Myanmar national escapes gallows, gets 30 years for murder

PUTRAJAYA: A Myanmar national has escaped the gallows after the Court of Appeal substituted his death sentence with 30 years' imprisonment for murdering his employer, a local woman.
A panel of three judges, comprising Datuk Nazlan Mohd Ghazali, Datuk Azmi Ariffin, and Datuk Dr Choo Kah Sing, had, on April 17, dismissed Than Nwe Soe's appeal against conviction but allowed his appeal against the sentence.
In a written judgment dated June 6, Datuk Azmi Ariffin stated that after reviewing all the evidence, the court found the case suitable for the exercise of judicial discretion under the Abolition of Mandatory Death Penalty Act 2023 to substitute the death sentence with imprisonment.
The court also imposed 12 strokes of the cane on Than and ordered him to serve the prison sentence from the date of his arrest on April 13, 2018.
The Act, which came into force on July 4, 2023, gives the court discretionary power to choose between imposing the death penalty or imprisonment of between 30 to 40 years, along with at least 12 strokes of the cane if the death penalty was not imposed.
Justice Azmi said the conviction for murder was safe to be upheld as Than and an individual still at large were fully responsible for causing injuries and death to Goh Geok Leng.
He added that a colleague of the accused had been informed by Than that he had kept the deceased's body in a container, and based on that information, police found the victim's body where the accused resided.
Justice Azmi also said that there were traces of the accused's DNA and the deceased's DNA at the location where the body was found, which further strengthened the prosecution's case.
On Jan 30, 2023, the Johor Bahru High Court found Than guilty of murdering Goh, 43, and sentenced him to death. Than subsequently filed an appeal with the Court of Appeal.
He was accused of committing the offence with an individual still at large at the Yu-Win Motor Trading Sdn Bhd premises in Kg Sri Purnama, Johor, at about 2pm on April 13, 2018.

PETALING JAYA: Fifty-five cases of drug abuse involving electronic cigarettes or vapes were recorded in the first half of 2025 alone, said the Health Ministry. Citing police figures, it said a total of 64 investigation papers were opened in 2024 on the issue. 'Alarmingly, over 70% of these cases tested positive for banned substances such as amphetamines and synthetic cannabinoids,' it said in a statement. The ministry was responding to an Aug 4 report in theSun on sales through online platforms of vape liquids laced with a harmful synthetic substance known as 'Magic Mushroom'. 'The ministry takes seriously the media report published by theSun. These illegal products, reportedly available in the local market, have been linked to severe side effects such as hallucinations, loss of self-control and, in one shocking incident, a student jumping off a school building while under the influence.' The ministry reaffirmed its commitment to working closely with police to tighten surveillance and enforcement on electronic smoking products suspected of containing controlled or dangerous substances. All smoking products, including electronic cigarettes and vape devices, are regulated under the Control of Smoking Products for Public Health Act 2024 (Act 852) which came into force on Oct 1, 2024. Under Section 3 of the Act, all smoking products must be registered and have their contents declared to the ministry before they can be sold. Only products that meet health and safety requirements will be approved. The government is also stepping up safety standards for vape devices in collaboration with the Standards Department and the Standards and Industrial Research Institute of Malaysia. This includes ensuring that devices cannot be easily modified to include illicit or hazardous substances. The ministry has issued a stern warning to parents, educators and the public to remain vigilant, particularly against unregulated or illegal vape products sold online or directly to teenagers, stressing the need for early intervention. 'Immediate reporting of such products or related behaviour to the authorities can save lives. The ministry is fully committed to protecting the health and safety of Malaysians, especially the younger generation, from the threat of dangerous and unregulated smoking products.' On Aug 5, Home Minister Datuk Seri Saifuddin Nasution Ismail said the government is reviewing potential amendments to existing laws to combat the growing issue of online drug sales. theSun had reported that 'Magic Mushroom' vape liquid, laced with synthetic drugs, is being sold online for as little as RM1 per drop, making it easily accessible to youths and first-time users.

(DAP pic) PETALING JAYA : The Court of Appeal has ordered the Kuching High Court to release its grounds of judgment for the Sarawak government's defamation suit against DAP's Chong Chieng Jen, three years after ruling in the state administration's favour. Chong, the state opposition leader, said his legal team had written five times to the High Court to request for the grounds of judgment but to no avail. He said the appellate court was scheduled to hear his appeal against the High Court's decision today but could not proceed as there were no grounds of judgment. 'Finally, the Court of Appeal has ordered the High Court to provide the grounds of judgment within one month from today. It has postponed hearing of the appeal,' Chong said in a statement. The Sarawak DAP chief also said his lawyers would be writing to the chief judge of Sabah and Sarawak on the matter. The state government and Sarawak Financial Authority (SFA) had sued Chong in 2013 for claiming that RM11 billion in state funds had disappeared into a 'black hole'. The case only came up for trial in January 2021, with 26 days of proceedings before it concluded in July the same year. In August 2022, High Court judge Alexander Siew, then a judicial commissioner, ruled that Chong had defamed the plaintiffs and awarded RM150,000 in damages.

KUCHING: The Court of Appeal has ordered the trial judge in the defamation trial of Stampin MP and Sarawak DAP chairman Chong Chieng Jen to provide the written grounds of judgment within one month from today. This is to enable the hearing of Chong's appeal to be heard. The hearing of the appeal today had to be postponed as the written judgment was not available. "As directed by the Court of Appeal, my lawyers will also be writing to the Chief Judge of Sabah and Sarawak on this matter," Chong said. He hoped to receive the grounds of judgment soon for the appeal to proceed. Chong said the trial had concluded four years ago and "yet there is still no grounds of judgment from the trial judge". In 2012, Chong criticised the state's budget, pointing to what he described as a recurring line item titled "government's contribution towards government-approved agencies trust fund". He argued that this allocation acted as a "black hole" since it lacked transparency as substantial sums in billions of ringgit were transferred without disclosure of the actual recipients or their uses. In 2013, the then Sarawak government and State Financial Authority (SFA) filed a defamation lawsuit against him following his published claims, including in leaflets and news outlets, that RM11 billion in public funds had gone into this "black hole". The suit was filed in the Kuching High Court, and the trial started on Jan 7, 2021. On August 30, 2022, the judge ruled in favour of the state government, determining that Chong's "black hole" remark was defamatory, and that his defences — justification, fair comment, and qualified privilege — did not hold. The judge ordered Chong to pay RM150,000 in damages and RM50,000 in legal costs, and issued an injunction preventing him from repeating the statement. Chong said the trial judge then did not provide the grounds of judgment. "After almost three years from the decision of the High Court judge, or four years after the conclusion of the trial, the judge has not provided the grounds of his judgment. "Over the years, we have written five times to the High Court to request the grounds of judgment, but all to no avail," Chong said. He said because there were no grounds of judgment, his appeal, which was to have been heard today, had to be postponed. Chong filed the appeal on Sept 12, 2022, arguing that allowing the government to sue individuals for defamation was a dangerous erosion of freedom of speech and that the judgment posed a threat to democratic rights across the Commonwealth. The judge who presided over the trial was a judicial commissioner at the time.
