NPA confirms 12 murder-accused SANDF members facing two other counts of murder

JOHANNESBURG - The National Prosecuting Authority (NPA) has confirmed that the 12 South African National Defence Force (SANDF) members charged with the 2023 murder of a Hawks' investigator are also facing two other counts of murder.
Frans Mathipa was shot in the head on the N1 near Hammanskraal, while probing claims that some members of the SANDF special forces were behind the abduction of two foreign nationals at the Mall of Africa.
The group appeared before the Randburg Magistrates Court in Johannesburg on Tuesday, where new details about the case emerged. At the time of his murder, Hawks investigator Mathipa had applied for a Section 205 subpoena to get classified documents that could shed some light on the 2022 kidnapping. According to Open Secrets, on or before the deadline for the SANDF to respond to the application, Mathipa and army officials had agreed to halt the process while they negotiated access to the requested information.
The SANDF maintains that the operatives were at the Mall of Africa on 29 December 2022, for a training exercise and that the abduction of an alleged ISIS associate and his bodyguard was a coincidence.
While it was never confirmed at the time, the NPA's spokesperson in Gauteng, Phindi Mjonondwane, said the kidnapped men may have also been killed by the special forces.
'I can just give a hint to say that we'll be relying on the case of Francis Rasuge in proving the other two murder charges, that's as far as we can go.'
The 12 accused are set to be back in court for a continuation of their bail hearing on Thursday.
The SANDF has consistently denied claims that the special forces unit is rogue, adding that claims of torture, illegal arrests, and murder are untrue.

NPA petitions SCA on discharge of Ace Magashule's ex-PA Moroadi Cholota
The National Prosecuting Authority (NPA) has filed a petition with the Supreme Court of Appeal (SCA) for leave to appeal the judgment delivered in the Free State High Court regarding Moroadi Cholota's special plea on the lack of the court's jurisdiction in the asbestos case. Last month Cholota successfully challenged her extradition from the US to testify in the corruption trial where her former boss, former Free State premier Ace Magashule, is one of the accused. The NPA initially filed for Cholota, who was studying in the US, to be extradited in 2022 after linking her to the corruption case. After her extradition, Cholota was included in the case as an accused. However, judge Phillip Loubser said Cholota's extradition was unlawful and the court was precluded from trying the offences she was charged with. She was then discharged. 'The petition to the SCA follows after judge Loubser dismissed the NPA's request for the judge to reserve questions of law in terms of the Criminal Procedure Act,' NPA spokesperson Mthunzi Mhaga said. He said the NPA believed the judge erred in dismissing the application for leave to appeal, there were reasonable prospects of success to appeal the judgment and there were compelling reasons for the SCA to hear the state's appeal. 'We are also exploring the possibility of approaching the Constitutional Court, challenging the same judgment, given the possible far-reaching implications on many other extradition matters.' Despite pleading not guilty, the State, represented by advocate Steven Muavha, presented compelling evidence that proved Chabalala's guilt beyond reasonable doubt. In aggravation of sentence, the prosecution told the court that the scourge of rape has reached 'pandemic levels' in the Vhembe district. The prosecution demanded that harsher sentences are necessary to protect vulnerable citizens, especially the elderly. It was further highlighted that Chabalala is a repeat offender, and had been undeterred by his previous convictions. In delivering judgment, Judge Thogomelani Caution Tshidada described Chabalala as 'one of the filthiest perpetrators who does not deserve to live in our communities'. The judge lamented that the victim was old enough to be Chabalala's grandmother and should have been treated with dignity and respect. The court also highlighted Chabalala's lack of remorse and found no mitigating factors to justify leniency. Meanwhile, the NPA has welcomed the sentencing heaped on Chabalala, adding that the jail terms will serve as a strong deterrent to would-be offenders. Director of Public Prosecutions in Limpopo, advocate Ivy Thenga, has commended the prosecution and investigation teams for their diligence and commitment to justice. 'This sentence reinforces our resolve to protect the most vulnerable in our society and ensure that justice prevails,' said Thenga.
