A 'glimmer of hope' towards transforming financial services landscape

It cannot be business as usual. Especially not in South Africa, the most unequal country in the world.
If steered on the helm of transformation, fairness and transparency, South Africa's financial services sector could be a vital vessel of democracy helping to navigate the nation away from the deep-set patterns of economic marginalisation and financial inequality.
On the horizon is the Conduct of Financial Institutions (COFI) Bill. With its sharp developmental thrust and strong accountability propellers, COFI provides a glimmer of hope for a fairer and more equitable financial services landscape.
The Bill sets out a streamlined path to transformation as well as greater regulatory cohesion and accountability. It brings better alignment between the BBEE Act and the Financial Sector Code while enhancing the powers of the Financial Sector Conduct Authority (FSCA) to overturn discriminatory decisions and seek court orders.
With a spanking new developmental deck that makes entry and participation easier, COFI could be an effective springboard for greater inclusion and participation. However, the history of failed financial legislation in South Africa serves as a stark reminder of how even the most solid policies can sink without rigorous implementation and oversight.
For now, racial gulfs in financial participation and financial prosperity continue to shipwreck financial parity and sully forecasts for a more inclusive and equitable society.
An oar of discrimination keeps marginalised South Africans economically stranded. Personal and business lending and investment remain unequal, with Black South Africans being less likely to be granted home loans or business financing than White South Africans. The lack of historical disadvantage and an empty pot of intergenerational wealth prejudices black South Africans in the banking and investment stakes.
Disparities in access to capital, credit, and favourable bank rates perpetuate discrimination in democratic South Africa. Often labelled as more risky investments, black South Africans are prejudiced by the sector's policies and practices.
The demon of de-banking continues to haunt politically exposed individuals. This is under the cloak of reputational management, and in the grim pall of poor transparency and impaired judicial oversight. The harmful practice of de-banking is a calculated financial attack on targeted individuals, in the ugly gambit of power and prejudice.
The closure of accounts is seldom based on fiscal responsibility; instead, it often serves as a political weapon to suppress dissent and challenge power and patronage. De-banking has severely affected several prominent political figures and opinion makers who have opposed South Africa's elite transition.
Black-owned businesses such as the Sekunjalo Group have become easy targets, while white-owned groups implicated in scandals, such as Steinhoff, have been treated with kid gloves.The veil of "reputational risk" must be lifted to show the ugly silk of conspiracy that lies beneath.
In the words of Dali Mpofu SC, "If banks can close your account without evidence, based on perception, then they are not just financial intermediaries—they are political actors."
COFI will need to create transparency and full disclosure on why certain bank accounts are closed, while others are left to thrive. These freedoms are present in many countries worldwide. In the United Kingdom, banks are now mandated to give 3 months' notice and provide reasons for debanking. This followed massive civil society outrage after UK politician Nigel Farage's bank accounts were abruptly closed.
In South Africa, the slate of prejudicial bank practices and the general lack of transparency and accountability has seen trust and credibility of the sector at an all-time low. Despite its potential, COFI must move beyond bureaucratic or technical compliance to become a genuinely transformative tool that fosters financial access, participation, and empowerment for marginalised individuals, organisations, and communities.
COFI needs to be more than a seductive, refashioned compliance mechanism. If it fails to deal with the thorny issues of systemic exclusion, discrimination and debanking, it will lose its legitimacy and effectiveness and find itself relegated to the large body of legislation that has failed to see the light of day.
Financial transformation has been undermined by discriminatory practices, insufficient regulatory oversight, and a lack of transparency and accountability. Successful implementation of COFI is dependent on vigilant monitoring and strong regulatory oversight. This is understood and addressed in the Bill.
Previous legislation has struggled due to poor execution and insufficient regulatory authority. Until the industry regulators have the necessary authority to revoke discriminatory and politically motivated decisions and actions, they will remain toothless.
A bow of regulation without the arrow of robust civil society support will fail to hit the transformation target. Without a supportive shield for those discriminated against, COFI will lack real potency. There is a real role to be played by civil society and financial activists.
Civil society must act as a watchdog for financial consumers. The true measure of success for COFI will be its ability to make a meaningful difference in the lives of ordinary South Africans, particularly those who were financially marginalised during apartheid.
This includes addressing the harmful effects of discriminatory financial practices that have led to the loss of assets and economic opportunities for these individuals. The Bill has yet to be enacted into law but is being prepared for Parliamentary review. It will herald in a new regulatory regime.
It is time for the financial services sector to show a genuine commitment to transformation and transparency. Without a watermark of ethical acuity and social responsibility, the financial services sector will remain a palace of elite interests. And South Africa will continue to be a rich man's world.

Institute of Race Relations slams unclear expropriation law
The Institute of Race Relations (IRR) calls on Public Works and Infrastructure Minister Dean Macpherson to disclose all state bodies empowered under the Expropriation Act. The Expropriation Act allows property to be seized below market value, raising concerns about property rights in South Africa. Makone Maja of the IRR says more than 400 state entities may already hold expropriation powers. The IRR has raised concerns over the lack of transparency about the number of government bodies authorised to carry out expropriations. Makone Maja, the IRR's strategic engagements manager, said the law is unpopular among South Africans and poses a significant threat to property rights. 'Our polling conducted in March and April shows that 68% of registered voters oppose the Expropriation Act,' said Maja. 'The act is so broadly worded that all forms of property – including savings and pensions – are now vulnerable.' According to the IRR, at least 426 public entities currently have the authority to expropriate property under the Act. However, the organisation believes the actual number may be closer to 1 000. 'If the number is unclear, how can citizens have confidence that these powers will not be abused?' In its Blueprint for Growth policy series, the institute emphasises the importance of secure property rights as a foundation for economic empowerment. Maja added that South Africa's history of corruption and abuse of power makes the lack of oversight especially troubling. While American cities like New York or the Bay Area still boast the most dollar millionaires in real numbers, a few destinations have emerged as new hubs for the wealthy. These cities have seen the biggest increase in dollar millionaires over the past decade. They're mostly fast-growing centres of technology and innovation. Meanwhile, a few also offer tax incentives to attract the wealthy. That's according to the World's Wealthiest Cities Report 2025, which is published by Henley & Partners, a firm that advises the wealthy on where to move to look after their assets. Between 2014 and 2024, Shenzhen saw a 142% increase in dollar millionaires. The Chinese city is a major technology hub, with companies like Huawei and Tencent based there. Once a rustic fishing village, Shenzhen is now the fastest-growing destination for dollar millionaires. The technology scene continues to attract entrepreneurs and financiers. Most South Africans may not hear much about Scottsdale, but tech entrepreneurs and those with six-figure account balances will know all about it. The American city's millionaire population grew by 125% over the past decade. Like Shenzhen, Scottsdale's attraction is its booming tech industry. It also offers a luxurious lifestyle, especially in golf estates, and favourable state tax conditions. It could be a surprise, but this Indian city is popular with the very wealthy. Bengaluru, also known as Bangalore, saw a 120% increase in dollar millionaires. That took place in just ten years, between 2014 and 2024. The city's flourishing tech industry, affordable living costs, and growing infrastructure have made it a hotspot for the wealthy. Over the past decade, West Palm Beach gained 112% more dollar millionaires. This American city offers the wealthy a laid-back lifestyle, thanks to its coastal location. Because the state of Florida has low taxes, businesspeople and rich professionals also flock to West Palm Beach. 108% more millionaires now live in Hangzhou, compared to ten years ago. That growth coincided with the rise of tech companies in the city, including Alibaba. Hangzhou is a historic city with pretty scenery, making it even more attractive to the affluent. Joshco bridges housing gap for missing middle residents
Construction is under way on what will become the largest phase of the Johannesburg Social Housing Company's (Joshco) Riverside View project in Diepsloot, which will add more than 700 new units to the growing social housing development. During an oversight visit, Nhlamulo Shikwambana, Joshco's acting COO, said 'the development has already completed three phases, with tenants living in over 300 units, and construction of phase 4 now under way'. 'Once complete, phase 4 will add over 700 more units. This is going to be our biggest build in the area. The plan is to reach over 1,000 units in Diepsloot' Shikwambana said the project is specifically aimed at South Africans in the 'missing middle', those who earn too much to qualify for RDP houses but too little to afford bonded homes. 'We are closing the gap for people who fall through the cracks. Most of our residents come from informal areas. We want them to feel safe and comfortable without being financially overstretched,' added Shikwambana. For many residents, the move from informal settlements to the structured, well-maintained apartments has been life changing. Marriam Tom, 50, sits in her bachelor unit with a sense of peace she says she has not known in years. 'I moved from the informal settlement and this place exceeded my expectations. I stay with two kids in a bachelor, and I have peace of mind because I know my kids are safe. I can leave them behind when going somewhere,' she said. Tom mentioned that 'the maintenance is also excellent'. 'My sink once had a blockage and after reporting, it was fixed within a few days.' Emmanuel Ramangwala, 32, who has lived with his brother in a two-bedroom unit for four years, described it as a major upgrade from his previous living conditions. 'This place gives off luxury vibes at an affordable cost. I'm paying R2,500 and we are more than happy. Transport is easily available outside the complex and Ubers can pick you up at the gate,' Ramangwala said. Kholwani Baloyi, the property supervisor, told TimesLIVE that the demand for the flats, which range from R1,200 for bachelor units to R2,500 for two-bedroom units, continues to grow. Each unit includes a modern kitchen, solar geyser, prepaid electricity, water meters and biometric access control. 'We cater for a range of residents and the demand is very high. Once we open applications, they fill up quickly', said Baloyi. Neo Matshitse, Joshco's acting general manager, said 'these units are meant to bring people out of informal settlements and into secure, affordable housing'. 'Safety features are central to the design. The flats come equipped with 24-hour CCTV surveillance, biometric access control and fenced-off play areas,' said Matshitse. Pfeno Ratovhowani, 28, who lives with her husband and daughter said: 'I am happy there is a playground around the block. I am at peace even when my daughter plays without supervision because there's CCTV everywhere. The place is also well maintained and cleaned throughout the day.' Shikwambana said beyond housing, the project is also helping combat unemployment in Diepsloot by creating job opportunities. Cleaners, security guards and gardeners are hired directly from the surrounding communities'.
