GEORGE TOWN: The Ministry of Tourism, Arts and Culture (MOTAC) remains committed to strengthening the enforcement of the Tourism Industry Act 1992 (Act 482) to ensure that only licensed and legitimate operators run tour businesses, fostering a safer, more competitive, and responsible tourism industry environment.
In a statement issued today, it said unlicensed activities can undermine tourist confidence and expose consumers to various risks, including fraud, uncertain itinerary, lack of legal protection and unsafe tourism experiences.
'Therefore, MOTAC is committed to enhancing the enforcement of Act 482 to ensure that only legitimate tour operators are allowed to operate,' read the statement.
The statement was issued in response to a case involving a tour company that was fined RM30,000 by the Sessions Court here today for operating a tour business without a valid licence.
Judge Irwan Suainbon (rpt: Irwan Suainbon) meted out the fine, in default 12 months in jail, after a representative of the company, Renewage Group Sdn. Bhd, pleaded guilty to the charge, framed under Section 5(2) of the Tourism Industry Act 1992 (Act 482).
The ministry hoped that the case would serve as a reminder to all operators in the tourism industry to be more responsible and ethical in conducting business activities.
It said that the offence under Act 482 is a serious criminal offence and that it will take appropriate action against any person who violates the law.

Kedah MMEA detains two unlicensed, overloaded tourist boats off Langkawi

ALOR SETAR: The Kedah Malaysian Maritime Enforcement Agency (MMEA) detained two tourist boats in Langkawi waters on Tuesday (June 17) for carrying passengers beyond the permitted limit. Kedah and Perlis maritime director Maritime First Admiral Romli Mustafa said the fibreglass boats were intercepted during a routine patrol. He said the boats, which were spotted 0.1 nautical miles west of Tanjung Kemarong at noon, were found carrying a total of 21 foreign nationals. "Checks revealed that the vessels had violated the Merchant Shipping Ordinance 1952 for operating without valid licences and the Boat Rules 1953 for carrying passengers beyond the permitted limit while conducting tourism activities,' he said in a statement on Wednesday (June 18). The boats, their skippers and passengers were taken to the Kedah and Perlis Maritime jetty for further investigation under the Merchant Shipping Ordinance 1952. First Adm Romli said the total value of the seizure was estimated at RM236,000. He said the MMEA would not compromise with any violations and remained committed to curbing illegal activities in the country's waters. "If there is any emergency or criminal activity at sea, the public is urged to call 999 or contact the Kedah and Perlis State Maritime Operations Centre at 04-9662750," he said. – Bernama

High Court increases trailer driver's sentence to 8 years for crash that killed 4 in family

TAIPING: The High Court here today dismissed a trailer driver's appeal against his conviction for causing the deaths of four members of a family in a crash in Jalan Ipoh-Kuala Kangsar on Feb 13, 2020. Judge Noor Ruwena Md Nurdin increased the sentence for Y. Vethri Vel, 31, from four years in jail and a RM20,000 fine to eight years in jail and an RM80,000 fine. Vethri, a father of two, was convicted of four counts of reckless driving resulting in the deaths of Mohamad Faiz Bakhari, 28, Nik Iedayu Nik Hassan, 30, Nik Ifeka Nik Hassan, 27, and a baby boy, Mohamad Faqih Irsyad Mohamad Faiz. The case was prosecuted by deputy public prosecutor Mohd Waffy Ismail. Vethri was represented by lawyers Ranjit Singh Sandhu and Faazil Rahman. In her judgment, judge Ruwena said the charge was amended from driving under the influence of alcohol causing death under Section 44(1)(b) of the Road Transport Act 1987 to reckless driving causing death under Section 41(1) of the same act. The change was made after the court found reasonable doubt in the original charge, following technical arguments by the defence on the handling of the accused's blood samples for chemical analysis. The samples taken at a hospital were not preserved with stabilising agents. The court was told that medication administered to the accused could have affected the test results. "Due to these concerns, I amended the charge. Section 41(1) still involves dangerous driving that results in fatalities, which is in line with the nature of this case," Ruwena said. Vethri had appealed for a lighter sentence in the form of a good behaviour bond, citing injuries sustained in the accident and his family responsibilities. However, deputy public prosecutor Waffy objected, stressing that the accused's reckless driving had claimed four lives, including a police officer. The court sentenced Vethri to eight years in jail starting June 13 for each of the four charges, to run concurrently. If he failed to pay the RM80,000 fine, he faced an additional three months in jail for each charge. The court ruled that Vethri would be disqualified from holding a driving licence for three years from the date of conviction, with the details of the conviction to be recorded in his licence. Vethri was initially charged at the Sungai Siput magistrate's court on Feb 20, 2020 with four counts of reckless driving that caused the deaths of four family members.

IGP donates RM5,000 to police fund from court award against Papagomo

KUALA LUMPUR - Inspector-General of Police (IGP) Tan Sri Razarudin Husain has donated RM5,000 to the Tabung Amanah Warisan Polis (TAWP), using funds awarded by the court in his committal proceedings against blogger Wan Muhammad Azri Wan Deris, better known as Papagomo. In a statement, the Royal Malaysia Police (PDRM) said a mock cheque for the amount was presented to Bukit Aman management director Datuk Abdul Aziz Abdul Majid, who is also a permanent member of TAWP, in a brief ceremony at the IGP's office here today. This is Razarudin's second contribution to TAWP, following a RM10,000 donation made on Feb 24, bringing his total personal contribution to RM15,000. - Bernama file photo This is Razarudin's second contribution to TAWP, following a RM10,000 donation made on Feb 24, bringing his total personal contribution to RM15,000. "This contribution reflects my support for TAWP's welfare initiatives to assist police officers, personnel and their children in need. "Funds like this are essential in easing the financial burden of those in need, especially within the police community,' Razarudin said in the statement. On April 30, Papagomo issued an unconditional apology to Razarudin over defamatory statements made earlier this year. Judicial Commissioner Gan Techiong, in delivering the ruling, said the apology read out in court must also be published on YouTube, TikTok, X, and Telegram for at least seven days. The court also ordered Papagomo to pay RM5,000 in costs. In February, the court granted Razarudin permission to initiate committal proceedings against Papagomo for allegedly breaching a court injunction dated Jan 10. The injunction prohibited Papagomo or his representatives from publishing or disseminating any defamatory statements against Razarudin on social media, whether in his official capacity as IGP or his personal capacity. This included statements made in writing, orally, through videos, or via online platforms and messaging apps like WhatsApp and Telegram. The court was originally scheduled to hear contempt of court proceedings initiated by Razarudin against the blogger, but both parties were advised to seek a resolution, which led to Wan Muhammad Azri's apology and subsequent purging of the contempt. On Dec 26 last year, Razarudin filed a RM3 million lawsuit against Papagomo for alleged defamation, which also involved the name of Prime Minister Datuk Seri Anwar Ibrahim. - BERNAMA
