An apology by Qantas for sacking 1,820 ground crew rings 'wholly hollow' and it has failed to make changes that ensure such actions never happen again, a judge has been told.
In the Federal Court in Sydney on Tuesday, Justice Michael Lee continued hearing submissions on the penalty to be imposed on Qantas for the biggest case of illegal sackings in Australian history.
Last October, Justice Lee ordered Qantas to pay $120million to the ground staff as compensation for their economic loss, pain and suffering since their jobs were outsourced during the Covid-19 pandemic.
The Transport Workers Union is seeking that he impose the maximum penalty of $121million and order that the money be paid to the union.
Noel Hutley SC, for the union, told Justice Lee that he should reject Qantas' submission that after four-and-a-half years of litigation, it was now contrite.
'Your Honour will not brush aside, as Qantas urges in its submissions, its vehement and regular denials of wrongdoing (and) its rejection of Your Honour's findings, which persisted all the way to the High Court,' he said.
'These reveal an attitude of adamantine self-righteousness.'
Since the High Court ruled against Qantas' appeal no senior executive of the airline had publicly accepted it broke the law or Justice Lee's conclusions until Monday, Mr Hutley said.
'The contrition rings wholly hollow.'
There had been 'a profound failure' within Qantas 'to come to terms with what needs to occur to avoid these things happening again', he said.
The court should order that the penalty be paid to the TWU, which had taken on enormous risks and burdens to fight the sackings, Mr Hutley said.
'If the penalty is paid to my client, my client is an organisation charged with advancing the interests of its members... and the money would be applied to the proper purposes of the organisation.'
On Monday, Qantas chief people officer Catherine Walsh told Justice Lee that 'hopefully you'll see from the size of the compensation payment that, in fact, we are very sorry'.
'We do wish for the workforce that was impacted to be properly remediated and the compensation that has been agreed could go some way to deal with that,' she said.
Outside court, former Qantas worker Damien Pollard said union members were looking forward to the conclusion of the case 'to allow us to get on with our lives'.
'It's been a long fight, it's been very stressful for a lot of employees, so we are looking forward to the end,' he said.

How another Labor immigration blunder has allowed a vile child sex offender to remain in Australia

The Albanese government took too long to scrap the visa of a migrant who performed an indecent act in front of a child, so he can stay in Australia, a court has ruled. The Federal Court decision is the latest in a string of immigration policy blunders to weigh on the party since 2023 - causing ex-Immigration Minister Andrew Giles to be demoted - though it seems it didn't harm Labor's performance at the March election. Federal Court judge Christopher Horan found a decision to deport the man, known as XMBQ, was unlawful because there was an 'unreasonable' delay between the appeals tribunal deciding the man could stay and termination of his visa. The ruling, first reported by The Australian, could set a precedent requiring immigration ministers to make decisions within a particular timeframe. Giles - now replaced by Tony Burke - previously came under fire for being caught off guard by the High Court's ruling in November 2023 that indefinite immigration detention was illegal, resulting in the release of more than a hundred criminals. Later, he was criticised over his Ministerial guideline, known as Direction 99, that stated a migrant's family connections to Australia and how long they have lived here should be considered in potential deportation cases, despite a criminal's rap sheet. Giles moved to cancel dozens of visas after it emerged that violent offenders were using the measure to avoid deportation. In the latest case XMBQ, a Somali man, had convictions for kicking a police officer in the face and performing a sex act in front of a 29-year-old woman and a 13-year-old girl on public transport. Lawyers for XMBQ challenged whether the former Immigration Minister's intervention in his case was legal. Giles cancelled the Somali man's visa on June 8, 2024 after the Administrative Appeals Tribunal decided he should be allowed to stay in April 2021. Justice Horan said the delay between the appeal and Giles's decision was far too long, ruling in the favour of XMBQ. 'If the minister is to exercise the power to set aside the original decision and cancel the visa, the minister must do so within a reasonable time,' the judgment said. 'Otherwise, the connection with the original decision as the object of the power will be lost, and it can no longer be said that the minister is addressing or responding to the state of affairs produced by or resulting from the original decision.' Immigration law specialist Simon Jeans said that although Giles had the power to cancel this visa it 'was a risk' and a 'decision [made] in haste' as he was under pressure to save his job. He suggested it would have been less risky for the Immigration Department to cancel XMBQ's visa rather than the minister intervening. XMBQ was born in Somalia in the 1960s before fleeing to Lebanon in 1993. He arrived in Australia as a refugee in 2004. XMBQ was placed on the sex offenders register for 15 years after pleading guilty to the public exposure charges in June 2017. In December 2017, his visa was cancelled by a delegate of the immigration minister but this was later overturned in the Federal Court. Lawyers for the man claimed Giles's decision to cancel his visa had been impacted by XMBQ being charged with two counts of rape, although he was not convicted. Justice Horan rejected this claim. The Albanese government and Mr Giles suffered a similar blow in January this year when a Bhutan-born man who attacked his wife with a meat cleaver was allowed to remain in Australia by the Federal Court. It ruled Mr Giles had made multiple 'jurisdictional errors' by overturning an appeals decision that the man could remain in Australia, because he did not consider the effect of deportation on his children and his stateless person status.

Should young Australians be worried about Labor's superannuation tax changes?

As debate rages over the Labor government's tax changes for large superannuation accounts, some young workers have asked their financial advisers whether they will be caught by the reforms. Advisers have told Guardian Australia that some young workers have even questioned whether they should stop making additional contributions. Experts say it's unlikely that younger Australians will get caught by the changes, with older, high-income earners the most exposed to the reforms. Here's what young Australians need to know about the changes. Most workers are legally entitled to be paid a guaranteed 11.5% of their wages into their superannuation fund, or 12% from July this year. The government levies a tax of 15% on the earnings on super balances of workers yet to retire and of retirees with more than $2m. Labor has proposed to lift that 15% tax to 30%, but only for the earnings from the portion of the balances over $3m. Earnings on the first $3m in an account would still be taxed at 15%. The tax would be levied each year. You can read a broader breakdown here. Economists expect most young people currently working will not hit $3m balances, though higher-income earners will have a higher chance at getting there. By the 2050s, when millennials will be looking at retirement and gen Z and Alpha will dominate the workforce, one in 10 people will have $3m balances, Treasury and Grattan Institute modelling shows. That could rise to three or four in every 10 people in the 2060s according to Diana Mousina, an AMP economist. But she says it is unlikely that 'half of gen Z' will reach $3m in super balances, contrary to some media reporting of her analysis. Mousina's modelling shows a worker earning more than $90,000 a year who works for 40 years consecutively with a 3% pay rise every year would probably achieve a $3m balance. This means a worker in their 20s who reaches $90,000 or over soon, then maintains it for the rest of their working life, could one day be affected. Workers on lower incomes who made no extra contributions and took time off work, for example to have a child, would be unlikely to reach $3m, according to Harry Chemay, a superannuation and wealth management consultant. The Financial Services Council, meanwhile, expects about 500,000 people of 14.6 million currently employed would earn enough to see their top-range tax breaks reduced slightly under the new proposal. While the reform would increase tax rates on big balances, superannuation would still be an effective way for high-income earners to reduce the tax they pay. The average superannuation balance in mid-2022 was $164,000, so most Australians are nowhere near balances over $3m. Sign up for Guardian Australia's breaking news email The proposed 30% tax rate is still lower than the top income tax rate of 45%, meaning superannuation contributions would continue to offer a tax break for well-paid workers. Public debate over the tax illuminated how lightly superannuation is taxed, according to Jonathan Philpot, a wealth management partner at accounting firm HLB Mann Judd in Sydney. 'It actually highlights that super actually has much lower tax rates than virtually any other structure you can have in your retirement years,' he says. 'I wouldn't want people changing their super plans.' Experts believe it is likely the threshold for the new tax would be lifted above $3m at some point in the future, so some young people who hit the $3m figure may not end up paying extra. Mousina is among those who agree the $3m benchmark for the new extra rate will probably rise but she suggests the increase could be baked into the new laws for the tax, which need the Greens' support to pass. 'We should think about indexing it, rather than just having no legislation around when it's going to cap out,' she says. The lack of assurance on whether the tax threshold will be lifted above $3m has attracted some media outcry, despite expert consensus that the figure would have to rise. Debate has also focused on the proposal to tax a type of investment return called unrealised gains, which would see high earners pay tax on a rise in value of some assets on paper while leaving them unable to get that money back if the asset value falls in the future. Most super accounts would have limited exposure to unrealised gains, according to Chemay. Australians with self-managed super funds are more likely to struggle with this type of investment. However, self-managed super funds only make up about 1 million of the 20 million or so super savers – and just 15% of them are under the age of 45. For perspective, four million Australians have more than one super account. The government in 2018 estimated the resulting extra fees would leave the average worker about $50,000 worse off by the time they retired.
