
TASMAC money laundering case: Madras High Court stays further ED proceedings against film producer Akash Baskaran, businessman friend Vikram Ravindran
A Division Bench of Justices M.S. Ramesh and V. Laksminarayanan granted the interim stay after being prima facie satisfied that an authorisation issued by a Joint Director of ED on May 15 and the consequential search and seizure operations at their residences and office was 'wholly without authority or jurisdiction.'
The judges went through the ED records produced before the court in a sealed cover and found no incriminating information or material, connecting the two writ petitioners with the TASMAC money laundering case, was available with them when the authorisation for search and seizure was issued by the Joint Director on May 15, 2025.
'It would be suffice to state that the so called information produced by the Directorate before us had absolutely no semblance of information which may have led them to believe that the petitioners may be involved in the offence of money laundering. In the light of the above observations, there shall be an order of interim stay,' the Bench added.
The judges also directed ED to return to the petitioners all materials including a laptop, a hard drive, three external hard disks, three iPhones, one more mobile phone and the lease rental deeds with respect to their office at Semmenchery and Mr. Ravindran's residence at Poes Garden which were seized from Mr. Baskaran's residence on May 16.
The Bench made it clear the petitioners must not tamper with or alienate any of those seized materials until further orders from the court and directed the High Court Registry too to keep a copy of the records produced by the ED, in a sealed cover, in safe custody so that they could be used during final hearing of the writ petitions.
Though Additional Solicitor General S.V. Raju urged the Division Bench to keep their interim stay order in abeyance for a period of three weeks to enable the ED to file an appeal before the Supreme Court if they chose to do so, the judges refused to accept the request and said, their order copy would be issued on Friday itself.

ED conducts raids at scrap dealer's house in Sahibganj
Dumka: The enforcement directorate (ED) on Tuesday conducted a raid at the house of a scrap dealer in Sahibganj district and examined various documents and electronic gadgets in connection with the Rs 1,250 crore mining scam and the ongoing investigation in the GST scam. The Rs 734-crore GST scam is allegedly a complex fraud planned by some traders from Jharkhand with implications in other states. ED has, however, not made any official statement about the raid. Sources said a four-member team of the ED, comprising a woman officer, assisted by CRPF personnel, entered the house of Bablu Gupta alias Bablu Kabadi located in the Bangali Tola Mohalla under the jurisdiction of the town police station around 7 am, and reportedly searched the house. "We were taken aback as unknown people in civilian clothes, accompanied by CRPF personnel, barged into our home. They started searching the entire premises even before we could understand anything," a member of the scrap dealer's family was quoted as saying to the neighbours. The family member also added that the operation continued for nearly six hours. During the search operation, one of the ED officials stepped out of the house along with a teenage boy of the Gupta family. They went somewhere and returned after some time, eyewitnesses said. Police said locals gathered outside Gupta's house out of curiosity as the news of the ED raid spread. Delhi HC refuses to grant bail to former Amtek Group chairperson Arvind Dham
The Delhi high court on Tuesday refused to grant bail to former Amtek Group chairperson Arvind Dham in a money laundering case stemming from an alleged ₹27,000-crore bank fraud. The Delhi high court. (File) A bench of justice Ravinder Dudeja, in his 29-page verdict, said that releasing him on bail would risk compromising the trial, public's confidence in the justice system and eroding the fabric of economic governance. The court noted that the allegations involved the commission of serious economic offences that had resulted in significant losses to public sector banks and could not be treated lightly. The money laundering case had stemmed from an FIR filed by the Central Bureau of Investigation (CBI) in 2022, following complaints from IDBI Bank and Bank of Maharashtra, alleging that Amtek Group companies had defaulted on substantial bank loans through fraudulent schemes involving cheating and criminal breach of trust. The Enforcement Directorate (ED)'s probe began on the directions of the Supreme Court on February 27, 2024. The ED, in its case registered last year, had alleged that Dham was the ultimate beneficial owner of the fraud, which was executed through the manipulation of financial records, overstating assets and profits by over ₹15,000 crores, creating fictitious sales and purchases, floating more than 500 shell companies, and installing dummy directors. He was arrested by the ED in July last year. Dham, in his petition before the high court, said he was a senior citizen aged 64 years, already been in jail for more than a year and could claim the benefit of 'sick and infirm' under Section 45 of the Prevention of Money Laundering Act (PMLA). Section 45 of PMLA requires the court to be convinced that there are reasonable grounds to believe the accused is not guilty and is not likely to commit any offence while on bail. These conditions generally make it challenging for an accused in a money laundering case to secure bail. However, it contains an exception which entitles 'sick and infirm' persons to be released on bail. Dham, represented by senior advocate Vikas Pahwa, asserted that the investigation qua him stood completed and there was no likelihood for the trial to commence in future since the CBI probe was not complete. On the contrary, the ED represented by special counsel Zoheb Hossain, along with panel counsel Vivek Gurnani, asserted that the scale and method of the alleged fraud disentitled him from seeking exemption for bail, since he was accused of committing a serious economic offence involving defalcation of public money. Hossain asserted that Dham was the controlling mind of the Amtek Group, orchestrated a complex scheme of siphoning public funds through hundreds of shell entities and falsified financial reporting. Rejecting the bail, 'Given the serious repercussions for the economy and the banking sector, such offences undermine public confidence and harm depositors and creditors. Granting bail too liberally in such matters risks sending a counterproductive signal,' the court noted. It added, 'Court finds that the allegations against the applicant pertain to an economic offence of exceptional magnitude, involving complex, deliberate, and sustained criminal conduct causing grave loss to public sector banks. Such offences erode the fabric of economic governance and public trust and cannot be taken lightly.' In its ruling, the court shot down Pahwa's contention that his client could be released on bail on the ground of being 'sick and infirm', saying that the same was not an automatic passport to bail in serious economic offences. 'The applicant's medical condition, though concerning, can be managed in custody, where prison authorities are obligated to provide adequate treatment, including referral to specialised hospitals if required,' the court maintained.

Earlier, ED provisionally attached fresh assets worth over Rs 550 crore of Amtek Group firms, an insolvent automotive equipment manufacturing company, under the anti-money-laundering law. Action was taken against Amtek Auto Limited, ARG Limited, ACIL limited, Metalyst Forging Limited, Castex Technologies Limited and Amtek Group promoter Arvind Dham, apart from some others, the ED said. Properties worth Rs 5,115.31 crore were attached by the agency in the case in September last. The ED probe began under the Prevention of Money Laundering Act (PMLA) on the directions of the Supreme Court on February 27, 2024. Dham was arrested the agency in July last year and chargesheeted in September later that year. "There were FIRs registered by the CBI arising from the complaints by IDBI Bank and Bank of Maharashtra under various sections of IPC and Prevention of Corruption Act on allegations of illegally diverting bank loans by causing wrongful loss to the banks," the ED said. The probe found the above-mentioned companies, along with other group concerns, were taken to insolvency, whose resolution led to a haircut of more than 80 per cent for the banks, causing "substantial" losses to these public sector financial institutions. The financial statements of group companies were "deceitfully manipulated" to obtain additional fraudulent loans and create bogus assets and investments in books of accounts, the agency alleged. The provisionally-attached assets include 145 acre of land in Rajasthan and Punjab, some properties in Delhi-NCR valued in total at Rs 342 crore, apart from fixed deposits and bank balances worth Rs 112.5 crore. All the Amtek assets are identified as "direct proceeds of crime" and held through several companies beneficially owned by Dham and assets of Amtek companies held by bankers who sanctioned the loans, according to the ED.
