High court notice to OMC on CBI plea for tougher penalty

Hyderabad: Justice K Lakshman of the Telangana high court on Wednesday issued a notice to Obulapuram Mining Company (OMC), which was convicted in an illegal mining case, directing it to respond to an appeal filed by the CBI.
The CBI has challenged the trial court's order, arguing that the penalty of ₹1 lakh imposed on the company was 'grossly inadequate' and must be enhanced to serve as a deterrent against corporate fraud.
On May 6, the principal special judge for CBI cases, Hyderabad, had convicted OMC under sections 120-B and 420 of the IPC and imposed a fine of ₹1,00,000. The court further ruled that if the penalty was not paid, the company's managing director, BV Srinivas Reddy, would undergo one year's simple imprisonment.

Invoking section 418(2)(b) of the Bharatiya Nagarik Suraksha Sanhita, the CBI contended before the high court that the punishment failed to reflect the gravity of the offences.
According to the prosecution, OMC, in collusion with public servants and private players, engaged in deliberate boundary shifting, unauthorised road construction inside forest areas, and large-scale illegal extraction and transport of iron ore. It was also alleged that the company demolished the historic Sugalamma temple within the forest to further its operations.
The CBI alleged that over 29.32 lakh metric tonnes of iron ore were illegally dispatched, causing massive revenue losses to the state exchequer.
The high court admitted the appeal and posted the matter to Sept 17 for further hearing.

1 2 Lucknow: UP's Kushinagar district police on Wednesday lodged an FIR against 13 people, including Balrampur-based cleric Jalaluddin alias Chhangur Baba and a serving police constable, in a case allegedly involving illegal religious conversions, gang rape, abduction and sexual exploitation. The FIR, filed on the complaint of a young woman, alleges a chilling nexus of crime that began in 2017. According to the survivor, she first came into contact with Mohd Rafiq Khan alias Bablu, a local political functionary with alleged gangster links, during a college function. Exploiting her vulnerable financial situation, Bablu lured her with a job promise and subjected her to repeated sexual assault, she alleged. In March 2024, the woman was allegedly abducted by Bablu, Naushad Khan alias Nata Nawab and their associates, and taken to a shrine at Utraula in Balrampur, where she was introduced to Chhangur Baba. There, Baba forcibly got her converted to Islam and renamed her Joya Khan. She was then forced into a nikah with Naushad Khan, which was attended by Bablu and others, the woman alleged in her FIR. The complainant alleged that she was taken to Mumbai, where she faced prolonged sexual exploitation at the hands of Naushad, before he abandoned her. She was then sent back to UP and placed in Bablu Khan's household, and subsequently employed at Red Hills Infra Project under Alamgir Ansari. There, she faced repeated assaults by Alamgir, his son Sahil and associates, including Ritesh Mishra and Tanveer, the woman alleged in the FIR. The survivor claims that although Naushad had abandoned her, he routinely collected her salary of Rs 15,000, leaving her trapped in dependency. She further alleged that when she attempted to file a complaint at Tamkuhi Raj police station in Kushinagar, she was betrayed by constable Imtiaz Khan, who handed her back to the accused. She was then allegedly gang-raped by Imtiaz, Irshad Khan and Jamaluddin near the Jharhi river, before being strangled. However, she survived. Kushinagar SP Santosh Kumar Mishra based on the woman's complaint, the 13 accused had been booked under multiple sections of IPC, along with provisions of the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, 2021. Chhangur Baba, already in Lucknow jail after his arrest in July by UP ATS, remains a central figure in the probe in the latest case. He allegedly ran an organised conversion syndicate from Chand Auliya Dargah in Balrampur. The ED has also claimed that he amassed illicit wealth worth Rs 100 crore, including Rs 15 crore in Pune real estate and multiple unauthorised properties. Noida: Two brothers and their associate, who were accused of attacking and threatening two villagers during a panchayat meeting 25 years ago, were acquitted by the additional civil court on Tuesday after the victims, who were also the only two witnesses in the case, turned hostile. On Oct 8, 2000, an FIR was lodged at Dankaur police station by Nangla resident Narendra Singh accusing three brothers—Bharat Singh, Yashpal, and Prem—and their associate, Sundar Singh, of attacking him and his brother when they went to attend a panchayat meeting. "A meeting of the members of the gram panchayat was called by the panchayat secretary for forming a village committee on Oct 8, 2000. I suggested that instead of holding the meeting at Bharat's house, it should have been convened at the school building near Panchayat Bhavan for everyone to access. Madurai: The CBI informed Madras high court on Wednesday that it has filed the final report (chargesheet) before the chief judicial magistrate court in Madurai, in the case pertaining to the custodial death of B Ajith Kumar in Thiruppuvanam in Sivaganga district. A total of 103 witnesses were examined, and the final report filed through online mode before the CJM court on Wednesday according to earlier orders of the court, it said. The CBI also included police constable Ramachandran, driver of the van in which Ajith Kumar was transported, as an accused in the case, apart from the five policemen - Prabhu, Kannan, Sankara Manikandan, Raja, and Anand, who were already arrested. The CBI submitted that though the final report has been filed, further investigation would be held to ascertain the involvement of any other people in the case. This will be based on reports from Central Forensic Science Laboratories in New Delhi and Hyderabad. Additional Advocate General M Ajmal Khan, appearing for the state, submitted that pursuant to the order of the court, an additional compensation of Rs25 lakh was paid to the victim's family. Protection has also been provided to five witnesses under Witness Protection Scheme. He submitted that CBI is yet to receive the files of another case registered in connection with the gold jewellery theft (based on a complaint of Nikitha), which was also transferred to CBI. A division bench of Justices S M Subramaniam and G Arul Murugan observed that Constitutional courts have to maintain a constant vigil against the inaction of authorities in discharging their duties and obligations. It was only when the high court took up the present case of custodial death, the process of investigation accelerated, and CBI investigation commenced. The judges appreciated CBI investigating officer DSP Mohit Kumar and his team for swiftly commencing investigation and filing the final report. The judges directed the state to hand over files pertaining to the jewel theft case to the CBI in a week. Thereafter, the CBI shall register an FIR and commence investigation expeditiously, the judges said. The judges directed the agency to file a status report on further progress in the case on Sept 24. Henri Tiphagne, counsel for a petitioner, submitted that though CCTV cameras were installed at the houses of the witnesses on Aug 19, certain other security doors and fencing are yet to be provided. Taking into account the submissions, the judges directed the state to comply with the orders passed under Witness Protection Scheme in one week. The court was hearing a batch of public interest litigations seeking a CBI probe into the custodial death incident. The hearing in the case was adjourned to Sept 24.
