A Wetherspoons manager who was sacked for giving a colleague a staff discount on £30 of chicken bites was unfairly dismissed, a tribunal has ruled.
Peter Castagna-Davies was sacked after a row erupted about the meal of chicken, halloumi fries and Monster energy drinks while he was working as a bar shift leader at The Pontlottyn in Abertillery, Monmouthshire.
The 'diligent' manager had worked at the pub chain for over 20 years and had risen to shift leader with a clean record, an employment tribunal heard.
However the hearing was told that on one occasion he scanned through an 'excessive' meal of double portions for a colleague with a 50 percent discount, who then took it home to eat.
Staff at the pub had been informed that they must only put through food which included the discount for themselves and eat it within the pub.
Wetherspoons ruled that Mr Castagna-Davies had broken company policy and dismissed him for gross misconduct.
However he is now set for compensation after the tribunal found his sacking was 'not reasonable' due to his clean record.
The hearing in Cardiff was told Mr Castagna-Davies began working at Wetherspoons in July 2002.
Staff at the pub were entitled to one free meal and soft drink on their shift, with any further food or drink half price. They were also given 20 percent off when not on shift.
All half price food must be consumed within the pub, the hearing was told.
In December 2023, the pub's manager had messaged all staff that the rules were going to be more strictly enforced after workers across the country were found to have over-claimed on their allowance.
On January 31, Mr Castagna-Davies claimed two portions of halloumi fries, two portions of chicken breast bites and two cans of Monster drink with a 50 percent discount for a colleague.
The cost of the items was £29 but was taken to £14.50 with the discount.
Despite going against the rules, the colleague, a kitchen associate, began preparing the food before it had been processed and took it home to eat.
Mr Castagna-Davies was told that if proven his actions could amount to abuse of the employee discount policy, a serious breach of policies, gross incompetence and an act of dishonesty.
The case was taken to a disciplinary hearing within the company and he was dismissed in February 2024 for 'allowing your colleague to purchase excessive products and by allowing him to take them home'.
His appeal against the decision was unsuccessful.
But the tribunal found that due to his long service and clean disciplinary record it was not reasonable to dismiss him for this incident.
Employment Tribunal Judge Rachel Harfield concluded that he was guilty of negligence rather than gross incompetence.
'[He] was acting as a manager at the time and the staff discount system is one built on trust,' she said. 'If open to regular abuse it would be costly to [Wetherspoons].
'It is understandable that [Wetherspoons] generally took a strong attitude to such breaches and that standard was widely known, including by [Mr Castagna-Davies].
'It was one incident on one shift that he could have managed better. He was an employee with long service and a clear disciplinary record.
'There was a basis for the belief [he] was otherwise usually a diligent manager.
'The decision to uphold the dismissal at appeal stage was not within the reasonable range.'

"If a big company like this relies on local support, think how much it means to have the local support as a small business." The Original Factory Shop was bought by Modella Capital, a private equity firm, in February. Modella is known for taking on struggling retailers and has also recently bought Hobbycraft and WHSmith's high street shops. At the end of April, Modella drew up plans to initiate a company voluntary arrangement (CVA) for the retailer. MS for North Wales As Chair of the Senedd Cross-Party Groups on Hospice and Palliative Care, and on Funerals and Bereavement, I took part in Mold-based 'Same but Different' Community Interest Company's photographic and conversational piece 'The Last Supper', a creative and reflective gathering held at Pen Y Bont Farm, Mold, exploring what matters most in end-of-life care. It was a pleasure to join a wonderful group of passionate individuals committed to improving the experience of care and support during life's final stages. Later in the week, I also attended a lovely Garden Party at St. Kentigern Hospice & Palliative Care Centre in St. Asaph, celebrating their 30 years (1995-2025) of delivering Specialist Palliative Care, providing exceptional services for those with life limiting illness and support for their families. Our Hospices, founded and supported by their local communities, are leading healthcare organisations and registered charities providing essential free specialist palliative care services to patients with life-limiting illnesses. However, they only receive a small portion of their funding from the Welsh Government, which must finally embrace their offer to help our Health Board deliver more, and ensure that they are supported to do this. With the Bus Services (Wales) Bill on its journey through the Senedd, I met the Executive Director for Regional Transport and Integration at Transport for Wales to discuss bus franchising and network planning. They are planning to roll out franchising across Wales based on the Corporate Joint Committee (CJC) regions, starting in the South-West in 2027 and then to North Wales in 2028. We also discussed concerns, issues and aspirations in relation to the bus network and a wider integrated transport network at a local, regional and national level. It was a pleasure to attend the 'How We Learn, Grow & Thrive' event, a Welsh Woodland Immersive Experience designed for young people, educators, parents, and changemakers passionate about the future of education, which took place at Halkyn Castle Wood, a family-run venue offering a variety of activities and accommodation in a serene woodland setting. Hosted by Mojo School and the Campfire Collective, the event included inspiring talks by thought leaders and young trailblazers, creative workshops, spoken word poetry, art, storytelling, nature walks and wellbeing sessions. More than 800 second home owners in Pembrokeshire have sidestepped Britain's harshest council tax premium. One in five have been permitted exemptions to the county council's 150pc penalty, with scores of owners thought to be exploiting legal loopholes in the policy. Second home owners who list their property for sale or let are granted a 12-month reprieve from the premium, shaving thousands of pounds from their tax bills. The legal workaround, which is enshrined in the Local Government Finance Act, allows owners to market their home with little intention of agreeing a deal. There is no obligation to sell or secure a tenant during the time period. Pembrokeshire Council raked in an additional £10.6m in 2024-25 thanks to the premium, but it could have earned more if 19pc of second homes were not exempt. Figures revealed in a council consultation document show that of the 4,328 second homes in the county, 3,503 – the equivalent of 81pc – were subject to the premium in June. Carol Peett, a buying agent at West Wales Property Finders, believes people listing homes with no desire to sell is commonplace across the county. She said: 'There's no question they are doing it. People are finding ways to get out of paying the tax. They are being forced into ways of avoiding it, as it's crippling for the lower-end properties.' Pembrokeshire's premium was introduced in 2017 at 50pc, before rising to 100pc in 2022, and then 200pc in 2024. Councillors agreed to reduce the rate to 150pc in April after conceding that they went too far – yet the premium is still the joint highest in Britain, along with Gwynedd and Denbighshire. A typical second home owner of a Band D Pembrokeshire property pays £4,130 in council tax, compared to the normal £1,651 rate, according to Telegraph analysis. Second home owners in the highest band face an annual bill just shy of £10,000. An owner can only be granted a 12-month exemption once during the course of their ownership of the second home. The tactic is fully legal, as long as properties are publicly marketed and listed at a price in line with the local area. Government guidance states: 'In cases where the council considers the sale or rental price to be inflated, the council can request evidence to support the asking price.' Conservative councillor Aled Thomas doubted whether second home owners are utilising the list-but-not-sell tactic. He said: 'I don't think people are using it to game the system. I think people are generally trying to sell their properties because they're fed up of being treated like a martyr here in Pembrokeshire. 'People are putting their second homes on the market, bu t they just aren't selling.' While English councils can implement a standard 100pc rate, Welsh councils have the power to charge up to 300pc council tax premiums on second homes. The majority have set a 100pc rate, but Pembrokeshire, Gwynedd and Denbighshire charge 150pc. Blaenau Gwent and Torfaen councils are the only two Welsh authorities not levying extra tax on second homes. Pembrokeshire is currently consulting the public on its rates for 2026-27. Money raised is not ring-fenced for local housing projects, with the majority going to the council's general fund budget. A council spokesman said: 'There are seven different exceptions to the second homes council tax premium making up the 19pc figure, of which putting the property up for sale is one. 'To receive this time-limited exception, the homeowners must provide evidence that the property is being marketed for sale. For example, they must provide a copy of the sale particulars and listing on a website at a reasonable price.'
