MS University law student Rakshit Chaurasiya, who crashed a speeding Volkswagen Virtus into three two-wheelers, killing one and leaving seven others grievously injured on the night of March 13 in Gujarat's Vadodara, was driving at a speed of 140 kmph, through the busy street on the night of a festival — Holi — under the influence of a cocktail of drugs, namely THC (Tetra-Hydro Cannabinol) and Codeine, the city police informed the court on Monday.
The Vadodara city police shared these details while opposing the bail plea filed by Chaurasiya, who has been in judicial custody since March 17.
The affidavit filed by the Karelibaug police station, through Police Inspector-cum-Investigating Officer HM Vyas, states that the Event Data Recorder (EDR) report received from the German car maker, Volkswagen, has confirmed that the car was being driven at 140 kmph at the time of accident.
The police affidavit states, 'To gain access to the data of the car in the possession of the accused at the time of the incident, the car was sent to the Volkswagen company showroom and a report was received after being analysed in Germany (car manufacturer headquarter). The report stated that the speed of the car at the time of the accident was 140 km per hour, as per the details extracted from the Event Data Recorder (EDR) of the car.'
Nine police pointers against bail
Opposing Chaurasiya's bail plea, the Vadodara city police on Monday put forth nine points before the court.
The police stated that granting bail to Chaurasiya — a law student well-versed with the legal process — would not only 'hamper the trial' in the case but also pose 'a risk that the accused will intimidate witnesses and destroy evidence' in the NDPS (Narcotic Drugs and Psychotropic Substances) case filed against him and two co-accused — Praanshu Chauhan and Suresh Bharwad.
Chauhan, who is the son of the owner of the Volkswagen Virtus, is also a co-accused in the Karelibaug accident case.
The police affidavit states, 'The police had collected the blood samples of the three (NDPS case) accused — Chaurasiya, Chauhan and Bharwad — at the time of the accident and sent them to the forensic laboratory in Gandhinagar. The FSL report confirmed the presence of Tetra-Hydro Cannabinol (THC) and Codeine in the bloodstream and determined that the accused was under the influence of drugs at the time of the accident. All three persons have been booked in a separate case of NDPS.'
'The accused had consumed cannabis and is likely to intimidate and manipulate witnesses in the case or try to destroy evidence. A simultaneous probe is on to ascertain from where did the accused procure the narcotics and if he is released on bail, he will attempt to destroy evidence in the (NDPS) case,' the affidavit stated.
The police affidavit also highlighted the viral video of Chaurasiya post the accident, in which he was seen screaming, 'another round', naming a friend and also chanting the names of Gods, stating that 'his conduct was that of jubilation as if he had achieved a feat instead of feeling remorse for his action or reaching out in aid of the injured persons.'
The affidavit further stated that Chaursaiya being a native of Varanasi in Uttar Pradesh is 'likely to remain absent from court hearings during the trial and turn uncooperative in further police investigation'. The police have also emphasised on the fact that being a law student, and 'having knowledge of law, the accused drove the car at top speed, endangering the lives of the people. The accused was also aware that it was the night of a festival, Holi, and the streets would be crowded.' The Vadodara court will next hear the matter on Tuesday with Vadodara District Government Pleader Anil Desai representing the Vadodara city police

Mumbai: Calling it "preposterous", Bombay high court on Monday dismissed a drug trafficking case registered in 2021 against Dhruv Tahil, son of actor Dalip Tahil . The court held the law prohibits a merging of several minor aberrations over 18 months into one charge, a move that led to Tahil "being charged with an offence of a higher magnitude". Holding the Bandra Anti-Narcotic Cell's action as impermissible after analysing sections 218 and 219 of the erstwhile CrPC, the HC said: "Prosecution cannot be permitted to decipher and follow its own procedure for levying of charge of such a serious nature which is impermissible under the provisions of (law)." Pointing out that Tahil was not even arrested in possession of contraband, Justice Milind Jadhav said: "Prima facie when section 218 (of CrPC) is read, such charge by prosecution on the face of record appears to be preposterous… The procedural law does not permit the prosecution to assimilate more than three charges into a singular charge over a period of 18 months to be tried together and invoke a singular precipitative action. " The ANC, Bandra unit, in May 2021 arrested Tahil, then aged 30, after a co-accused, Muzammil Shaikh, held in Bandra (E) with 35 gm of mephedrone (MD), alleged that he had "in the past" supplied to him and various others. Police said it recovered WhatsApp messages between Jul 2019 and Jan 2021, which allegedly pertained to purchase of 1 gm or 2 gm of MD on various occasions, totalling 44 gm from Shaikh worth roughly Rs 25,000, to justify its invocation of serious charges of drug trafficking against Tahil in alleged conspiracy with Shaikh. HC noted that for small quantities, the punishment is less -- maximum 1 year in jail; but for intermediate quantities (less than commercial) invoked against him, it is 10 years. Justice Jadhav said "the prosecution was aware" each single act of alleged procurement was "less than small quantities" and Tahil would get the benefit of doubt, and hence it combined all the alleged transactions without following the tenets of the exception carved under the law. Tahil had challenged a 2023 rejection of his discharge plea by a special NDPS court. Justice Jadhav, after hearing Tahil's counsel Ayaz Khan, who alleged non-application of mind by the police and "mala fide intentions" in invoking the charges, and after hearing prosecutor H Dedhia, said, "From the material available on record and invocations of charge… no case is made out for the applicant to stand trial." HC also said "the alleged WhatsApp chats... in my opinion cannot translate into admissible evidence" during trial. HC said the state failed to comply with CrPC mandate and it led to Tahil "being charged with an offence of a higher magnitude". That too, under a special law like NDPS, which attracts higher punishment and fine and stringent conditions to get bail, HC noted adding, stringent laws require reciprocal duty on police to strictly comply with the law and its aspects that may have a negative impact on the accused.

Nashik police crack down on drug sale and transport

Nashik: The city police seized drugs worth over Rs 1 lakh and arrested at least seven people, with two involved in the possession of mephedrone (MD) and three others involved in the sale of ganja, in May this year. Nashik city police announced they stepped up action against drugs sale and transport in the city after growing number of youngsters were found to be engaging in thefts and robberies under the influence of drug addiction. Thus intelligence was stepped up and the police seized MD worth Rs 75,000 and ganja worth Rs 53,000 and found 28 other people consuming drugs. ACP (crime) Sandeep Mitke said increased intelligence helped gather information regarding drugs sale and transport. CP Sandeep Karnik advised zero tolerance towards the menace of narcotics in the city, he said. According to reports from the police between Nov 2023 and May end this year, a total of 60 cases were registered under Narcotics Drugs and Psychotropic Substances (NDPS) Act. 129 people have been arrested and drugs and other substances worth Rs87 lakh have been seized, including 737g of MD worth Rs34 lakh, 292kg of ganja worth Rs48 lakh, 49g of charas worth Rs24,000 and 326kg of bhang worth over Rs3 lakh. As part of this initiative, last month, a police head constable was dismissed from service due to his connections with drug dealers. Earlier this week, the Nashik rural police conducted a month-long operation in May, targeting the sale, consumption, and transportation of narcotic drugs and products across the district's rural areas. This initiative led to the seizure of narcotic products valued at Rs 8.49 lakh. During the drive, the police registered a total of 22 cases and arrested 29 individuals.
