Auditor General appointment valid, no retirement needed says AGC

KUALA LUMPUR: The Attorney-General's Chambers (AGC) has clarified that the appointment of Datuk Seri Wan Suraya Wan Mohd Radzi as Auditor General complies with constitutional and legal provisions, dismissing claims that she should retire.
The AGC stated that under Article 105 of the Federal Constitution and subparagraph 1(1) of the First Schedule to the Audit Act 1957, the Auditor General can be appointed from the public service.
'Referring to Clause (2) of Article 105 of the Federal Constitution, when Datuk Seri Wan Suraya Wan Mohd Radzi was appointed as Auditor General with effect from June 13, 2023, she would no longer hold any other appointment in the Federal service,' the AGC said.
This means she is no longer part of the Administrative and Diplomatic Officers service scheme but remains a member of the general public service under Section 3 of Act 62.
'Since her appointment as Auditor General was in order, there is no need for her to be retired in the interest of the country,' the statement added.
Communications Minister Datuk Fahmi Fadzil also affirmed that Wan Suraya's appointment is valid and does not conflict with the Federal Constitution. - Bernama

MACHANG, July 26 (Bernama) -- Civil servants must set a good example by refraining from participating in any assemblies organised by the public, said Attorney-General Tan Sri Mohd Dusuki Mokhtar. He said if any civil servant is found to have joined such gatherings, their respective department heads may take further action as it would constitute a breach of established rules. 'Such assemblies actually violate the code of conduct and discipline for civil servants. 'As public servants, we are supposed to set a good example, and I believe civil servants' involvement in these events does not serve any benefit,' he said after launching the Attorney-General's Chambers' Santuni MADANI programme at Sekolah Kebangsaan (SK) Pulai Chondong here today. Mohd Dusuki also handed over cash aid of RM3,000 and a television set to the school, as well as batik cloths and water bottles to over 1,000 villagers and students. The AGC had issued a statement explaining that civil servants are subject to a specific directive from the Chief Secretary to the Government prohibiting their participation in any public assemblies. Meanwhile, on the sentence handed down to motoring influencer Tengku Nizaruddin Tengku Zainudin and his brother Tengku Abdul Aziz yesterday, Mohd Dusuki said the AGC would look into the matter. Protesters were seen clad in black Turun Anwar T-shirts. Some were even seen with Turun Anwar flags. Protesters from various gathering points such as the Sogo shopping mall, Masjid Jamek, Masjid Negara, and Pasar Seni are set to converge at Dataran Merdeka at 2pm. Chants of Turun Anwar! Bangkit Rakyat! were heard at several protest points. Unhappy with Prime Minister Datuk Seri Anwar Ibrahim administration's performance, the protesters are calling on the premier to step down. Children and differently able individuals were also seen at the gathering points. Politicians including former prime ministers Tun Dr Mahathir Mohamad and Tan Sri Muhyiddin Yassin are expected to deliver speeches at around 4.45pm. Other prominent figures expected to deliver speeches from 3pm onwards include PAS president Tan Sri Abdul Hadi Awang, Opposition leader Datuk Seri Hamzah Zainudin, Wanita Perikatan Nasional chief Datuk Mas Ermieyati Samsudin, Gerakan president Datuk Dominic Lau and Pejuang president Datuk Seri Mukhriz Mahathir.
