
No EU toast raised with single malta: CJEU verdict spells end for 'Golden Passport' scheme
Freedom to do so must be exercised in compliance with EU laws.
The scheme led to 'commercialisation of the grant of nationality of a member state and, by extension, of [EU] citizenship', which breaches EU rules relating to citizenship and the principle of sincere cooperation.

In April, Court of Justice of the European Union (CJEU) held Malta's investor-citizenship scheme (ICS) - 'golden passports' - to be a contravention of EU laws. This was the only remaining EU member state that still operated a golden passport programme.ICS was adopted under Article 10(9) of the Maltese Citizenship Act, and the Granting of Citizenship for Exceptional Services Regulations 2020, which allowed foreign investors to be naturalised as citizens of Malta upon fulfilment of certain conditions, principally of a financial nature. Such schemes are called ' citizenship by investment ' (CBI). CJEU's impugned order comes days after the EC initiated legal proceedings against Malta after revelations that Maltese passports had allegedly been sold to Russians, who were later sanctioned due to the Russia-Ukraine war.Malta defended its competence in regulating citizenship matters. While the court recognised this, it also held that:According to Article 20 of the Treaty on the Functioning of the European Union (TFEU):Article 9 of the Treaty on European Union (TEU) similarly states that every citizen of a member state shall be an EU citizen. Also, Article 4(3) of TEU puts forth the principle of sincere cooperation, under which the EU and member states shall:Notably, CJEU's order contradicts advocate general Anthony Collins' opinion from 2024, in which he remarked that 'holding the scheme to be illegitimate would upset the carefully crafted balance between national and EU citizenship, leading to a wholly unlawful erosion of member states' competence'.CBI was launched after Malta's integration into the EU and its adoption of the euro, which exposed Malta's economy to the 2008 financial crisis and the euro crisis of 2009. After this, Malta first came up with the idea of CBI in the form of the Individual Investor Programme (IIP) in 2013. Under it, an investor (citizenship buyer) was required to make a non-refundable contribution to Malta's National Development and Social Fund.A minimum non-refundable donation of ₹6 lakh was required for a 36-mth naturalisation period, while ₹7.5 lakh could fast-track naturalisation to only a year. IIP was open for applications until September 30, 2020, after which it was replaced by 2020 regulations and the Maltese Citizenship by Naturalisation for Exceptional Services by Direct Investment scheme.With its success, Malta has continued to promote the scheme. Valletta has now become home to many licensed agencies and legitimate brokers that peddle citizenship of their country (and, by extension, that of the EU). Its concurrent rise in notoriety stems from the fact that by selling its citizenship, Malta is transacting EU citizenship - opening the proverbial door to non-EU nationals to enter the union's political bloc and economic markets.CBI's implications have been deep, perverse and expansive. Countries such as Malta are arguably transacting more than just an entitlement or a bundle of rights, leading to unexpected triggers and worries. The issues around national sovereignty, market access, free trade, visa-free travel and global security are just the tip of the iceberg.Whether it's the issue of absconsion, tax avoidance, shifting wealth or even waging wars, one can witness a systematic and institutional decoupling of the state from its citizenry. Moreover, over half are actively integrating AI-driven technologies to streamline tax functions, paving the way for a smarter, more automated compliance space. Why the growing interest in AI? The constant stress of creating a tax-transparent and globally connected trade environment has driven Indian exporters to seek the best-in-class solutions. This stress arises from the multilayered regulations they need to tackle from the outset. In the US, for instance, tax compliance becomes challenging due to the multijurisdictional nature of sales tax. Each state imposes their own rates and economic nexus laws requiring businesses to collect and remit sales tax once they exceed certain revenue thresholds, even if the company has no physical presence there. Moreover, there are over 13,000 sales and use tax jurisdictions in the US with their policies and deadlines. Similarly, the VAT system in the European Union (EU) has its own set of requirements. An Indian exporter selling across member states may need to charge different VAT rates based on the product type and the buyer's location, leading to a convoluted network of compliance responsibilities. This can be overwhelming, especially as compliance errors can lead to penalties and disruptions in trade. To overcome this, AI-powered tax systems offer an integrated solution that consolidates tax laws from multiple jurisdictions, automating calculations, filings, and regulatory updates. By reducing manual efforts and decreasing the risk of errors, AI helps exporters redirect their focus from regulatory burdens to strategic expansion. Additionally, AI-enabled platforms can help track real-time transactions, proactively flagging potential issues before filing returns. For example, if an Indian exporter selling apparel online approaches California's economic nexus threshold of $500,000 in sales , AI systems can alert the business to register for sales tax in that state. By utilizing ML algorithms, AI can also predict future tax liabilities based on historical data and projections, helping businesses avoid unforeseen tax burdens. Simultaneously, AI and ML make accessing and interpreting vast amounts of tax data stored in the cloud easier. AI-driven platforms can source and structure this data, helping businesses understand what has changed, track new tax rates, and automatically find the correct rates for each product and location. In line with this, companies are increasingly adopting advanced technologies, such as GenAI, blockchain, and data analytics, to revolutionize their tax functions. According to recent studies, 87% of tax and finance professionals believe GenAI will significantly enhance the efficiency and effectiveness of their operations. GenAI helps businesses automate complex tax-related processes, such as generating accurate tax reports, predicting potential liabilities, and identifying discrepancies across jurisdictions. This allows organizations to swiftly adapt to regulatory shifts, ensuring greater compliance and reducing the risk of costly mistakes in cross-border transactions. Beyond the basics The push for Digital India is propelling significant progress in various sectors, focusing on leveraging technology to streamline operations and compliance. A recent example of this impel is the launch of Bharat Trade Net (BTN), a unified digital platform designed to simplify cross-border trade. BTN focuses on enhancing logistics, customs clearance, and trade documentation processes, which are often burdensome for exporters. Moreover, it significantly improves transparency and provides easier access to financing, making it simpler for Indian businesses to expand. Given this, as AI drives tax compliance and automation, it has the potential to enhance the capabilities of platforms like BTN, ensuring that Indian businesses remain innovative and efficient globally. Notably, the collaboration between the government and businesses will be crucial in shaping a future-ready tax ecosystem. With this, the increasing adoption of third-party, automated tax solution providers signals towards more secure, scalable, and cost-efficient solutions for managing tax compliance. Looking ahead, all these advancements will smoothen the tax processes and empower businesses to respond faster to regulatory changes, ensuring greater accuracy and transparency. As the industry evolves, Indian exporters need to be better equipped to meet the obstacles of a rapidly changing tax world, enabling sustainable growth and unfolding new opportunities for businesses and the economy alike.

Delhi court acquits former coal secy HC Gupta, 2 senior officials over Jharkhand block allocation ‘scam'
A Delhi court Friday acquitted former coal ministry officials H C Gupta (secretary), K S Kropha (joint secretary) and K C Samaria (coal allocation director) in a case linked to alleged irregularities in the allocation of the Mahuagarhi coal block in Jharkhand to the company M/s Jas Infrastructure Capital Pvt Ltd (JICPL). While the three men – represented by advocates Rahul Tyagi and Mathew M Phillip – were acquitted, Special Judge Sanjay Bansal of Rouse Avenue Court convicted the firm JICPL and its director Manoj Kumar Jayaswal. Arguments on their sentence will be heard on July 8. The allegations in the case were that JICPL had misrepresented various facts in its application and had fraudulently obtained the allocation of the coal block. Allegations against the public servants were that they had acted in a manner which was 'detrimental' to public interest and that they had allowed JICPL to 'misappropriate' nationalised natural resources. In December 2016, a trial court in Delhi had framed charges in this case for alleged offences under sections 420 (cheating), 468 (forgery for the purpose of cheating), 120 B (criminal conspiracy) of the Indian Penal Code (IPC) and under relevant provisions of the Prevention of Corruption Act. Initially, the Central Bureau of Investigation (CBI) had filed a closure report in this case in April 2014, stating that no case was made out against the accused. A detailed closure report was filed on October 14, 2014. The court had on November 20 that year disagreed with the CBI's conclusion and held that a case was made out for taking cognisance of the alleged offences against the accused. A Delhi court had in 2018 sentenced Gupta, Kropha and Samaria to three years' imprisonment in a case pertaining to alleged irregularities in the allocation of Moira and Madhujore (North and South) coal blocks in West Bengal to Vikash Metal and Powers Ltd. In 2017, the three were convicted in a case related to irregularities in the allocation of Thesgora-B Rudrapuri coal block in Madhya Pradesh to Kamal Sponge Steel and Power Ltd (KSSPL). Towards the end of its tenure, the UPA 2 government started being perceived as corrupt due to allegations connected with the 'coal scam'. A Comptroller and Auditor General (CAG) report had at the time pegged the loss to the exchequer at Rs 1.8 lakh crore. While 27 of the 54 cases being investigated by the CBI have been disposed of, the other half are still pending a decade later. With this case, the CBI has achieved 19 convictions. Three of its cases have ended in acquittals and two in discharge. In the aftermath of the alleged coal scam, on August 25, 2014, the Supreme Court cancelled the allocation of 204 coal blocks, deeming them illegal and arbitrary. Additionally, it also levied a penalty of Rs 295 per tonne of coal that had already been mined over the years. In his book titled Supreme Court and the Indian Economy, Pradeep S Mehta states that the apex court's decision increased the current account deficit by US$ 700 million due to additional coal imports. 'Around Rs 4.4 lakh crore was the estimated loss in royalty, cess, direct and indirect taxes, etc,' wrote Mehta, citing an SBI research report. Former Solicitor General of India Harish Salve had stated that the decision cost the economy 1 per cent of the GDP.

India saw a resilient FY25, despite weak manufacturing. Keeping momentum will require reforms
The wedge between the GDP and GVA growth is explained by higher net taxes (up 12.7 percent), driven by higher collections and lower subsidies. The strong Q4 helped annual GDP growth for FY25 reach 6.5 percent, matching previous estimates. India's economy wrapped up FY 2024-25 strongly, with the fourth quarter Gross Domestic Product (GDP) growing 7.4 percent year-on-year—the fastest in a year and above expectations. Gross Value Added (GVA) growth for the quarter came in at 6.8 percent. A key driver behind the recent growth surge has been the government's strong focus on capital expenditure in the last quarter of FY 2024-25. Gross Fixed Capital Formation (GFCF) jumped by 9.4 percent in Q4—the fastest pace in six-quarters—highlighting sustained investments in infrastructure, such as roads, railways and urban development. The construction sector mirrored this momentum, expanding by 10.8 percent in the quarter and 9.4 percent over the year. Furthermore, the substantial increase in central government capital expenditure in the second half of FY25—up 48 percent year-on-year in December 2024 and 33 percent in March 2025—significantly contributed to the overall improvement in investment growth during the year. This investment-led growth is further corroborated by the Index of Industrial Production (IIP) for infrastructure and construction goods, which recorded an impressive 8 percent growth in Q4, underscoring the robust activity in construction and capital formation during the period. Resilience of rural sector Rural India continued to support growth in the absence of a broad-based revival in urban growth. The primary sector, which includes agriculture, forestry, and fishing, expanded by 5.4 percent in Q4, up sharply from just 0.9 percent a year ago. This was supported by improved rabi crop output (4.5 percent growth in food grain output for FY25) and higher Minimum Support Prices (for example, Rice: 5 percent; Wheat: 7 percent for marketing season 2024-25), which boosted rural incomes and, in turn, private consumption. Average rural wages (men) rose by 6 percent in FY25 (April–February, compared to the same period last year), exceeding the trend and reinforcing signs of a rural revival. Decent growth in services Services continued to be the backbone of India's growth, contributing 55 percent to Gross Value Added (constant prices) this year. The sector recorded 7 percent growth for the third straight quarter in Q4 FY25. Financial, real estate and professional services etc. grew by 7.8 percent in Q4, while public administration and defence expanded by 8.7 percent, while trade, hotel, transport etc recorded 6 percent. Interestingly, the firm data seems to align with the official figures. The Gross Value Added by listed non-financial services companies broadly corroborates the official growth estimates for sectors like trade, hotels, and transport etc. Also Read: Why RBI's dividend to Centre is at a record high in FY25 & a volatile history of its surplus transfers FY25 Provisional Estimates For the full financial year of 2024-2025, real GDP stood at Rs 187.9 lakh crore, reflecting a 6.5 percent growth, which is in line with the Second Advance Estimates. Sectoral growth estimates present a mixed picture, with investments and lower imports contributing positively to overall growth, and consumption remaining somewhat subdued. It is important to note that these figures are derived using the benchmark method with the help of proxy indicators, and as such, the estimates are subject to revision, when actual source data becomes available. While most sectors performed in line with expectations, the construction sector stood out, posting a growth of 9.4 percent for FY25 in the Provisional Estimates—higher than the 8.9 percent projected in the earlier Second Advance Estimates—highlighting its strong momentum within the overall economic landscape. Agriculture saw a notable turnaround in FY25, with growth rising to 4.6 percent from 2.7 percent last year. The higher agriculture output is driven by rising foodgrain output in the year. The outlook remains positive, with above-normal monsoon projected for the current year as well. Manufacturing's share in GVA remained flat at 17 percent, and the sector grew by 4.5 percent in FY25, as against 12.3 percent in FY24. Manufacturing continued to face both structural and cyclical challenges, including global supply chain disruptions, trade uncertainties and soft urban demand. This underperformance is concerning, given the sector's importance for exports and job creation. While Gross Fixed Capital Formation share of GDP (constant prices) rose to 33.7 percent—the highest since FY14—it seems to reflect the outsized role of the public sector in driving investments. National Accounts Statistics 2025 suggests that private corporations investment remained flat at Rs 20.4 lakh crore in FY24, compared to Rs 20.3 lakh crore in FY23 at constant prices. This stagnation reflects weak investment sentiment, which is likely to improve only as business confidence, capacity utilisation and global demand strengthen. Private Final Consumption Expenditure grew by 7.2 percent in FY25, up from 5.6 percent last year, but remains below pre-pandemic levels, indicating a still-fragile recovery. Rural consumption has been more resilient, thanks to higher real wages and strong farm output. Looking ahead, recent tax cuts, a likely normal monsoon and expected rate reductions by the Reserve Bank of India should help boost urban demand in FY26. However, the overall outlook for PFCE remains cautious, and will depend on continued policy support, and sustained recovery in both rural and urban consumption. Exports lent strength to the GDP numbers with a growth of 6.3 percent growth in FY25, as against 2.2 percent in FY24. Buoyant services exports and contraction in imports (-3.8 percent) led to the growth. Looking ahead, export prospects face headwinds from global trade weakness, tariff shocks and softer IT demand, which could keep net exports under pressure in FY26. India's FY25 growth reflects resilience, driven by strong public investment and a vibrant services sector, though persistent manufacturing weakness highlights the need for structural reforms. The outlook for FY26 remains positive. Rural consumption is expected to lead India's economic recovery in FY26, supported by recent income tax reliefs, a forecasted normal monsoon, and anticipated 25-50 basis points of rate cuts by RBI—all of which should boost rural demand even as urban discretionary spending remains subdued. Maintaining momentum will require labour reforms, climate-resilient agriculture and new trade agreements, alongside continued focus on infrastructure and digital investments. Despite global headwinds, India is projected to grow at 6.3–6.4 percent in FY26.
