New Year's Eve murder case: SPP says he has not been paid dues

Special public prosecutor Pradip Gharat Tuesday informed a court here, before which the trial in the New Year's Eve murder case of a 19-year-old is ongoing, that he has not been paid his dues.
Gharat told the court during a hearing in the case that he has been appointed as the special public prosecutor (SPP) since 2021 but has not been paid even for a single hearing so far.
He told the court that he had written thrice to the Khar Police senior inspector, and sent the officer messages about his dues but did not get any response.
The court has directed that the pursis filed by Gharat informing it about the non-payment be forwarded to the Khar Police.
Gharat informed the court that he has given the authorities 'sufficient time' to respond and if they fail to do so by the next hearing on June 16, he has no option but to step down from the case.
On the intervening night of December 31, 2020 and January 1, 2021, Jhanvi Kukreja, a 19-year-old Khar resident, was allegedly murdered after a scuffle. The police arrested Kukreja's childhood friend, 19-year-old Diya Padalkar and 22-year-old Shree Jogdhankar, on charges of murder. Gharat was appointed as the SPP in 2021 and the trial in the case has been underway since 2023.
On Tuesday, Gharat examined the 41st witness in the case.
Following the examination, he informed the court that while he had conducted the trial which is almost at its fag end now with 3-4 witnesses remaining, he has not been paid his pending dues.
Gharat told the court that if he does not receive any response, he will not be able to attend the next hearing.
Gharat, who was the SPP in the Telgi scam, and is representing the CBI in the cases against gangster Chhota Rajan, including the murder of journalist J Dey where Rajan and others were sentenced to life imprisonment, was replaced earlier this year from case of the abetment of suicide of Dr Payal Tadvi.
On March 7, the law and judiciary department issued the notification to cancel the appointment of Gharat with immediate effect and appointed another lawyer as the SPP.
Appointed in many cases during the Maha Vikas Aghadi government, Gharat was also asked to step down in some cases of a political nature like the sedition case against former MP Navneet Rana.

MUMBAI: Two days after the Bombay High court asked the state government to check if senior advocate Pradeep Gharat would consider returning as special public prosecutor (SPP) in the 2019 Dr Payal Tadvi suicide abetment case, the state government on Wednesday told the HC that Gharat has expressed willingness to rejoin the case, which has seen multiple delays over the past five years. On March 7, 2025, the state government removed Pradeep Gharat from the case. In his place, the state had appointed advocate Mahesh Manohar Mule as special public prosecutor. Dr Payal Tadvi's husband, Dr Salman Tadvi and her mother Abeda Salim Tadvi opposed the new appointment. In November 2024, while serving as SPP, Gharat filed an application before the special court seeking to make Dr Yi Ching Ling Chung Chiang — then head of the obstetrics and gynaecology department — a co-accused in the case. Gharat argued that Dr Chiang had failed to act on repeated complaints of harassment lodged by Payal and her family, despite an obligation to intervene. The application relied on findings of the hospital's anti-ragging committee and an early written complaint by Payal's mother. On February 28, 2025, the special court allowed the application, paving the way for Dr Chiang's prosecution alongside the original three accused. Barely a week later, however, the state government abruptly replaced Gharat with advocate Mahesh Manohar Mule. The decision was neither explained in the official notification nor conveyed to Payal's family, prompting her mother to move the high court challenging the move. Dr Payal Tadvi, a 26-year-old postgraduate medical student from the oppressed Bhil tribal community, died by suicide on May 22, 2019, allegedly after facing prolonged caste-based harassment and ragging by three senior colleagues — Dr Hema Ahuja, Dr Bhakti Meher and Dr Ankita Khandelwal — at the Topiwala National Medical College and BYL Nair Hospital. Her death sparked national outrage, leading to the arrest of the three doctors under provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the Maharashtra Prohibition of Ragging Act, and the Indian Penal Code. They are currently out on bail. Despite the gravity of the allegations, the trial is yet to commence. In earlier hearings, the court had voiced displeasure over Gharat's removal and asked the state to ascertain whether he would be willing to return to the case. The matter will now be heard further in light of the state's statement that Gharat is ready to rejoin as SPP.

1 2 Chandigarh: The Punjab and Haryana high court on Wednesday extended its stay on the trial in the special CBI court, Panchkula, against former Haryana chief minister Bhupinder Singh Hooda and Associated Journals Ltd (AJL) in a plot allotment case. The stay will continue until Oct 27. "The application has been filed, seeking an extension of the interim order dated July 1, 2021, granting a stay of proceedings before the trial court, to be continued until the next date of hearing, which is October 27, 2025. It has also been pointed out that the stay was operating until April 3, 2025; however, due to oversight, it could not be extended while adjourning the matter on Aug 6 to Oct 27. In these circumstances, the application is allowed, and it is directed that the interim order dated July 1, 2021, shall remain in effect until the next date of hearing," the court observed in its order. Challenging the framing of charges in the case, the counsel for Hooda submitted that the allegation of him favouring AJL in the restoration of the plot, in normal parlance, would presume the rehabilitation of the status quo ante. "It was always open to the authority to take a decision in the matter of the price at which it was to be restored. It was specifically raised that as per the discharge application, the policy for allotment of institutional plots of a non-commercial nature was based on recovery of cost only. New Delhi: A day after facing criticism from the Delhi High Court , Delhi govt on Wednesday informed the court that it has suspended nine Tihar Jail officials for allegedly running an extortion racket in collusion with inmates. The govt assured a bench of chief justice D K Upadhyaya and justice Tushar Rao Gedela that strict disciplinary action was initiated against the officials, who were placed under suspension and transferred as per rules. It also sought an additional two months to file its action taken report in the case. Earlier, the high court had directed the CBI to register an FIR after finding merit in allegations of an extortion ring operating from Tihar Jail, facilitated by inmates' access to mobile phones. The report included call data records between persons outside and inside the jail, and misuse of the jail's official landline to "promote nefarious activities."
