Indian national company director facing CBT charge granted bail of RM50,000
KUALA LUMPUR: An Indian national company director facing a criminal breach of trust (CBT) charge was today granted bail of RM50,000 with two local sureties by the High Court.
Justice K. Muniandy granted the application after hearing a bail review submitted by counsel Daniel Annamalai, who represented Rajinder Singh, 57, following the Sessions Court's earlier decision to deny bail.
'The Court allows the applicant to be released on bail of RM50,000 with two Malaysian sureties, with the additional condition that his passport be surrendered to the court,' he ruled.
Earlier, deputy public prosecutor Izalina Abdullah informed the court that the prosecution had proposed bail of RM70,000 at the Sessions Court, however, it was ultimately subject to the discretion of the presiding judge.
'Should this court allow the applicant to be released on bail, we propose the same amount, RM70,000, with two Malaysian sureties and the additional condition that the applicant surrenders his passport to the court,' she submitted.
Meanwhile, Daniel submitted that the Sessions Court had denied bail on the grounds that his client is a foreign national. However, he informed the High Court that Rajinder has been residing in Malaysia for approximately eight years for employment purposes and holds valid travel documents.
'The proposed sum of RM70,000 is excessive for my client. We respectfully request that bail be set at RM40,000 should this honourable court be minded to grant bail,' he said.
On May 5, Rajinder pleaded not guilty in the Sessions Court here to a CBT charge involving RM141,486.12, belonging to Vantage Trading Partners, entrusted to him as an authorised signatory of the company.
He allegedly committed the offence at the company's premises at Ilham Tower, Jalan Binjai here, on Oct 13, 2021, and Nov 26, 2021, and was charged under Section 409 of the Penal Code, which carries an imprisonment of between two and 20 years, caning and a possible fine upon conviction.
The accused also claimed trial to an alternative charge of misusing the same funds without the consent or ratification of a general meeting, at the same location and on the same dates, under Section 218(1)(a) of the Companies Act 2016, which provides a maximum penalty of five years imprisonment, a fine of up to RM3 million, or both.

Arambai Tenggol, which is alleged to have orchestrated the violence against the Kuki community, has also announced a 10-day shutdown in the valley districts. The state's home ministry has ordered all internet and mobile data services in volatile districts to be shut off for five days in order to bring the latest unrest under control. Internet services were shut down for months in Manipur during the initial outbreak of violence in 2023, which displaced around 60,000 people from their homes according to government figures. Thousands of the state's residents are still unable to return home owing to ongoing tensions. Long-standing tensions between the Meitei and Kuki communities revolve around competition for land and public jobs. Ex-cop's murder death penalty affirmed as message to police officers
The Court of Appeal upheld the death penalty imposed on Ahmad Rizal Umar for the murder of Kartini Borhan, 27, four years ago. PETALING JAYA : The Court of Appeal said it upheld the death sentence imposed on a former investigating officer for the murder of his lover 14 years ago to convey a clear message to all police officers of the need to uphold the law. Justice Wong Kian Kheong said all officers were required under Section 13 of the Police Act 1967 to take an oath. 'By murdering the deceased, the appellant had betrayed his declaration to 'obey, uphold and maintain' the law,' he said, adding that the bench exercised its sentencing discretion to affirm the punishment on grounds of public interest. Last September, a three-member bench chaired by Justice Supang Lian, sitting in Kota Kinabalu, dismissed Ahmad Rizal Umar's appeal against conviction and sentence for killing Kartini Borhan, 27. Also on the panel hearing the appeal was Justice Collin Lawrence Sequerah. Rizal, who held the rank of inspector, committed the offence at an apartment in Taman Andika, Keningau, between 4am and 5am on Sept 29, 2011. Wong delivered his 37-page written grounds earlier this week, paving the way for Rizal, 43, to exercise his automatic final right of appeal to the Federal Court. The judge said Rizal had used violence and great force to kill Kartini with a knife leaving the victim suffering 10 injuries, including a horrific second stab wound. 'After the murder, he attempted to conceal the offence by alleging that Kartini had been killed by an assailant who broke into the premises to rob her. 'Worse still, he had the temerity to make the false police report and had not shown any remorse,' he said. He said Rizal used his police training and work experience as an investigating officer to conceal the crime. According to the facts of the case, Rizal was in Kartini's rented apartment on the day of the incident but made it look as if a robber had broken into the premises and attacked both of them. Wong said a forensic pathologist gave evidence that Rizal's injuries were self-inflicted and not consistent with the consequences of a combative encounter with a robber. The motive for the murder was a love triangle as the deceased was alleged to have been having an affair with another man. In mitigation earlier, lawyer Ram Singh, who was assisted by Chen Wen Jye, asked for Rizal to be imprisoned and whipped, saying he was a first offender and father to two children. In response, deputy public prosecutor Amril Johari called for the death penalty to be retained as the accused was a law enforcement officer who had attacked his victim brutally.

Bodies of missing couple Tanjung Harapan boat accident recovered
A TRAGIC boat accident off Tanjung Harapan, Port Klang, has claimed five lives, including a married couple whose bodies were found drowned near North Port early this morning. The incident, which occurred during a test drive of the boat, involved six people. Three died at the scene, one survived, and two were initially missing. None of the victims were wearing life jackets, complicating the search and rescue efforts. The missing couple, Gan Hon Tat and Careen Man, both from Klang Utama, were among the deceased. Selangor Malaysian Maritime Enforcement Agency (MMEA) enforcement and excise unit operations officer Lieutenant Mohd Syafiq Sazali said both victims were Malaysian nationals. 'The bodies were found floating at 7.42am about 0.1 nautical miles from North Port, Port Klang,' he said. 'We recovered the bodies using assets from the Fire and Rescue Department and brought them to the Selangor Maritime jetty,' he added.
