Commission orders Rs 8L relief after train passenger falls off coach, dies
One Keertivathi, a resident of Keshavanagar in Hubballi, was travelling with her husband Sudhindra Kulkarni from Yeshwanthpur to Shivamogga by train. Around midnight, while Sudhindra went to use the washroom, he accidentally fell off the coach through one of its open doors.
Keerthivathi, in her complaint to the Commission, alleged that SWR had collected money from the complainant for a reserved seat, but there was neither a TTE nor any security staff member in the compartment.
The Railway staff had also failed to ensure that the compartment doors were properly shut, the complaint said, highlighting negligence on the part of the mass transporter.
According to Railways rules, in the event of death in a train accident, the victim's family is eligible for a compensation of Rs 8 lakh.
However, SWR argued that this compensation must be claimed through the Railway Tribunal, and that the Consumer Commission does not have jurisdiction to hear such claims.

Challenging this argument, the complainant approached DCDRC, claiming that the refusal to provide compensation amounted to service deficiency under the Consumer Protection Act.
After detailed hearings, the Commission comprising chairman Eshappa Bhute and member Vishalakshi Bolashetti held that since the deceased was travelling on a valid ticket and Railways was the service provider, the complainant was qualified as a consumer to file a case with DCDRC.
Rejecting the Railways' claim that the matter was beyond DCDRC's jurisdiction, the Commission directed SWR, Hubballi, to pay Rs 8 lakh as insurance claim and an additional Rs 10,000 towards legal expenses within one month of the order.

Tamil Nadu: 3 dead, 1 injured as illegal fireworks unit explodes in Virudhunagar
A devastating explosion at an illegal fireworks unit in Vijayakarisalkulam, Virudhunagar district, claimed the lives of three individuals, including two women. The blast, triggered by friction during the manufacturing of banned joint crackers, also left another woman severely injured. VIRUDHUNAGAR: Three people, including two women, were charred to death, and another woman was injured in an explosion at an illegal fireworks manufacturing unit operating at a house in Vijayakarisalkulam village near Vembakottai in Virudhunagar district on Saturday. The deceased were identified as M Jegatheeswaran (21) of Keelakottai in Nachiyarpuram; P Muthulakshmi (70) and P Shanmugathai (60), both residents of Vijayakarisalkulam. All three died on the spot. R Mariammal (48) of Vijayakarisalkulam sustained severe injuries and is undergoing treatment at Sivakasi govt hospital. Police said the house belonged to Ponnu Pandian (43) of East Street in Vijayakarisalkulam. Crackers, including banned joint crackers, were being manufactured illegally inside the premises. The Supreme Court imposed a ban on joint crackers and the use of barium nitrate in 2018. A sudden friction-induced spark triggered an explosion, causing the building to partially collapse, said the officials. Fire and rescue services personnel from Vembakottai and Virudhunagar police carried out rescue operations. The bodies were sent to Sivakasi govt hospital for post-mortem. Police are probing the source of the raw materials and have registered a case on Ponnu Pandian. Stay updated with the latest local news from your city on Times of India (TOI). Raksha Bandhan Pain: Balaghat Woman Waits 14 Years To Tie Rakhi To Brother In Pakistan Jail
Balaghat, Madhya Pradesh: For 14 years, Sanghamitra Khobragade has been waiting to tie a Rakhi to her brother, Prasannajit Rangari, who is imprisoned in Pakistan's Kot Lakhpat Central Jail. This Raksha Bandhan, like many before, will pass without the joy of seeing him. Sanghamitra's emotional letter to her brother remains undelivered as postal and courier services to Pakistan have been suspended since the Pahalgam attack. In her message, she writes of her deep longing, her mother's tears, and her vow not to tie a Rakhi to anyone else until her brother returns home. "Brother, I miss you a lot on Raksha Bandhan. I want to send you a rakhi, but you are very far away from India. I wish to send you a rakhi, and I hope the Government of India accepts the rakhi sent with love and sends it to Kot Lakhpat Jail in Lahore, Pakistan, so that a sister's wish of tying a rakhi to her brother can be fulfilled. Every sister ties a rakhi to her brother, but I am an unfortunate sister who cannot do so. Mother misses you a lot and waits for you. Your nieces also miss you and want to see you...," she wrote in the letter. Prasannajit, once a bright pharmacy student, disappeared from home years ago. The family had believed him dead until 2021, when a former Indian prisoner from Kot Lakhpat informed them he was alive. Records show Pakistan took him into custody in October 2019 from Batapur. He is listed there under a different name but has revealed his true identity and family details. Their father died waiting for his son's return, while their mother, now mentally unwell, still believes he is in Jabalpur. Sanghamitra, a daily wage labourer and mother of two, has been tirelessly visiting offices seeking government help for his release. The family, already struggling to make ends meet, hopes authorities will act swiftly so that one day, Raksha Bandhan can truly be a celebration for them again.
