Lecturer ‘forced out' after false racism claim seeks £450K compensation

The tribunal heard how a fellow lecturer mocked her disabilities on several occasions by tapping her head to indicate her 'mental problems' and made derogatory remarks about her loss of memory.
This was reported to the college by students who had recorded a lesson for their note-taking.
An investigation was launched after one of them also complained the colleague said her coursework had been deleted because Dr Turton disliked her 'because of [her] family background and that all Gypsies should not be allowed to have an education'.
The judge ruled this was 'fabricated information' of 'false racist remarks' concerning the student's Traveller heritage.
After hearing about the rumours, Dr Turton posted on Facebook asking her followers if anyone had heard what was being said- which was later taken down at the college's request.
Smear campaign
She added: 'I needed to know if there were rumours about me being a racist, and there were. I was fighting a smear campaign against me. My first concern was for the student, and I asked for somebody else to cover her class.
'Then I thought, if they believe it, I could be sacked on the spot, lose my house and even get a criminal record.'
Dr Turton was signed off sick with 'stress-related illness', returning in March 2022 and working mostly from home at her request to avoid the lecturer and another colleague.
A confrontation took place at the Medway campus in April 2022 when she came across the two women in the staff room and they both shouted at her: 'Hello, Sharon.' Other members of staff described this as 'very confrontational' and 'excessive' behaviour.
Of the six complaints, including harassment related to disability, direct disability discrimination and failure to make reasonable adjustments for disabilities, three were 'well-founded' and three were dismissed.
In June 2022, Dr Turton and the two other lecturers were informed they were at risk of redundancy 'due to a reduction in student numbers'. While signed off work, she was invited to a redundancy selection interview but she accepted voluntary redundancy instead due to her health issues.
'Considerable evidence'
The report said she felt that she had no option but to take redundancy saying she believed if she stayed she would have died.
The tribunal found 'considerable evidence' that decision-makers considered Dr Turton to be difficult and internal HR emails suggest they may have seen redundancy as an 'opportunity' to dismiss her.
Speaking at her home in Ashford, she said: 'I loved the job and had planned to continue until I was 71. I was given the option to postpone the hearing because I had more evidence, but this has gone on too long and I needed to get it over [with].'
She said her aim was to make managers and HR teams aware of the problems facing disabled people in the workplace and to 'expose' the behaviour shown to her. 'It's no good knowing about the Equality Act if you don't know about hidden disabilities,' she added. 'People ask what proof you have, but a lot of it is verbal and you don't have any.
'Luckily, I have family in the legal profession who have helped me. But there are many in my situation who will not know how to get evidence together.'
'Extremely serious'
Simon Cook, the principal and chief executive of MidKent College, said the college takes the findings 'extremely seriously'.
He said: 'Throughout this time, the college has continued to learn and grow, strengthening its policies and practices to foster a more inclusive workplace.
'We are reviewing our internal processes to ensure that all concerns raised by staff are appropriately addressed and that our commitments to equality, diversity and inclusion are upheld in all aspects of college life.'
Dr Turton thanked her legal team for fighting her case through the tribunal and not accepting an out-of-court settlement.
The lecturer has three daughters and six grandchildren, and an 11-month-old Doberman puppy to keep her company.

Gary, from Renfrew, vanished on the Canary island on March 17. The family of Gary Shearer have slammed cruel trolls telling them "he's dead" as the Scot remains missing in Lanzarote for over two years. The avid Celtic supporter, from Renfrew, vanished on the Canary isle after arriving to celebrate St Patrick's Day in 2023. The then 53-year-old had been drinking at Bar 67 on the night of his disappearance, where he was highly intoxicated. ‌ He was seen on CCTV asking an unknown man for directions. Gary has not been seen or heard from since. ‌ His family have visited Tenerife on multiple occasions to conduct their own searches for Gary. And in March, after their most recent visit to the island, Spanish police confirmed they were reopening their case into his disappearance. But despite the development, cruel trolls have been targeting Gary's family online, telling them: "He's dead, why bother." Writing on a Facebook page dedicated to the search for Gary, a statement from his relatives reads: "We see the comments. Our family, our friends and those who love Gary deeply read them hoping for hope, for answers, not hurt. "Speculation and cruel remarks don't help us find him. They only deepen the pain we are already carrying. ‌ "To those who write horrible comments to us, all i can say is: I hope you never have to experience the hurt of a situation like this and if you ever did I only hope you would get answers and support. "Not comments telling you to give up as he's been missing for so long or telling you 'he's dead, why bother'. ‌ "If you share something, please let it come from a place of support. If you comment, please consider the impact of your words on a family in the middle of every family's worst nightmare. "We're still holding on to hope that we will get answers no matter how long we have to fight for them. "This message extends to any comment anyone makes in the future, in any situation. Just remember kindness goes way further than you think." ‌ Gary's family previously appealed to the unknown male in the CCTV to come forward. They do not believe him to have anything to do with his disappearance, but are keen to speak to him and hope he can help police. ‌ Gary's niece, Darcie Deeney previously said: "It would be great for us to speak to the individual as he could confirm for sure where Gary was trying to go and in which direction he went, which is key information for us as we or the police are still unsure of the exact direction he went." Couple targeted by rogue roofers in Milford Haven — rescued by local hero

A VULNERABLE couple in Milford Haven were left distraught and their home exposed to the elements after rogue roofers climbed onto their property under false pretences — and one reportedly grabbed the arm of 68-year-old Jane Scourfield, who suffers from spinal issues and relies on a walking stick. The incident happened on Saturday (May 31) at the home of Jane and Dean Scourfield, aged 68 and 58, who live on Pill Road in Milford Haven. Two men arrived at the property claiming they were there to provide a quote for roof repairs. Without permission, they climbed onto the roof and began removing tiles, leaving the property damaged and exposed to the weather. Witnesses said the men were seen in a silver van, and have also been spotted in a bronze or gold coloured SUV. When Jane challenged the pair, one of the men grabbed her by the arm. She later told police she felt frightened and intimidated. A neighbour who witnessed the incident has confirmed the contact. Jane, who has a serious spinal condition, relies on a stick to walk and was left shaken by the ordeal. Speaking to The Herald, she said: 'Following this I feel very vulnerable. They are targeting people who are older. They are looking at people who have disabled bars on their houses — we all have these hand rails on Pill Road. It's a vulnerability.' The man who grabbed her is described as around 5ft 10in, with very bright ginger hair, and believed to be in his late twenties. The second male was a teenager, possibly 18 or younger. Both fled the scene after causing the damage. The couple were left distressed — but less than 24 hours later, they were contacted by a genuine local roofer, Wayne Rogers of Rogers Roofing, who offered to carry out the repairs at cost, asking only for materials to be covered. He saw the appeal on Facebook and immediately stepped in to help. Jane and Dean's daughter, Ellen Tamilia, praised their kindness: 'After 24 hours of terrible stress, we have a hero on a white charger coming to our rescue. Thank you so much both for restoring our faith in humankind.' Wayne Rogers has confirmed that he will carry out the repairs to the couple's roof this week. Dyfed-Powys Police have been contacted for a statement.
