Discrimination against SC community remains: Kerala High Court
Justice V G Arun said the Scheduled Castes in India have faced systemic ignominy like exclusion, untouchability and violence rooted in centuries-old caste hierarchy. They had restricted access to resources, land and quality education. Still, the discrimination continues. 'One cannot be oblivious of the fact that the tolerance level of persons from vulnerable sections will not be the same as that of those who have not suffered any such ignominy. To put it pithily, only the wearer knows where the shoe pinches,' the court said.
The HC made the remarks while dismissing a petition filed by C K Kusuman, former principal of DB College in Kottayam's Keezhoor, seeking to quash the case against him for allegedly making casteist remarks against an assistant professor in 2022.
Advocate Thomas J Anakkallunkal, the assistant professor's counsel, said the principal made the comments with the deliberate intention of insulting him by reason of his parentage. The remarks were made during the staff meeting of the college, the counsel said.
The court said the question of whether the insulting remark made inside the hall can be perceived as something done within public view can only be decided based on evidence, and the HC cannot conduct a mini-trial or microscopic scrutiny of documents.

Supreme Court quashes over 1000 assistant professor appointments in 2 Punjab universities
Representative image NEW DELHI: In a major setback to over 1,000 assistant professors appointed in 2021 in Panjab University and Guru Nanak Dev University, the Supreme Court on Monday quashed their recruitment, observing that it was done in violation of UGC regulations. Recruitment was done for 1,091 posts of assistant professor and 67 posts of librarian. The court said it is a settled principle that when the law prescribes a thing to be done in a particular manner, then it should be done in that manner alone. "In the present case, there are multiple deficiencies. Giving away of a rigorous criteria laid down in UGC regulations with a single, multiple-choice question based written test, and the complete elimination of the viva-voce, all establish the arbitrary nature of the exercise which cannot pass the test of reasonableness laid down under Article 14 of the Constitution," a bench of Justices Sudhanshu Dhulia and K Vinod Chandran said. "Hence, the single judge (of Punjab and Haryana HC) had rightly struck down the entire selection process, and the division bench of HC erred in interfering with that conclusion," it said. SC accepted the plea of senior advocates Raju Ramchandran and Nidhesh Gupta who alleged that the recruitment process was illegal and needed to be set aside. The court noted that the recruitment process was changed without any reason and it was decided by govt that selection would be done only on the basis of a written exam. "State is entitled to change its policy, yet a sudden change without valid reasons will always be seen with suspicion. Even in cases where there is no statutory prescription of any particular way of doing a thing, the executive must observe the long-standing practice," it said.

Cocaine Worth Over Rs 60 Crore Seized From Woman At Mumbai Airport, Arrested

The Directorate of Revenue Intelligence (DRI), Mumbai, has seized cocaine worth Rs 62.6 crore from an Indian woman at Mumbai International Airport. The development came after specific intelligence developed by officers of DRI Mumbai indicated that a female of Indian nationality, coming from Doha to Mumbai on Monday, would be smuggling narcotics into India. Acting on the said intelligence, DRI Mumbai officers intercepted the female passenger upon her arrival at Mumbai Airport on Monday, July 14. Following a thorough examination of her baggage, 6 oreo boxes and 3 chocolate boxes were recovered. On opening, all nine boxes were found to contain capsules filled with a white powdery substance purported to be Cocaine. A total of 300 such capsules were recovered. All capsules were individually tested using the field test kit, which showed a positive result for Cocaine. A total of 6261 grams of Cocaine with an estimated value of Rs 62.6 crore in illicit market was recovered and seized under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. Additionally, the passenger in question was arrested. Further investigation is in progress.
