Huge update on 5 year neighbour dispute over untrimmed hedge

News.com.au2 days ago
A UK couple has won a bitter neighbour dispute over an untrimmed hedge after five years of furious feuding.
Keith Smith, 71, and his wife Julie, 68, were locked in a feud with their neighbours in Prestonfield, Edinburgh, over the height of a hedge, The Sun reports.
The Smiths claimed the untrimmed cypress trees, belonging to David Hunter and Niena Hunter Mistry, made their lives a misery.
The row of trees sparked a five-year battle between the two couples.
The neighbour war grew so bitter that it involved the Edinburgh City Council, the Scottish Government and even the police.
The Smiths claim the trees cast a shadow across their garden, forcing the pensioners to live out their retirement in darkness.
Demanding the trees be chopped down, the Smiths turned to the local authority but were left frustrated when they were refused.
The couple paid a massive £350 ($A712) fee for a High Hedge Notice application which was denied after a visit from a city council officer.
Appealing the decision, the Smiths won and managed to successfully have the trees trimmed back to 8.5ft in 2023.
After the bush was trimmed the Smiths claim that gaps where the tree once stood were suddenly replaced by gardening tools, including ladders, pipes and concrete.
The pair went on to claim the trim was inadequate and called for the council to come back, which they did and agreed that the remaining trees should be further cut back.
Mr Hunter left a single tree standing untrimmed however which he claimed was not part of the 'boundary hedge' and therefore not subject to the High Hedge Notice.
The Smiths then insisted the remaining tree be cut back too with the dispute turning ugly again.
The couple, who have lived in their home for 44 years, continued their brutal battle to have the foliage lopped back.
Things got so bad that in June of last year the police were called to the quiet suburb where they issued 'two men' with 'recorded police warnings'.
Mr Smith previously claimed to Edinburgh Live his neighbours' behaviour had been 'atrocious' and branded the couple's actions 'absolutely appalling'.
The hedge owners refused to chop down their bush and claimed they felt harassed and intimidated by the Smiths.
The Smiths previously said: 'We, the Smiths, have suffered hugely financially, emotionally and physically by this process and sincerely hope, this will now lead to resolution.'
An appeal launched by Mr Hunter in a bid to save his tree was rejected and the last remaining part of the hedge will now have to be cut back to 8.5ft.
Mr Hunter insisted the remaining tree was not part of the hedge and begged that it be allowed to stand.
He said in a document seen by the Mail Online: 'The individual tree identified in the varied notice cannot reasonably be said to be part of the boundary hedge.
'It appears as a separate individual tree and has never been trimmed.
'We would be very grateful if you would take all our points and concerns into account and request that you quash the revised high hedge notice.'
Despite his pleas Mr Hunter was ordered to cut back the remaining piece of his hedge to 8.5ft in line with the previous High Hedge Notice.
The Smiths were delighted after a government official stated the tree did in fact cast a shadow over a 'significant' portion of their garden.
The official also stated the previous High Hedge Notice applied to the whole hedge, including the remaining tree.
Despite the best efforts of Mr Hunter the government official ruled the hedge damaged the Smith's enjoyment of their home.
The government ruled the remaining part of the hedge is now subject to the High Hedge Notice and should be trimmed to 8.5ft.

Trump says he turned down an offer to visit Jeffrey Epstein's private island

Donald Trump says he turned down an offer to travel to Jeffrey Epstein's private island, where the convicted sex offender was known to have abused underage girls, describing it as 'one of my very good moments.' The US President was forced to explain – on the world stage – the nature of his own relationship with the disgraced financier, who committed suicide in 2019 at the Metropolitan Correctional Centre in New York where he was awaiting trial on federal sex trafficking charges. Elements of the MAGA base have turned on Mr Trump after his administration refused to release the files from the investigation into Epstein and dismissed the existence of a 'client list', with the President describing the issue as a 'hoax'. Speaking alongside British Prime Minister Keir Starmer at his Turnberry resort on the west coast of Scotland, Mr Trump explained that he fell out with Epstein and banned him from his Mar-a-Lago resort because he 'stole people that worked for me'. He also made clear that he never travelled to Epstein's private island in the US Virgin Islands. 'I never went to the island,' Mr Trump said. 'And Bill Clinton went there supposedly 28 times. I never went to the island, but (former US Treasury secretary) Larry Summers I hear went there … and many other people that are very big people. Nobody ever talks about them. I never had the privilege of going to his island. And I did turn it down. 'In one of my very good moments, I turned it down. I didn't want to go to his island.' Mr Trump has become increasingly frustrated at the ongoing interest in his connections with Epstein and the interest in the 'Epstein files', declaring 'I haven't been overly interested in it. It's a hoax that's been built up way beyond proportion'. The President said that if there was anything that reflected negatively on him in the Epstein files, the previous administration would have released it all before the last election. 'Those files were run by the worst scum on Earth,' Mr Trump said. 'They were run by (former director of the Federal Bureau of Investigation James) Comey. They were run by (former US attorney-general Merrick) Garland. They were run by (former president Joe) Biden. And all of the people that actually ran the government including the autopen. 'Those files were run for four years by those people. If they had anything I assume they would have released it. If they had anything why didn't they use it when I was killing Joe (Biden)? … If there was anything in there, they would have used them for the election.' Mr Trump said people were not buying into the issue, arguing that his poll numbers had gone up since his handling of the Epstein matter had come into public focus. He also continued to reject the substance of a report carried in The Wall Street Journal that said he penned a bawdy letter for an album marking Epstein's 50th birthday and contributed what also appeared to be the hand-drawn outline of a naked woman. The letter was reported to have concluded: 'Happy Birthday – and may every day be another wonderful secret.' Mr Trump, who is suing The Wall Street Journal for $US10bn ($15.3bn) over the story, continued to defend himself and declared that 'I don't do drawings'. 'I'm not a drawing person … I don't do drawings of women, that I can tell you. They say there's a drawing of a woman and I don't do drawings of women,' he said. 'Also, Epstein was always a very controversial guy. I was at a very high position. Pretty much all my life in all fairness. I've been doing this for a long time. I had the top show on television. I have the number one bestsellers. I had everything, right? And I was a very successful business guy. Who would do a controversial drawing? 'Now, with that being said, they say there were many letters done by many people.' Asked why he banned Epstein from his Mar-a-Lago resort at Florida's Palm Beach, Mr Trump said it was 'such old history. Very easy to explain. But I don't want to waste your time by explaining it'. 'For years I wouldn't talk to Jeffrey Epstein. I wouldn't talk. Because he did something that was inappropriate,' Mr Trump said. 'He hired help. And I said to him, 'don't ever do that again'. He stole people that worked for me. I said, 'don't ever do that again'. He did it again. And I threw him out of the place, persona non grata … I'm glad I did, if you want to know the truth.' In Florida, lawyers for Mr Trump asked a federal judge to expedite a deposition of Rupert Murdoch in the President's $10bn defamation lawsuit against The Wall Street Journal, citing the media baron's advanced age. His legal team asked District Judge Darrin Gayles to compel an 'expedited deposition'. Judge Gayles gave lawyers for Mr Murdoch until August 4 to respond. Read related topics: Donald Trump

Passenger tackled after bomb threat on flight sparks terror

A man has sparked chaos after announcing he had 'a bomb' during a flight to Glasgow on Sunday morning. Disturbing footage shows the moment passengers on the 7am easyJet flight from London's Luton Airport tackled the man after he yelled out 'Death to America' and 'Death to Trump.' He then screamed 'Find the bomb on the plane' before chanting 'Allahu Akbar,' which translates to 'God is great' in Arabic. A male passenger can be seen pinning him to the ground as another passenger sat on him, telling him to sit down and not move. Other passengers can then be heard questioning if he was with someone else and whether he 'had a bomb' before demanding to 'check his pockets.' 'Have you been drinking, have you been doing drugs?,' questions one passenger. Further footage shows authorities boarding the aircraft upon its arrival and arresting the man while he is still on the floor. 'You're calm now, are you going to be calm when I stand you up?,' asks an officer. 'I'm calm now,' replies the man. As he's being escorted off the plane he can be heard questioning the whereabouts of his phone and wallet to which a passenger yells 'F**k off,' drawing laughs from the plane. A spokesperson for easyJet told local media: 'Flight EZY609 from Luton to Glasgow this morning was met by police on arrival in Glasgow, where they boarded the aircraft and removed a passenger due to their behaviour on board. 'easyJet's crew are trained to assess all situations and act quickly and appropriately to ensure that the safety on the flight and other customers are not compromised at any time. 'The safety of our customers and crew is always easyJet's highest priority,' they said. A Police Scotland spokesperson also added that the man 'remains in custody.' 'We received a report of a man causing a disturbance on a flight arriving in Glasgow around 8.20am on Sunday, 27 July. 'Officers boarded the plane on its arrival and a 41-year-old man was arrested and remains in custody. Enquiries are continuing. 'At this time we believe the incident was contained and that nobody else was involved. 'We are aware of videos circulating online and these are being assessed by counter terrorism officers,' they said. One woman took to Facebook to detail and the 'frightening and traumatic' experience. 'This is what happened this morning. I was sleepy and tired and ten minutes before landing a random man stood up and shouted, 'I have a bomb and I am going to kill everyone. F**k Donald Trump.' 'It was so frightening and traumatic.' The incident comes amid President Trump's five-day visit to Scotland that has seen mass protests break out across the country, with residents displaying signs such as: 'Scotland hates Trump' and 'Veto the Cheeto.'
