Alberta regulator orders ATCO to repay $71-million to customers
But this week's decision by the Alberta Utilities Commission is far from the end of the regulatory tussle. ATCO chief executive officer Nancy Southern told shareholders at the company's annual meeting recently that ATCO intends to challenge the commission over the issue in the Alberta Court of Appeal in October.
At the heart of the case is the commission's electricity rate-setting formula, called performance-based regulation.
The formula is designed to encourage efficiency by providing incentives for utility companies to reduce costs. The more efficiently a utility operates, the more money it saves. Those savings are then shared with customers through lower utility rates.
ATCO Electric fined $3-million for unearned rate increases, overstating its costs
ATCO delivered $500-million in distribution-cost savings, which is being passed on to customers. But the commission found that those savings could not be clearly attributed to specific utility projects, programs or initiatives, as required by the commission's rules.
Instead, it said that much of ATCO's savings were the result of operational changes, such as its decision not to pursue certain capital projects.
The commission's judgement has come in two phases. The first, released last May, ruled that ATCO's utility rates in 2021 or 2022 'were not just and reasonable.' ATCO was granted a court appeal on that decision.
The $71-million refund announced this week is the second phase of the commission's process. It separated the refund into $35-million for ATCO Electric customers, and $36-million for customers of ATCO Gas.
That equates to roughly $14 per month for ATCO Electric customers for a six-month period, and $3.83 per month for ATCO Gas customers.
Paul Barry, the executive director of the Industrial Power Consumers Association of Alberta, said Thursday his group was hoping for closer to $100-million for just the ATCO Electric side of the decision.
Still, he's pleased some cash will be returned to customers.
'We view it as a positive, and it is setting a precedent that's a clear example of the commission seeking to hold utilities accountable,' Mr. Barry said.
At ATCO's general meeting, Ms. Southern applauded the commission for implementing performance-based regulation. But, she told shareholders, ATCO and the commission have a 'major difference of opinion' in the way that the rules are applied.
'We believe we were operating within the regulatory framework,' she said.
Jason Sharpe, ATCO's chief operating officer, said that ATCO had in fact built more efficient operations and lowered its rates.
He said ATCO believes the commission is applying rules of performance-based regulation retroactively, hence the court challenge.
The refund is to be delivered to customers over six months, beginning in September, the commission ruled. That's particularly prickly timing for the company, Mr. Sharpe said, given it overlaps with the court challenge.
Mr. Sharpe said multiple requests to defer the refund decision until after the case goes through the Court of Appeal were denied by the commission.
'In our opinion, this is a premature refund until it's gone through the full appeal process,' he said, adding that it could create confusion for customers if the court finds in ATCO's favour.
The commission would not comment on Wednesday's decision, but this isn't the first time it has ruled against ATCO.
In 2022, ATCO was penalized $31-million after it deliberately overpaid a First Nation group for work on a new transmission line in 2018, and then failed to disclose the reasons when it applied to be reimbursed by ratepayers for the extra cost.
Mr. Sharpe pointed said the latest decision 'very different,' in that it is a refund, not a penalty, and boils down to different views on how rules are applied.

First Nations advocates disappointed as UN working group on enforced disappearances postpones visit
A United Nations body that investigates cases of enforced disappearance is postponing a visit to Canada due to a lack of money, though First Nations advocates hope the group will soon visit to probe the deaths of children at residential schools. "The postponement of the visit is not only a disappointment, but a continued delay in addressing the real systemic issues," said Linda Debassige, grand council chief of the Anishinabek Nation. Debassige advocates for 39 First Nations in Ontario and wrote the UN Working Group on Enforced or Involuntary Disappearances in August 2024, inviting it to visit Canada and shine an international spotlight on this issue. "The disappearances of these children constitute an ongoing human rights issue, impacting the families and communities," her letter said. However, unbeknownst to Debassige, the working group had already asked to visit Canada — the request went out in February 2024 — and Ottawa accepted on Oct. 24, 2024, the UN's website says. It lists the visit period as between June 2025 and June 2026. That would "mean a lot" to many, Debassige added. "It's not just about me; it's about the survivors and their families," Debassige said. "It's only been in recent recent years that truth has started to come to light." However, the group's chairperson told CBC Indigenous the visit is on hold because the UN had to cut the number of country visits it can do. "The visit is not likely to take place anytime soon, mostly due to the overall UN liquidity crisis," wrote Gabriella Citroni, a professor of international human rights law at the University of Milano-Bicocca in Italy, in an email. The UN outlined its " deepening financial crisis" in May 2025, citing among other things a shortfall of $2.4 billion in unpaid dues from member states. The main culprit is the United States, which owes about $1.5 billion and is withholding money as it cuts spending. Steve Lands, a co-ordinator with the Wiikwogaming Tiinahtiisiiwin Project, started by Grassy Narrows First Nation to investigate the former McIntosh Indian Residential School in northwestern Ontario, said it would be important for the UN group to visit sites like that for a firsthand account. "It was quite exciting for us that the UN would be coming to visit because the UN has a lot of clout," said Lands, a McIntosh survivor himself. "I believe the whole team would be agreeable on the UN to come and visit McIntosh." Last year the project located 114 unmarked burial features on the property, of which 106 were in the historical cemetery. They know of 166 people buried in that cemetery, so they are still trying to find everyone, said project technical lead Aaron Mior. "I think it's good to have an independent body come in and give their opinions and insight into what they've seen, compared to other atrocities or other similar examples across the world," he said. Kimberly Murray, the former federal special interlocutor for missing children and unmarked graves at residential schools, rendered her final report in October 2024 — just days after Canada agreed to the UN working group's request. Yet Murray said federal officials never told her about this potential visit, even though she argued at length these children were disappeared by the state and victims of a crime against humanity. "They never mentioned anything about it at the closing when the minister of justice spoke," said Murray, a law school professor at Queen's University in Kingston, Ont. She also met with ministers a month after her final report, yet there too no one mentioned the visit, she said. Murray suspects she was kept in the dark because Canada wants to minimize publicity. "I think that they want to keep it quiet, don't want the public and Indigenous communities to know that the working group has an interest in coming to Canada to investigate whether there is enforced disappearances," she said. In a statement, Global Affairs Canada said it has had a standing invitation for these UN special procedures in place since 1999. "Canada welcomes opportunities for dialogue to help us better implement our human rights obligations," wrote spokeswoman Dina Destin. Citroni, the chairperson, said Canada will be notified of subjects to be covered and places to be visited when the planning reaches a more concrete stage, which can't happen right now. Still, she added, it would fair to consider that, were the working group to visit, missing children linked to residential schools would be of interest, citing interest in related issues from UN entities in the past. She provided as an example an allegation letter sent to Canada in 2021 expressing concerns with the lack of progress implementing the final report of the National Inquiry into Missing and Murdered Indigenous Women and Girls.

More than 4,100 teaching positions to be filled as Quebec prepares for back-to-school
With two weeks to go before the start of the school year, more than 4,100 teaching positions remain unfilled in Quebec schools, although approximately 96 per cent of all positions have been filled. According to official figures from the Ministry of Education on Monday, 4,115 positions were still vacant, representing 4.4 per cent of the 92,820 teaching positions in the school system. The current situation is an improvement over the last two years, Education Minister Bernard Drainville told reporters at the National Assembly on Thursday. 'Two years ago, there were 8,500 positions to be filled,' he said. 'Last year, there were 6,000. Now, there are 4,000. Two years ago, we were at 90 per cent, 94 per cent [last year] and today, we are at 96 per cent of positions filled.' According to Drainville, this progress reflects the government's achievement with the unions in ensuring that most teachers are assigned by Aug. 8 of each year. 'The goal ... was precisely to improve the situation year after year, to start recruiting earlier and then assign teachers to their classes, and it's working,' said the minister, while acknowledging that the situation remains imperfect. The figures for Monday were published on the ministry's website on Thursday, shortly after the minister's press conference. He also indicated that, among the teachers hired, 10 per cent did not have a teaching certificate, but that at least half of them had a Bachelor's degree in one of the subjects taught at the school, such as French, English, history, or chemistry. He did not specify the situation for the other half of those without a teaching certificate. 'What we want is to help them obtain their teaching certificate. That's why we asked universities to create short, 30-credit training programs to enable teachers to obtain their teaching certification,' Drainville said. With regard to support staff, such as special education technicians and professionals such as speech therapists and remedial teachers, the number of vacancies remains unknown at this time. Drainville assured that recruitment is continuing and that the figures will be released at the end of August. The minister also expects a larger number of students to enroll in September, pointing in particular to the increase in asylum applications at the Saint-Bernard-de-Lacolle border crossing. Most U.S. stocks fall after a disappointing inflation update, but Big Tech keeps Wall Street steady

(AP Photo/Richard Drew) NEW YORK — Most stocks fell on Wall Street Thursday after a disappointing report said inflation was worse last month at the U.S. wholesale level than economists expected. But gains for Amazon and some other influential Big Tech companies helped mask the losses. Seven out of every 10 stocks within the S&P 500 fell, though the index edged up by less than 0.1 per cent to set another all-time high. The Dow Jones Industrial Average dipped 11 points, or less than 0.1 per cent, and the Nasdaq composite dipped by less than 0.1 per cent from its record set the day before. The inflation report said that prices jumped 3.3 per cent last month at the U.S. wholesale level from a year earlier. That was well above the 2.5 per cent rate that economists had forecast, and it could hint at higher inflation ahead for U.S. shoppers as it makes its way through the system. The data forced traders to second guess their widespread consensus that the Federal Reserve will cut interest rates at its next meeting in September. Lower rates can boost investment prices and the economy by making it cheaper for U.S. households and businesses to borrow to buy houses, cars or equipment, but they also risk worsening inflation. 'This doesn't slam the door on a September rate cut,' but it may raise some doubt, according to Chris Larkin, managing director, trading and investing, at E-Trade from Morgan Stanley. Traders now see a 7.4 per cent chance that the Fed may hold rates steady in September, according to data from CME Group. A day earlier, they were betting on a 100 per cent certainty that the Fed would cut its main rate for the first time this year. Higher interest rates drag on all kinds of companies by keeping the cost to borrow high. They can hurt smaller companies in particular because they often need to borrow to grow. The Russell 2000 index of smaller U.S. stocks tumbled a market-leading 1.2 per cent. Thursday's disappointing data followed an encouraging update earlier in the week on prices at the consumer level. A separate report on Thursday, meanwhile, said fewer U.S. workers applied for unemployment benefits last week. That's a good sign for workers, indicating that layoffs remain relatively low at a time when job openings have become more difficult to find. But a solid job market could also give the Fed less reason to cut interest rates in the short term. The data helped send Treasury yields higher in the bond market. The yield on the 10-year Treasury climbed to 4.28 per cent from 4.20 per cent just before the data reports' release and from 4.24 per cent late Wednesday. On Wall Street, Tapestry tumbled after the company behind the Coach and Kate Spade New York brands showed it's feeling the pressure of tariffs. It detailed how much profit it could lose in its upcoming fiscal year because of tariffs and duties, and its forecast for profit fell short of analysts' expectations even though its forecast for revenue came in above. Its stock fell 15.7 per cent, despite it also reporting a stronger profit for the latest quarter than analysts expected. Deere fell 6.8 per cent even though the machinery maker likewise delivered a better profit than expected. There, too, the focus was on where profits are heading. It cut the top end of its forecasted range for profit this fiscal year and said its customers 'remain cautious amid ongoing uncertainty.' On the winning side of Wall Street was Fossil Group, which jumped 29.8 per cent after the seller of watches and other accessories reported better profit than expected. It also announced a plan to strengthen its finances, while trimming its forecast for how much it expects worldwide net sales to fall this year. Big Tech stocks also helped mask Wall Street's losses. Amazon rose 2.9 per cent to add to its gains from the prior day when it announced same-day delivery of fresh groceries in more than 1,000 cities and towns. Because Amazon is so huge, with a market value of US$2.45 trillion, the movements for its stock carry much more weight on the S&P 500 than the typical company's. All told, the S&P 500 rose 1.96 to 6,468.54 points. The Dow Jones Industrial Average edged down 11.01 to 44,911.26, and the Nasdaq composite dipped 2.47 to 21.710.67.
