Sara Rivers' Claims Against Diddy Mostly Axed By Judge
According to reports, Diddy has won a legal victory against former Making The Band singer Sara Rivers, as a judge in New York has ruled that all of the charges save for one be dismissed. In the ruling issued Thursday (Aug. 14), U.S. District Court Judge Jed S. Rakoff ruled that 21 of the 22 charges within the lawsuit, which included racketeering, assault and battery, forced labor, and false imprisonment, be dismissed with prejudice. That means that she will be unable to file a new lawsuit containing those allegations against the Bad Boy Records founder.Judge Rakoff's ruling on the final charge read that 'the determination of whether to dismiss, with or without prejudice, Count 15 (the Gender-Motivated Violence Protection Act claim) … is hereby stayed pending' a ruling from an appellate court. It leaves the door open to Rivers to file another suit based on that claim.
Rivers was part of the group Da Band who were the focus of the second season of the MTV reality series, and she filed her lawsuit against Diddy, aka Sean Combs, in February. She alleged that she was sexually assaulted by Diddy after visiting his studio, Daddy's House, to record after being berated by the mogul who claimed that Rivers and her bandmates 'lacked drive and initiative' in making their album. She stated that after she left the booth, she ran into Diddy who backed her into a corner and 'ran his left hand across her breasts.'
Rivers also made more allegations while appearing in the Peacock documentary Diddy: The Making of a Bad Boy released in January, stating that he 'touched me in a place that he shouldn't have' and spoke about how enraged he would be toward her and other members of Da Band. 'When he got angry with one of my band members, he said, 'You make me so mad, I want to eat your flesh,'' she recalled.
Ariel Mitchell, Rivers' attorney, has stated that she and her client plan to appeal. Diddy is still incarcerated in the Metropolitan Detention Center in New York City, awaiting his sentencing after being convicted on two counts of engaging in transportation with the intent of prostitution in May. He and his legal team are still mounting an offense to release him from jail, including petitioning President Donald Trump for a federal pardon.

Sara Rivers of Making The Band 2 doubled down on her allegations against Sean 'Diddy' Combs after a judge dismissed 21 of 22 counts in the lawsuit. Rivers, who competed in the reality series as Sara Stokes, accused her former boss of sexual assault and misconduct. Earlier this month, Judge Jed Rakoff dismissed the legal complaints she filed against the Hip-Hop mogul without prejudice, meaning they cannot be refiled. Based on documents reviewed by VIBE, one count (Count Fifteen), which claimed he violated New York City's Gender Motivated Violence Protection Act, is still pending as Judge Rakoff awaits a Second Circuit ruling. The appellate court is left to decide whether the claim is time-barred under New York's Adult Survivors Act, which was enacted in May 2022 and amended state law to allow alleged victims of sexual offenses for which the statute of limitations had expired to file civil suits for one year, from November 24, 2022, to November 24, 2023. 'From the outset, we have said these claims were meritless, time-barred, and legally deficient,' explained a statement from Combs's counsel, Erica Wolff. 'The Court agreed, finding no legal basis to allow them to proceed. We are pleased the Court carefully analyzed and swiftly dismissed these baseless claims.' In response to the dismissal, the R&B singer took to social media and remained persistent that the 'truth' would be exposed. 'Today, the courts dismissed SOME of the claims, not all of them. The most serious and personal claim, sexual assault…it remains very much alive,' she relayed on social media. 'This fight was never about headlines. It's about truth, accountability, and justice for me, and for every other survivor that has been told that they should just give up. I will not be silenced and I will not be intimidated, and I will see this thing through.' She continued, 'The journey continues. Oh, and don't think. Because y'all got all that unlimited amount of baby oil that y'all gonna slide through this. Come on now. And for those that have been trying to defame me with those false stories, the truth will be coming. Best believe that.' Rivers initially filed the lawsuit against Combs in March 2025 and sought $60,000,000 in damages for 'extreme emotional distress impacting nearly every aspect of Plaintiff's life and personal relationships.' She is represented by attorney Ariel Mitchell, who is currently named as a defendant in Combs' $100 million defamation lawsuit. Combs was found guilty on two federal counts of transporting women across state lines, and not guilty of racketeering and sex trafficking charges in his eight-week criminal trial. The Bad Boy Records founder will be sentenced in a hearing set to be held on Oct. 3. He faces up to ten years in prison on each count. The Harlem native remains behind bars until sentencing despite his legal team's attempt to have him freed on bail, with Judge Arun Subramanian calling him a 'risk of flight or danger.' Tuesday, the rapper dropped his self-directed vibrant visual for 'Darling, I,' where he is romancing a series of women in various eras and period pieces in eye-catching scenes.
