
Sales Tax Act: Proposed Section 37AA irks businessmen at large
LAHORE: Proposed insertion of a new Section 37AA in the Sales Tax Act has irked businessmen at large, authorizing an Inland Revenue Officers (IROs) to arrest without warrant based on mere suspicion of tax fraud – a power that invites abuse and harassment.
They said the provision creates a surveillance state where businesses operate under the constant threat of arbitrary action. This is not tax policy but a systematic harassment institutionalized by law, they added.
As per the provision, an IRO can arrest a person involved in a tax fraud or any offence under the Act with prior approval from the commissioner. If delay may let the person escape or it is impractical to get approval, the officer may arrest without it – but he must immediately inform the commissioner with all relevant facts and grounds for arrest.
It may be noted that the Sales Tax Act had empowered the IRO to raid a business place and confiscate books of account, computers and business record in case of tax fraud. But the present one provision has proposed arrest of taxpayer to investigate and get a confession on the assumption that a tax fraud may have happened.
They said empowering IROs with such an authority would lead to corrupt practices besides harassment. Mustafa Ashraf, a tax consultant, also pointed out that how a commission can extend approval for arrest a taxpayer when he's not present on the spot simply on the statement of IRO regarding a tax fraud. No procedure has been defined and the commissioner would be authorizing IRO on his verbal briefing on tax fraud, he wondered. Also, he added that how an IRO can arrest a taxpayer first and seek an approval from the commissioner in the follow up.
Some other tax experts dubbed the said provision as a complete ambiguity. They said the said provision also lacks the procedure regarding pre or post arrest bail of taxpayers. No such opportunity has been given to taxpayers and IRO has been bestowed with unlimited powers.
It is nothing but harassment and sole discretion of IROs. Also, the provision does not suggest action against IROs in case their mala fide is established at the end of the whole exercise, they asserted.

FBR makes first major ‘Benami Property' seizure in Islamabad, vows to expand crackdown
The Federal Board of Revenue's (FBR) Anti-Benami Initiative (ABI) has seized its first immovable properties under the Benami Transactions (Prohibition) Act, 2017, marking a milestone in Pakistan's fight against illicit wealth and tax evasion. Two prime plots in Islamabad's Pakistan Employees Cooperative Housing Society (PECHS)—Plot 168-A (816 sq yards) and Plot 174-A (991 sq yards)—were confiscated after investigators found they were registered under a 'benamidar' (front person) whose CNIC had allegedly been misused. The owner disclaimed knowledge of the properties and was unregistered with the FBR. Subsequent to a thorough investigation, a reference was filed before the Benami Adjudicating Authority Bench-I Islamabad, and the case was decided in favor of the Benami Zone-I, Islamabad. Following the completion of all legal procedures, the properties were confiscated with the assistance of local law enforcement agencies. This action aligns with the government's intensified efforts against benami assets, which gained momentum in July 2019 with the establishment of three Ani-Benami Zones across the country. These zones, operating under the supervision of a Directorate General ABI, have filed over 187 references involving various categories of assets, including shares, bank accounts, vehicles, land and buildings. The ABI Zone-I, Islamabad, has been actively involved in identifying and investigating benami properties in the Province of KP, Civil Division of Rawalpindi and Islamabad Capital Territory. The successful confiscation of these plots mark a significant step in the government ongoing campaign to eliminate benami transactions, non-documentation of economy, detect/catch the ill-gotten and untaxed money, curb white collar crimes and generate resources for the state.

Minister stresses need for ecological preservation at ports
KARACHI: Federal Minister for Maritime Affairs Muhammad Junaid Anwar Chaudhry has emphasised the need to balance industrial growth with ecological preservation at ports, underscoring a strategic vision that aligns economic development with environmental sustainability. In a statement on Friday, he called on the Port Qasim Authority (PQA) to intensify efforts to protect the environment across all industrial zones under its jurisdiction, stressing the importance of responsible industrial growth alongside ecological preservation. The Minister directed PQA management to ensure that all industrial units have installed sewage treatment plants. He directed that the failure to comply should result in penalties under environmental laws for pollution and improper waste discharge to curb industrial pollution and safeguard marine and coastal ecosystem. Praising PQA's engagement of independent third-party for environmental monitoring, the Minister urged the port to maintain impartial, data-driven assessments of industrial compliance. This approach will improve transparency and strengthen regulatory enforcement. Highlighting PQA's commitment to the global Green Port Initiative, the Minister noted that the authority has successfully planted over 25,000 trees within port areas, significantly contributing to carbon sequestration and ecosystem restoration. 'These efforts underscore PQA's unwavering dedication to environmental responsibility and a sustainable, greener future for maritime sector.' He said it aligns with broader government policies to modernise maritime infrastructure and enforce stricter environmental regulations, including waste management and afforestation projects. The Ministry continues to collaborate with port authorities, industry stakeholders, and environmental agencies to ensure the ports contribute positively to climate resilience and marine conservation, he added.
