‘Not tenable': ECI sources on Congress seeking digital copy of Maharashtra voters' list

The Hindu8 hours ago

A day after the Congress urged the Election Commission of India (ECI) to provide machine-readable digital copy of the Maharashtra voters' list, ECI sources on Thursday (June 26, 2025) said the demand is "not tenable" under the prevailing legal framework, asserting that a similar plea of the party was junked by the Supreme Court in 2019.
The ECI sources said while Congress leader Rahul Gandhi has been demanding for machine-readable, digital copy of the electoral roll for the last seven months, such demand by the Congress is "not new".
'Rather, it forms part of a strategy by the political party for well over eight years, a fact that appears to have been selectively obscured in the present representation,' an ECI source pointed out.
The ECI sources said the demand reiterated by Mr. Gandhi, albeit consistent with the position historically maintained by the Congress, is "not tenable within the contours of the prevailing legal framework".
They pointed out that the issue was already agitated by the Congress before the Supreme Court in a writ petition in 2018 filed by Kamal Nath, the then president of the Madhya Pradesh Congress Committee.
It appears that Mr. Gandhi, the Leader of Opposition in the Lok Sabha, may not have been appropriately apprised of the finality with which the matter stands concluded in judicial record, they said.
Referring to the Supreme Court's verdict in Kamal Nath vs Election Commission of India, (2019), the sources said that top court had observed that it found force in the submission of ECI.
Clause 11.2.2.2 of the Election Manual uses the expression "text mode". The draft electoral roll in text mode has been supplied to the petitioner, the apex court had said.
'The clause nowhere says that the draft electoral roll has to be put up on the Chief Electoral Officer's website in a 'searchable PDF'. Therefore, the petitioner cannot claim, as a right, that the draft electoral roll should be placed on the website in a 'searchable mode'. It has only to be in 'text mode' and it is so provided,' the apex court had observed.
The Congress on Wednesday (June 25, 2025) urged the ECI to provide machine-readable digital copy of the Maharashtra voters' list along with video footage of polling day of the state and Haryana within a week.
The Congress and Mr. Gandhi have consistently accused the poll authority of fudging voter data to help the BJP.
Mr. Gandhi has alleged that the Maharashtra Assembly polls held last year were rigged.
The poll authority has denied the allegations, saying elections are strictly held under electoral laws passed by Parliament.

‘Anti-constitutional': Cong slams RSS over call to review terms ‘Socialist', ‘Secular' in Constitution's Preamble

'The thinking of the RSS-BJP is anti-constitutional. Now, RSS general secretary Dattatreya Hosabale has demanded a change in the preamble of the Constitution,' the Congress said in a post on X. In a post in Hindi on X, the Congress said it will never allow the BJP-RSS 'conspiracy' to succeed and will oppose any such move. New Delhi, Jun 26 (PTI) The Congress on Thursday accused the RSS and the BJP of being 'anti-constitutional' after Rashtriya Swayamsevak Sangh General Secretary Dattatreya Hosabale called for reviewing the words 'socialist' and 'secular' in the Preamble of the Constitution. The party claimed that Hosabale wants the words 'socialist' and 'secular' to be removed from the preamble. 'This is a conspiracy to destroy Baba Saheb's Constitution, which the RSS-BJP has been hatching for long,' the Congress said. The opposition party claimed that when the Constitution was implemented, the RSS opposed it and burnt its copies. 'In the Lok Sabha elections, BJP leaders were openly saying that they needed more than 400 seats in Parliament to change the Constitution, but the people taught them a lesson. 'Now, once again, they are engaged in their conspiracies, but Congress will not let their intentions succeed at any cost. Hail Constitution,' the Congress said. The RSS, the ideological mentor of the ruling BJP, on Thursday called for reviewing the words 'socialist' and 'secular' in the Preamble of the Constitution, saying they were added during the Emergency and were never part of the Constitution drafted by B R Ambedkar. Addressing an event here organised on the Emergency, Hosabale said, 'The preamble of the Constitution, Baba Saheb Ambedkar never had these words. During the Emergency, when fundamental rights were suspended, Parliament did not work, the judiciary became lame, then these words were added.' He said discussions were held on this issue later, but no effort was made to remove them from the preamble. 'So, whether they should remain in the preamble should be considered,' he added. RSS's Hosabale calls for ‘review of secularism, socialism' inserted into Preamble during Emergency

This year marks 50 years since then Prime Minister Indira Gandhi declared a nationwide Emergency on 25 June, 1975, citing internal disturbances. The Emergency, which lasted for about 21 months, saw the suspension of civil liberties, censorship of the press, arrests of political opponents under MISA, and sweeping powers handed to the executive. He also said the Congress must apologise for the Emergency and excesses committed under the Indira Gandhi government, calling it a period when citizens' rights were crushed and institutions weakened. New Delhi: Rashtriya Swayamsevak Sangh (RSS) general secretary Dattatreya Hosabale Thursday called for a review of the words 'secular' and 'socialist' inserted into the Preamble to the Constitution by way of the 42nd Amendment, saying they were added during the Emergency and were not part of the original text drafted by B.R. Ambedkar. Speaking at an event to mark the anniversary in New Delhi, Hosabale said insertion of the two words into the Preamble needs to be revisited. 'Freedom of judiciary was also curtailed … but one more thing, during the Emergency, two words were added to the Preamble to India's Constitution. We all know: secularism and socialism. These were not in the Preamble earlier. They were added later. The Preamble is meant to be eternal.' 'So, from the perspective of ideology, should socialism be considered eternal for India?' he asked. 'The word secularism was not originally in the Indian Constitution. It was added to the Preamble. Yes, the ideas of secularism may have existed, they may have been part of governance and state policy, that's a different matter. But should these two words remain in the Preamble? This is something that deserves reflection,' Hosabale said. Adding, 'Because I know, and I'm saying this while standing in the building named after Dr Babasaheb Ambedkar, the architect of our Constitution, that these words were not included by him.' He went on to say, 'When you discuss the Constitution, it is not just about Babasaheb Ambedkar. There are also aspects that were not part of what Ambedkar had framed.' Hosabale emphasised that the changes were made at a time when democratic institutions were severely weakened. '… when citizens' rights were suspended, when Parliament was ineffective, when the judiciary was crippled, at that time, this was inserted.' Adding, 'That is why, I believe, many such matters still need to be reviewed even today.' He also said the Congress must apologise for the Emergency. 'They have not apologised to the people of the country till today. They haven't sought forgiveness. One lakh people were jailed, 60 lakh forcibly sterilised, 250 journalists were sent to jail, the judiciary was crippled but still, no apology was made. They will have to apologise to the nation. If your ancestors committed the mistake, then apologise in their name. What's the issue with that?' 'Those who did such things are today moving around with the Constitution's copy. They have still not apologised … Apologise,' he said. 'Your ancestors did it… You must apologise for this to the country.' 23,000 personnel, AI-enabled cameras: Ahmedabad all set for Rath Yatra today

The Gujarat Police is focussing on preventing a stampede-like situation or a security threat during the 148th Rath Yatra that will begin from the 400-year-old Jagannath temple in Ahmedabad on Friday morning. Union Home and Cooperation Minister Amit Shah will perform the 'mangala aarti' at 4 am at the temple situated in Jamalpur, right before the chariots of Lord Jagannath, Lord Balram and their sister Subhadra will proceed for the yatra. While the police has already deployed Artificial Intelligence -aided cameras for crowd control, besides over 23,000 personnel from the police, para-military and civil defence, in a post on X, the Ahmedabad city police warned action against those posting provocative or fake messages on social media or forwarding them. The 16-km-long route of the Rath Yatra will pass through narrow streets and some communally sensitive areas of the walled city where the police have identified around 152 'sensitive points' along the route. 'The Ahmedabad police will be constantly monitoring social media. Action will be taken against illegal activities, rumour-mongering and (those) circulating fake messages,' the Ahmedabad police posted. On Thursday, like every year, Congress leaders, including the Congress Legislative Party leader Amit Chavda, visited the temple and performed an aarti.
