Kuldip Nayar's son recalls Emergency: ‘My father was held to scare the press… He paid the price for honesty'
Kuldip Nayar, who passed away in 2018, was one of the country's renowned journalists and human rights activists. He fought fiercely for press freedom during the Emergency imposed by then Prime Minister Indira Gandhi during 1975-77, when fundamental rights, including free speech, were subverted. Nayar was then an editor with The Indian Express. He was also jailed under the Maintenance of Internal Security Act (MISA) for leading a protest against the excesses of the administration.
In an interview with The Indian Express, Nayar's son Rajiv Nayar, a senior advocate, recalls the night of his father's arrest, shining light on his work. Excerpts:
What happened during the night of Kuldip Nayar's arrest? Were you aware that your father was going to be put behind bars?
My father knew from some sources that he was going to be arrested. He did not know the exact date, but he knew it was going to happen soon. We were at Malcha Marg (in Delhi) at that time and we saw some people in plain clothes deputed outside our house… We knew that it was imminent.
Could you talk about your father's work during the Emergency?
Even when he was released, he kept on writing articles criticising the government. He was arrested only to make an example to scare the press. Nobody else wrote like he was writing. He paid the price for being honest and independent.
Why do you think the government released Kuldip Nayar from jail before the high court's judgment came?
When the judgment was reserved and the government got an idea that the judgment is going against them, they tried to make it infructuous by saying that they had already released him. The judgment was still pronounced. That is why the judges paid the price – the junior judge was demoted and the senior judge was transferred.
What happened to all the high court judges who gave rulings against the government during the Emergency?
Most of them were transferred from one state to another.
How was your father's experience in jail?
He got used to it, I think. I used to take food for him whenever I used to meet him. He was not harassed at all, and had a very good time. In fact, he also made a lot of friends. But, of course, the comfort and luxury of home was missing. My grandfather (who was also arrested during the Emergency) and my father were in the jail at the same time for one night. He used to always recall that this surprised him a lot.
Your father broke the news in January 1977 that the government was going to call fresh elections…
I think he got the tip from a very senior Congress leader. I am not entirely sure, but this is what I was told.

Congress VP Hira Jotva arrested in Rs 7.3 crore MGNREGA scam in Bharuch; party says ‘vindictive move by BJP'
Over a month after an FIR was filed against two Gir-Somnath based agencies in Gujarat for an alleged MGNREGA scam of Rs 7.3 crore in the Bharuch district, district police arrested Gujarat Congress Vice President Hira Jotva in the case late on Thursday night. An alleged 'outsourced' technical staff person, Ramesh Tailor, was also arrested on Thursday. Bharuch district police said that evidence shows Jotva allegedly being a 'partner' in both firms and 'having directly used the siphoned funds' from the MGNREGA scheme. District Superintendent of Police Mayur Chavda told The Indian Express, 'We have evidence that shows that Jotva was a sleeping partner in both the agencies that were contracted in Bharuch and had a direct involvement in the irregularity being investigated. We are also probing the money trail as there is evidence that Jotva has used the money that was siphoned off… He was brought to Bharuch and arrested late on Thursday night.' The FIR was lodged by Assistant MGNREGA account officer P U Chaudhary of the Bharuch District Rural Development Authority against Veraval-based Jalaram Enterprises (owned by Piyush Nukani) and Murlidhar Enterprises (owned by Jodha Sabhad). It states, 'The irregularity relates to MGNREGA projects in Amod, Jambusar, and Hansot talukas of the district… As per the complaint received from an infrastructure company, the two agencies contracted to supply material had passed bills in violation of tender conditions…' The arrests of Jotva and Tailor are the first in the case as agency owners Nukani and Sabhad are 'on the run', police said. Chavda said that the two agencies, as per the procedure under MGNREGA, had appointed an outsourced technical assistant, Ramesh Tailor, who was stationed at the office of the Taluka Development Officer (TDO) of Hansot taluka. He allegedly 'created forged documents at Jotva's behest'. Chavda said, 'Tailor created the documents used for the misappropriation, including forged bills… The MGNREGA provisions mandatorily require the expenses to be in the ratio of 60:40 in favour of labour and raw material. However, in this case, the accused showed material cost up to 80% of the total amount, which disturbs the ratio and indicates a scam.' Chavda added that apart from inflated bills, the agencies allegedly also showed completed works which 'did not exist on the ground' to embezzle funds. Both Chavda and Tailor will be produced in court on Friday evening. Reacting to Jotva's arrest, Gujarat Pradesh Congress Committee Spokesperson Manish Doshi told The Indian Express that Jotva has been 'victimised' as he 'did not succumb to the pressure of quitting the Congress'. 'The story being weaved against Hirabhai Jotva that just because two agency owners are known to him, he is involved in the scam, exposes the two-faced approach of the BJP… The state government, on the one hand, has not even initiated an action against its Cabinet Minister Bachubhai Khabad even after both his sons have been arrested in multiple FIRs for alleged MGNREGA scams but here, Jotva is arrested just for being acquainted with the agencies,' he said. 'Jotva has documents to fight his case. He is a powerful leader of the Ahir community in his region… There has been a lot of pressure on him to quit the Congress since a while now but he has not succumbed. This arrest is a result of the vindictive nature of BJP, which wanted him to toe their line. We have full faith in the judiciary and we will fight a legal battle,' Doshi said. Senior BJP leaders refused to comment on the Congress' stand in the issue. Jotva, who is among the nine Vice Presidents of Gujarat Congress, had unsuccessfully contested the Lok Sabha polls in 2024 from Junagadh and also the Keshod Assembly constituency in the Gujarat Assembly polls of 2022. The FIR states that following a detailed investigation into the complaint, it was found that in works of building roads in villages of Jambusar, Amod and Hansot talukas, 'inflated bills of material supply' were allegedly presented while only a small amount of material was allegedly used. 'The bills put forth from Jambusar were for 128.40 cubic metres of material, while the actual material used was 28.32 cubic metres against the stipulated use of 103 cubic metres…' the FIR states. Similar discrepancies were also 'discovered' in a total of 56 villages. The Bharuch district FIR had come just a week after the Dahod district police had re-arrested two sons of Gujarat Minister of State for Panchayat and Agriculture Bachubhai Khabad in one common and two separate FIRs lodged in Dahod B-Division police station to probe another alleged MGNREGA-related scam of over Rs 100 crore.

'Led To End Of Op Sindoor': Cong Jabs Centre As Trump Teases Trade Deal, Takes Shot At Jaishankar
As US President Donald Trump declared an imminent 'very big deal' with India, Congress leader Jairam Ramesh criticised the Centre, linking it to the "abrupt" conclusion of Operation Sindoor. The US president has consistently stated that he utilised trade discussions with India and Pakistan to halt confrontations following the Pahalgam terror attack, although India has consistently rejected these assertions. Jairam Ramesh demanded transparency from the government and urged Jaishankar to focus on addressing what he called a collapse in Indian diplomacy, instead of speaking about the Emergency imposed 50 years ago. #donaldtrump #indiadeal #jairamramesh #operationsindoor #pahalgamattack #sjaishankar #indiandiplomacy #transparency #tradetalks #usindia #congress #modigovt #foreignpolicy #bilateralrelations #nationalsecurity #politicalcriticism #internationalaffairs #pakistan #emergency #indiapakistan #toi #toibharat Read More

Will pad up and bat if captain tells me to: Kanhaiya on contesting Bihar polls
Congress leader Kanhaiya Kumar on Friday (June 27, 2025) said that he will contest the upcoming Bihar Assembly polls if the party tells him to. Using a cricketing analogy, Mr. Kumar said that just like batting, bowling, and fielding are responsibilities that have to be fulfilled on the cricket field, fighting polls is also a responsibility in politics. "To fight polls, to make others fight polls and campaign, all are responsibilities that the party allots. If the party tells me to contest the polls, then I will fight the elections also. Earlier also, when I contested the polls, it was on the orders of the party," he told PTI in an interview when asked whether he will contest the upcoming Bihar Assembly polls slated later this year. "If the captain tells me to sit outside and deliver drinks for those at the crease, I will do that. And if the captain tells me to, I will also pad up and bat," Mr. Kumar said on the possibility of him contesting assembly polls. Also Read | Tejashwi Yadav urges Bihar's youth to give him 20 months to transform the State On the Congress projecting him as a prominent face in Bihar, Kumar said the party has given him a responsibility like it does to its lakhs of workers. It is like in a team where different people have a separate role, he added. "Earlier, (MS) Dhoni was the wicketkeeper. Now (Rishabh) Pant is there," he said, drawing a cricketing parallel. Asserting that the party functions with collective effort, Mr. Kumar said the decision to contest polls should also be collective. "I have been a strong votary of the principle that fighting an election is a collective decision. Like other responsibilities, fighting polls is also a responsibility. Like batting, bowling, and fielding are all responsibilities that have to be fulfilled, fighting polls is also a responsibility," he said. Mr. Kumar, a former president of the Jawaharlal Nehru University Students Union, had unsuccessfully contested the Lok Sabha polls twice. He first contested general elections on a CPI ticket from Bihar's Begusarai in 2019 and then as a Congress nominee from Northeast Delhi in 2024. On the Election Commission asking for place of birth certificates starting with Bihar polls, Mr. Kumar said the Congress has asked the poll panel to rectify the anomalies in the voters list. "Today, if you raise questions on EC, they are answered by the BJP. You raise questions on ED, and answers are given by the BJP. You raise questions on the CBI and the Income Tax Department, answers are given by the BJP. I would like to remind you that it was the BJP that raised the questions over EVMs... So, if you (the BJP) raises questions it is ok but if we do the same, it is wrong," he said. "First you were saying there is no error. Now you are starting this process from Bihar. So, you are accepting that there is a mistake. And if there is a mistake, your focus should be on rectifying that and not harassing people. A Process should not become a punishment and the issues that have been raised should be rectified honestly," Mr. Kumar said.
