ECI firm on Aadhaar, ration card exclusion ahead of Supreme Court hearing on Bihar voter revision

Aadhaar
and ration card before the Supreme Court for the
Bihar Special Intensive Revision
but is expected to tread cautiously on the issue and cite court pronouncements and government orders on the two not being proof of citizenship, ET has learnt.
The ECI is also expected to inform the SC that the period for enumeration in Bihar is not too short, as is being contended, and is in keeping with past intensive revision exercises, ET has gathered.The poll panel is expected to file an affidavit before the SC this week regarding the SIR in Bihar. The apex court will hear the matter on July 28.

EPIC, Aadhaar, Ration Card
On voter ID card or Electors Photo ID Card (EPIC), the poll panel's contention largely is that the EPIC number is preprinted on the new enumeration form and so is already the basis of the SIR. Therefore, enlisting the EPIC card as a separate document of proof would not serve the desired purpose.

Aadhaar has been a matter of raging debate, with the ECI's several efforts in the past on making the Aadhaar-EPIC linkage mandatory hitting legal roadblocks.
The current enumeration form in Bihar also allows users to voluntarily disclose the Aadhaar number, as does Form 6 for registration of new voters. At the same time, there are several court observations as well as central government orders, including by the Unique Identification Authority of India, which administers Aadhaar, that Aadhaar is not a proof of citizenship but of identity and address. The new cards also carry such a disclaimer printed on them, the poll panel is likely to point out. In the landmark Justice KS Puttaswamy Vs Union of India, 2018 case, the Supreme Court, while upholding the constitutional validity of Aadhaar, referred to Section 9 of the Aadhaar Act, 2016, which states, "The Aadhaar number or the authentication thereof shall not, by itself, confer any right of, or be proof of, citizenship or domicile in respect of an Aadhaar number holder."
In May 2025, the Delhi Police also said it would not accept Aadhaar or ration card as citizenship proofs, given misuse by illegal foreign immigrants. The ration card, similarly, is mainly considered a document to facilitate the public distribution system and not a citizenship proof. The March 20, 2015 gazette notification by the Ministry of Consumer Affairs, Food & Public Distribution said, "Ration card shall not be used as a document of identity or proof of residence".
Further, on May 14, 2016, the Ministry of External Affairs informed Parliament that it had decided "not to accept ration cards as a document for identity or proof of residence for the purpose of granting passports with effect from 01.04.2016".
SIR window 'too short'
The one-month window for house-to-house verification and enumeration form submission in Bihar SIR - June 25 to July 25 - has caused much concern. The ECI, however, is expected to contend that even in the past, including in the 2003 intensive revision in Bihar, the enumeration exercise was conducted over a period of 30-33 days, according to people in the know. Similarly, in the 2004 intensive revision across seven north-eastern states, house-to-house enumeration was done from August 2 till September 3. On the other hand, the time for "pre revision" activity is decidedly shorter in the ongoing SIR in Bihar compared to the one-month period in 2004.
The SIR instructions issued by the ECI on June 24 did not mention any pre-revision activity schedule. Officials told ET that this period could be compressed considerably now given the availability of superior technology.

New Delhi: Dharti Aaba Janbhagidari Abhiyan (DAJA), one of the largest tribal empowerment campaigns, has turned out to be a big success, with more than 1.10 lakh beneficiaries, particularly those from tribal communities, having registered themselves in a fortnight. A campaign was launched by the Gujarat government from June 30 to July 15, which saw more than 750 scheme-oriented camps organised in various districts. In just 15 days, more than 1.10 lakh tribal beneficiaries from 21 districts were provided the benefits of 22 scheme-oriented services at their doorsteps. More than 5 lakh tribal brothers and sisters participated in it. Briefing about the campaign's success, Tribal Development Minister Dr. Kuber Dindor said that this abhiyaan was initiated across the country, including Gujarat, to fulfil the resolve of 'Sabka Sath, Sabka Vikas and Sabki Bhagidari' for the development of tribals and also to extend the benefits of public welfare schemes to tribal families. Through Dharti Aba Jan Bhagidari Abhiyan in 21 districts of Gujarat, various government departments have provided Aadhar cards to 22,226 citizens of the tribal community, Ayushman Bharat cards to 22,287, benefits to 13,962 farmers under PM Kisan Samman Nidhi and ration cards to 11,313 citizens. He further informed that the benefits of Poshan Abhiyan was given to 9,648 people, caste certificate to 8,207 people, caste certificate cards to 8,230 tribal families, pension scheme to 3,724 people, PM Suraksha Bima Yojana to 2,765 people, PM Jeevan Jyoti Bima Yojana to 1,829 people, PM Jan Dhan Yojana to 1,352 people, PM Matru Vandana Yojana to 1,382 people. 'Under the scheme, 1,075 people benefit from PM Garib Kalyan Anna Yojana, 1,097 from PM Ujjwala Yojana, 798 from Kisan Credit Card, 652 from PM Vishwakarma, 255 from Standup India Yojana,' he said. Apart from this, 20,941 sickle cell tests and 4,054 TB cases were conducted in the tribal belt. Minister of State for Tribal Development Kunwarji Bhai Halpati supervised the program and encouraged the officers, employees and tribal beneficiaries involved in the campaign. The nationwide 'Dharti Aaba Janbhagidari Abhiyaan' was launched by the Ministry of Tribal Affairs on the occasion of the 150th birth anniversary of 'Lord Birsa Munda'. The campaign focuses on the emancipation and empowerment of the tribal community by bringing them into the mainstream. During the campaign, special camps are organised to provide them benefits of health cards, ration cards, caste certificates, Aadhaar cards, land verification cards, housing schemes, means of self-employment, electricity benefits, etc., at their doorsteps.

This brings the total number of missing or problematic entries in the electoral rolls to 52.30 lakh. On Tuesday, the ECI reported that out of the 7.90 crore registered electors as of June 24, enumeration forms have been collected from 7.16 crore, including 7.13 crore digitised forms. The poll body revealed that 52.30 lakh voters, accounting for 6.62% of the total registered voters, have not been found at their registered addresses. This list includes 18.66 lakh deceased voters, 26 lakh permanently shifted voters, and 7.50 lakh duplicate entries—voters enrolled at multiple places. The number of untraceable voters stands at 11,484. With these numbers, the ECI has covered 7.68 crore electors (97.30%) through enumeration forms, leaving just 21.35 lakh voters, accounting for 2.70% of the total. To be included in the draft electoral roll that will be published on August 1, voters must submit the enumeration forms by July 25. To ensure transparency, poll body officials have held meetings with representatives of all political parties and shared detailed lists of the 21.35 lakh pending forms and 52.30 lakh missing electors. 'The entire election machinery, including nearly 1 lakh BLOs, 4 lakh volunteers, and 1.5 lakh BLAs appointed by the District Presidents of all the 12 major political parties in Bihar are working together to locate those electors who have yet to submit their Enumeration Forms (EFs) or have not been found at their addresses," the ECI stated. On Tuesday, the ECI reiterated that a full one-month period—from August 1 to September 1—will be provided for public objections regarding any additions, deletions, or rectifications in the draft electoral rolls. The SIR drive is seen as a crucial step towards cleaning and strengthening Bihar's electoral rolls ahead of the upcoming elections. NEW DELHI: The Election Commission of India on Tuesday flagged major discrepancies in Bihar's electoral rolls revealed from its controversial Special Intensive Revision (SIR). The ongoing survey, EC said, revealed that 18 lakh deceased electors, 26 lakh electors who had been shifted to different constituencies, and 7 lakh electors who had been enrolled at two places. This came after the poll body justified its SIR exercise, which has been questioned by the Supreme Court and the opposition, saying that it added to the purity of the polls by "weeding out ineligible persons" from the electoral rolls. "The SIR exercise adds to the purity of elections by weeding out ineligible persons from the electoral roll. The entitlement to vote flows from Article 326 read with Sections 16 and 19 of the RP Act 1950 and Section 62 of the RP Act 1951 which contains certain qualifications with respect to citizenship, age, and ordinary residency. An ineligible person has no right to vote, and thus, cannot claim a violation of Articles 19 and 21 in this regard," EC said in an affidavit. "In addition to the legal concerns already articulated hereinabove, these documents are, in fact, already being considered by the Commission for the limited purpose of identity, during the SIR process," it added. In its affidavit responding to a plea against the June 24 order mandating a nationwide SIR of the electoral roll beginning with Bihar, the Election Commission said that, despite legal concerns, documents like Aadhaar, voter ID, and ration cards were already being used in a limited capacity for identity verification during the SIR-2025 exercise. "A bare perusal of the enumeration form issued under the SIR Order reveals that the Aadhaar number may be voluntarily furnished by a person furnishing the enumeration form. Such information is utilised for the purpose of identification, in accordance with Section 23(4) of the Representation of the People Act, 1950, and Section 9 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016," it said. The Supreme Court, on July 10, directed the EC to treat Aadhaar, voter ID, and ration cards as valid identity documents during its ongoing Special Intensive Revision (SIR) of electoral rolls in Bihar, which is scheduled to hold elections later this year. The matter is slated for the next hearing on July 28.
