
SC judge recuses from hearing transfer petition of Congress MLA Rajendra Bharti
New Delhi: A Supreme Court judge on Thursday recused himself from hearing a plea filed by Madhya Pradesh Congress MLA Rajendra Bharti seeking transfer of a criminal case outside the state.
After Justice Manmohan withdrew himself from hearing, the bench headed by Justice Prashant Kumar Mishra referred the transfer petition to the Chief Justice of India (CJI), who is the master of roster, for listing the matter before a different bench.
In the meantime, the bench ordered extension of the interim order passed in the petition seeking transfer of the alleged cheating case outside Madhya Pradesh.
In February this year, the apex court stayed the proceedings pending before the Additional Sessions Judge in Gwalior, observing that there was enough material placed on record before the trial court containing an allegation that the defence witnesses were sought to be intimidated.
"The trial court should have also taken appropriate action on the basis of the material. (W)hen we made repeated queries to the learned AAG (Additional Advocate General) and the learned counsel appearing for the respondent-State (of Madhya Pradesh), they have no answer to the question of what inquiry or investigation the state has made on the basis of the allegations made by the petitioner (Rajendra Bharti)," it said.
In its order, the Supreme Court had stressed the duty of the state machinery to ensure that a fair trial is conducted.
"We must record that it is the duty of the State to ensure that a fair trial is conducted. Fair trial means that full opportunity is granted in accordance with law to the accused to defend himself," it had said.
After the top court's observations, a committee of three police officials was constituted to inquire into the allegations of intimidation of defence witnesses. However, the Supreme Court, in an order passed in April this year, said that "proper investigation has not been made" into the allegations of putting pressure on the defence witnesses.
"We expected the officers appointed by the State to look into each and every allegation made by the petitioner as well as by the witnesses and record findings. It is the duty of the State to ensure that there is a fair trial, which is an essential part of the rights guaranteed under Article 21 of the Constitution of India."
Listing the matter for further hearing on May 16, the apex court told the state officials to carry out a "better investigation" and called for a report within one month.
In the 2023 Madhya Pradesh Assembly polls, Rajendra Bharti won the Datia seat of Gwalior-Chambal region, defeating senior BJP leader Narottam Mishra, who held the portfolio of Home Minister in the Shivraj Singh Chouhan government.

Ashu poser to Kejriwal: ‘Will you let Arora to continue in Rajya Sabha if he loses'
The Congress Thursday demanded that the ruling AAP in general, and its national convenor Arvind Kejriwal in particular, must tell people of Punjab what would be the party's stand on the Rajya Sabha seat from state in both scenarios — if Sanjeev Arora wins or loses the June 19 Ludhiana West Assembly bypoll. The AAP has fielded Arora, its Rajya Sabha member from Punjab, as the bypoll candidate amid allegations by the Opposition that the ruling party has nominated him to 'facilitate the backdoor entry of Kejriwal into the Upper House', a charge that AAP has denied several times in the past. Ashu, a former two-time MLA and the Congress candidate for teh bypoll, posed three questions to Kejriwal and AAP. Raising the first question, Ashu asked 'Kejriwal Sahab to please tell the people of Punjab in general and Ludhiana in particular whether you will allow Sanjeev Arora Ji to continue as the Rajya Sabha member after June 23 once the election results are declared and he loses'. 'Yes or no? You cannot escape the specific answer by claiming that 'he is going to win and he will obviously go to the Vidhan Sabha'… I am saying that because you are nobody to decide and I am nobody to decide at this stage, as it is the people of Ludhiana West who will decide. Ayodhya turning into liquor hub
New Delhi: In a scathing attack on the BJP-led Uttar Pradesh government, the Congress party on Thursday alleged that the religious sanctity of Ayodhya, the birthplace of Lord Ram, has been compromised by the unchecked proliferation of liquor shops. The party also accused the state administration of concealing the actual death toll during the Kumbh Mela stampede. Uttar Pradesh Congress president Ajay Rai said that Ayodhya, considered a holy city by millions of Hindus, has been turned into a liquor hub under the current government, despite its claims of being the custodian of Lord Ram's legacy. Rai disclosed that an 'umpteen number of liquor shops' have been opened throughout Ayodhya, and presented video evidence from a prominent YouTube news channel to back his claim. The report showed alcohol being sold in nearly every corner of the city. This, Rai pointed out, was in clear violation of the Municipal Corporation's ban on the sale and supply of liquor within a 13-kilometre radius of the city's central sacred zone. 'On one hand, the BJP claims to be the devotee of Lord Ram, and on the other, it is promoting liquor in his very birthplace. This is not only hypocrisy, but an outright insult to the faith of crores of Hindus,' Rai said. The Congress leader also leveled serious charges against the Yogi Adityanath-led government over the alleged underreporting of deaths that occurred during the Kumbh Mela stampede. Quoting a leading national media outlet, Rai stated that while 82 people had actually died, the government officially acknowledged only 37 fatalities. He further alleged that 19 individuals who perished during the Mahakumbh stampede were completely erased from the records. 'There is no mention of these victims, no compensation was offered to their families, and they have effectively been declared non-existent in the eyes of the government,' Rai said.
