EOW has been directed to arrange for Pandey's transfer back to Kolkata within three to four days. Pandey was subsequently taken back.

New Delhi: Leader of Opposition in the Lok Sabha Rahul Gandhi on Monday said that the futures and options (F&O) trading market has become a playground for 'big players,' and the Jane Street saga shows that retail investors are bearing the maximum brunt. Jane Street has been barred by the capital markets regulator SEBI from the Indian stock market for indulging in manipulative trading practices that allegedly enabled the company to make unlawful profits running into thousands of crores. In a post on social media platform X, Rahul Gandhi said he had clearly stated in 2024 that "the F&O market has become a playground for 'big players,' and small investors' pockets are continuously being drained". "Now SEBI itself is admitting that Jane Street manipulated thousands of crores. Why did SEBI remain silent for so long? At whose behest was the Modi government sitting with its eyes closed?" said the Congress leader. He said the need is for enforcement and surveillance rather than more regulations, and the "order in the Jane Street case speaks for itself". "Within the regulations only, we have bought it. So, regulations remaining the same, it is the enforcement and surveillance that can actually help. Excess regulations do not mean excess regulation. Those are two different things," Mr Pandey remarked. He highlighted that a great deal of analytical work went into the Jane Street case, as manipulative activities are done in many ways. Jane Street indulged in aggressive trading in the derivatives (futures) segment, where the firm executed trades to influence market prices by unfair means to make a fast buck.
