Courtrooms have winners & losers, but mediation's healing: CJI

is grim and shallow, as it results in a winner and a loser - a process that fails to heal strained relationships between parties. He contrasted this with mediation, which, he said, seeks to provide a holistic solution that restores relationships.
Speaking at the first
National Mediation Conference
inaugurated by President Droupadi Murmu, CJI Khanna said '
community mediation
' provision in the Mediation Act, 2023 is salutary as this can be an effective tool to resolve disputes that are likely to affect peace, harmony and tranquility among residents or families in a specific area or locality. "This is an important step forward," he said.
Justice Khanna said unfortunately mediation, which is ingrained in our civilisational history, is not mainstreamed and not first choice of parties to a dispute even though modern mediation tools can provide solution to litigants, which is unavailable in courtrooms.
"In courtroom adjudication, one party is right, the other is wrong. In this way, courtroom litigation and adjudication are grim and shallow. At times, the root cause remains unaddressed, and the ailment and pain remain. The relationships are strained, if not broken. There is a winner, there is a loser," he said.
In contrast, mediation seeks to identify and remedy the root cause with a process that delves deeper into the issue, the cause of the misunderstanding between the parties and attempts a holistic solution without getting mired in legal procedures to restore the relationship between parties, he added.
"Because process is voluntary and participatory, solution reached is less traumatic, more humane and acceptable," Justice Khanna said, adding that between 2016 and early 2025, a staggering 7,57,173 cases were settled using mediation.
Comparing the courtroom justice delivery mechanism and the mediation crafted resolution, CJI Khanna said while a judge attempts to find whois at fault among the litigants who advance their case through argumentative lawyers, a mediator goes beyond the binaries and attempts to resolve misunderstandings, which is often the mother of most litigations.
He said, "Mediation offers space by undoing complexity. It does not involve legal and procedural complexities. It is flexible and personalised, not bound by rigid procedure. And above all, it is empathetic - aiming not to win over the other side, but to bring together."
Mediator's neutrality is crucial to achieve resolution of a dispute, said Justrice Khanna, adding that "a skilled mediator senses not only what is being said, but what lies beneath the words."

The Uttar Pradesh government is gearing up for a mega ceremony to distribute appointment letters to more than 60,000 new police recruits. Union home minister Amit Shah will be present at the programme to be held here this Sunday, officials said. The stage and massive pandals, being set up at the Defence Expo Ground in Vrindavan Yojana, are spread over an area of over 100 acres. Addressing a gathering on Sunday, chief minister Yogi Adityanath had confirmed that Shah would distribute the appointment letters in an event in Lucknow on June 15. The recruitments were part of the UP Police Constables' Direct Recruitment Examination-2023, which could be completed after hiccups of a question paper leak in February last year. It was one of the biggest recruitment drives taken up by the state government, with over 48 lakh aspirants, which included 15 lakh women, evincing interest in joining the department. The leak had given the opposition ammunition to target the Union and the state governments during the 2024 Lok Sabha polls. BJP-led NDA's share in the state came down to 33 from 62 in 2019. While the political nuances of Shah's visit cannot be overlooked as panchayat polls are due in the state early next year, the event is also significant as it shows the government's commitment to creating job opportunities for youngsters. A senior police official engaged in the arrangements confirmed that the efforts to make the event a mega affair were in full swing. 'Pandals being set up for the event are completely waterproof. Separate transformers are being installed at the site for an uninterrupted power supply. Sitting arrangements are being made for at least 70,000 people,' he said, adding the CM met the Union minister in Delhi on Monday to formally invite him to the event. He said director general of police (DGP) Rajeev Krishna had written to all district police chiefs and police commissioners to expedite the steps required from the home districts of police recruits to facilitate the process. The letter stated that the allocation of cadres to 48,196 male and 12,048 female candidates should be completed soon. In the letter, the DGP said while the male candidates were required to wear full-sleeve white shirts, khaki pants and black shoes to the programme, women candidates must wear plain salwar suits or sarees. He said the home districts should make arrangements for the candidates to travel to Lucknow and come back, and that the Lucknow police commissioner should make arrangements for their stay. The recruitment process was completed under Rajeev Krishna as the director of the UP Police Recruitment and Promotion Board (UPPRPB) after the removal of previous director Renuka Mishra following the question paper leak. The state government cancelled the written examination on February 24 and directed that it be reconducted within six months. The written examination was then successfully conducted in August 2024 under heightened security.

New Delhi [India], June 9 (ANI): A delegation of sacked teachers from West Bengal left for New Delhi on Monday to attend the upcoming Supreme Court hearing and to seek nationwide political support for their demands. The group also announced an assembly campaign on June 16, warning of a protest if their issues remained unresolved. From the Kolkata airport, Suman Biswas, one of the key faces of the protest, said, 'By going to Delhi, we will try to draw the attention of the Prime Minister, President and leaders of various national parties towards our problems.' The move came after West Bengal teaching and non-teaching staff lost jobs in the wake of the Supreme Court verdict on April 3 that upheld a prior Calcutta High Court decision to annul recruitments made through the 2016 recruitment conducted by the West Bengal School Service Commission (WBSSC) Around 25,753 teaching and non-teaching staff in West Bengal lost their jobs because of alleged corruption in various examinations conducted by the state's School Service Commission. The bench of Chief Justice of India Sanjiv Khanna and Justice Sanjay Kumar found that the West Bengal SSC's selection process was based on large-scale manipulations and fraud, and ordered the TMC government to initiate a fresh selection process. A section of the teachers are planning to file a review petition as well as to meet President Droupadi Murmu and Prime Minister, along with other MPs and leading politicians, with an appeal for reinstatement. They also called for a 'Bidhan Sabha Aviyan' on June 16, demanding the release of the mirror image of their Optical Mark Recognition (OMR) sheets to identify the genuine candidates. Earlier on April 3, the Supreme Court upheld the Calcutta High Court's decision to quash the recruitment of more than 25,000 teachers and non-teaching staff by the WBSSC in 2016 for the state-run and aided schools. The top court's verdict came on a petition filed by the West Bengal government that challenged an April 2022 order of the Calcutta High Court. (ANI)
