Ex-MMEA director jailed for accepting RM10,000 bribe

JOHOR BARU: A former Tanjung Sedili Malaysian Maritime Enforcement Agency (MMEA) director has been sentenced to 20 months' jail for accepting a RM10,000 bribe some five years ago.
Sessions Court judge Datuk Ahmad Kamal Arifin Ismail handed down the sentence, effective immediately, after finding that the prosecution had proven its case against Mohd Zulfadli Nayan, 44.
'After hearing and weighing all the evidence, the court finds that the accused has failed to raise reasonable doubt against the prosecution's case,' he said yesterday.
The case was prosecuted by Malaysian Anti-Corruption Commission deputy public prosecutor Zander Lim Wai Keong while lawyer Mohd Fazaly Ali Mohd Ghazali represented the accused.
Earlier during mitigation, Mohd Fazaly Ali asked the court to impose punishment in the form of fines.
He said if the court were to impose a jail sentence, it should be at the minimum, citing Mohd Zulfadli's health issues including gout, chronic migraine and gastric problems that require ongoing medication.
'My client currently works as an e-hailing driver and wireman, earning between RM2,000 and RM3,000 per month to support his family, which includes four children, aged between three and 11,' he said.
Meanwhile, Lim urged the court to impose a sentence that reflects the seriousness of the offence.
'As a senior federal officer, the accused was responsible for upholding the law and ensuring maritime safety.
'However, he instead accepted a bribe from a shipping agent, which is clearly against his duties and this has tarnished the image of MMEA,' he said.
Following the sentencing, Mohd Fazaly Ali applied for a stay but the court rejected the application.
On May 23, 2021, the accused contested the charge under Section 165 of the Penal Code, which carries a jail term of up to two years, a fine or both.
According to the charge sheet, he accepted the money from the shipping company owner at a restaurant in Jalan Yahya Awal on Oct 2, 2020.
He was accused of using his position to avoid taking action in the investigation of a vessel owned by the company, which was detained by Tanjung Sedili MMEA on Sept 17, 2020.

MERSING, June 3 — What was meant to be a joyful holiday back in their hometown ended in tragedy when two siblings drowned while swimming at the Pulau Mentigi beach here yesterday afternoon. Malaysian Maritime Enforcement Agency (MMEA) Mersing Zone director Maritime Commander Suhaizan Saadin said the deceased were Nur Awatif Udaima Mohd Hisam, 15, and her younger brother Ahmad Uwais Al Qarni, 13. He said the Malaysia Rescue Sub Centre (MRSC) Johor alerted them at 4.25pm to activate a search and rescue (SAR) operation, after which MMEA's patrol boat Perkasa 44 was deployed to the scene. 'According to the information received, the first victim, Nur Awatif Udaima, was found at the location where she drowned by the local community at 4.30pm. 'The Perkasa 44 boat and the islanders then expanded the search sector, and Ahmad Uwais Al Qarni was found through diving efforts by island residents at 6.30pm,' he said in a statement last night. Suhaizan said it is understood that the victims' family had returned to their village at Pulau Tinggi for the school holidays, and the family had gone to the beach, about 19 nautical miles from the Mersing coastline, for an outing. He added that the bodies were handed over to the Marine Police Force (PPM) and brought back to the Shahbandar Jetty. Meanwhile, Mersing District Police Chief Supt Abdul Razak Abdullah Sani said that the bodies of the siblings were sent to Mersing Hospital for post-mortem. — Bernama

TAWAU: Five foreigners who rammed a police roadblock while attempting to flee at the Megah Industrial Zone at 8pm were arrested after a 45km high-speed chase last Wednesday. District Police Chief ACP Jasmin Hussin said the suspects, aged between 29 and 43, included the male driver, two male passengers, and two female passengers. 'The vehicle was ordered to stop by a team from the Police Patrol Car Unit (MPV) and Motorcycle Patrol Unit (URB), who were conducting a roadblock operation. 'However, the driver defied police instructions and attempted to escape by crashing through the checkpoint, prompting our officers to pursue them,' he said. The chase continued through several main roads including Jalan Timur, Kem Pengakap Tiku, Jalan Bunga Raya, Jalan Chong Thien Vun, and Jalan Apas, before it was eventually stopped at Batu 12, Jalan Apas. Upon inspection, police found none of the occupants, including the driver, could produce any identification. The driver did not possess a valid driving licence or road tax. The case is being investigated under Section 26(2) of the Police Act 1967 for fleeing a police checkpoint and Section 186 of the Penal Code for obstructing a public servant in the discharge of their duties. Investigations are also being carried out under Section 6(1)(c) of the Immigration Act 1959/63 for unlawful entry and stay in the country without valid identification or travel documents. The driver is also being investigated under Section 26 and Section 23 of the Road Transport Act 1987 for driving without a valid licence and road tax. ACP Jasmin said none of the police personnel were injured and that the authorities view such incidents very seriously. 'We urge the public to fully cooperate with the police, especially during roadblocks,' he said. TANGKAK: A 58-year-old retiree lost about RM108,000 of her savings after receiving a call from scammers impersonating as officers from government agencies. Tangkak OCPD Supt Roslan Mohd Talib said the woman was contacted by individuals claiming to be from the Malaysian Communications and Multimedia Commission and the police. 'The suspects accused her of being involved in suspicious investment and loan activities, and she started to panic. 'The suspects manipulated the victim into believing she was being audited. Out of fear, she followed the instructions given, including transferring money into an account supposedly for audit purposes,' he said here yesterday. The victim ended up making 16 transactions from her account to two bank accounts, believed to be mule accounts. 'She only realised she had been cheated after suffering losses totalling RM108,520. She lodged a police report on Sunday,' said Supt Roslan. The case is being investigated under Section 420 of the Penal Code for cheating. Supt Roslan warned the public not to fall for phone scams, particularly those involving callers posing as enforcement officers or government servants. 'We advise the public to verify suspicious calls before taking any action. Be cautious and always get the latest updates on scams through official platforms like Facebook, Instagram and TikTok pages of the Commercial Crime Investigation Department,' he said. Supt Roslan urged anyone who believes they have been scammed to immediately contact the National Scam Response Centre (NSRC) at 997 for early intervention to block fund transfers.
