Bid for promotion leads to arrest for ‘degree fraud'
Police spokesperson W/O Ndiphiwe Mhlakuvana said the 33-year-old had been enrolled for a Bachelor of law (LLB) degree at Walter Sisulu University (WSU) between January 2010 and December 2016.
He allegedly failed to meet the academic requirements to graduate.
Despite this, he allegedly submitted a falsified LLB degree certificate and a bogus legal education and development (Lead) attendance report as part of his application to the National Prosecuting Authority's (NPA) aspirant prosecutor programme, which required a legitimate LLB qualification or proof of final year status.
Mhlakuvana said the accused was appointed as an aspirant prosecutor i n January 2021 and later elevated to the position of public prosecutor.
Proof of his qualifications was requested when he sought to climb the career ladder.
"The accused applied for promotion at regional court as a prosecutor using the same credentials and he was shortlisted for appointment. However, the NPA requested him to submit the original academic certificates," Mhlakuvana said.
He resigned with effect from March 15.
"The institution picked up discrepancies in his qualifications and referred the matter to the Hawks for investigation.
"The Hawks confirmed WSU had never conferred an LLB degree to him and Lead had never issued him the attendance report due to outstanding fees.
"Through misrepresentation, the NPA suffered financial prejudice of more than R1.1m from the salaries paid to him during his fraudulent term of employment."
The would-be prosecutor was arrested on July 22 and briefly appeared before the Mthatha specialised commercial crime court on the same day, where he was granted R5,000 bail. The case was postponed to August 18.

Luthando Nomandindi, 33, appeared in the Mthatha Specialised Commercial Crime Court in the Eastern Cape facing charges of fraud, forgery, and uttering. The charges stem from Nomandindi's time at Walter Sisulu University (WSU), where he was enrolled in a Bachelor of Laws (LLB) degree programme from 2010 to 2016. Despite being registered for six years, Nomandindi failed to satisfy the academic requirements necessary for graduation. Next Stay Close ✕ Using the same fake qualifications, Nomandindi applied for a promotion at the Regional Court as a Court Prosecutor and he was shortlisted for appointment. However, his fraudulent reign came crashing down when the NPA sought original academic certificates from him. In a panic, Nomandindi resigned on March 15 this year, just before the original documents were to be reviewed. The discrepancies in his qualifications were quickly flagged, leading to the investigation by the Hawks' Serious Commercial Crime Investigation unit. The inquiry revealed that WSU had never conferred any LLB degree upon Nomandindi. Furthermore, the Legal Education and Development organisation confirmed that due to outstanding fees on his account, they had never issued him an attendance report either. Nomandindi was arrested on July 22, and made a court appearance on the same day. He was subsequently released on R5000 bail. The matter was posted to August 18, for disclosure of docket contents. ‘Accountability must follow' – charges withdrawn against Fort Hare forensic investigator
Sarah Burger, the former main forensic investigator contracted by the University of Fort Hare, who uncovered massive fraud at the institution and was then controversially arrested herself, has indicated that she will sue the government after charges were withdrawn against her on Friday. The National Prosecuting Authority (NPA) has withdrawn controversial fraud charges against a former lead forensic investigator contracted to the University of Fort Hare, where she uncovered evidence of massive wrongdoing. In a media release on Friday, Luxolo Tyali from the NPA said there had been a decision to separate the University of Fort Hare fraud, corruption and money laundering case into five legs. They will be allocated to five Regional Court Magistrates presiding in the East London Specialised Commercial Crimes Court. 'The five legs, which involve 21 accused, who are University of Fort Hare employees, service providers, and their business entities, have now been separated after finalisation of charge sheets, and each magistrate will arrange trial dates with the respective legal representatives. 'Nine of the accused were university employees who, together with service providers and their companies, are accused of having colluded in the awarding of tender contracts at UFH in return for gratifications. 'More than R172-million was paid by UFH to the service providers, with the bulk allegedly finding its way into the pockets of the accused university employees. The conclusion of these tenders was allegedly associated with violent acts, including murder, at the university,' Tyali said. He said the decision to withdraw charges against forensic investigator Sarah Burger came after 'lengthy engagements' between the complainant (University of Fort Hare), the Eastern Cape prosecution team and Burger's legal representatives. Previously, Tyali said the case against Burger and her business partner and owner of Horizon Forensics, Bradley Conradie, was before the court because the NPA 'had evidence linking them to crimes'. 'If they have evidence of political motivation, they can make representations to the Director of Public Prosecutions or escalate it to the National Director of Public Prosecutions,' he said at the time of the arrest. On Friday, Tyali said: 'The decision to separate the case into different legs with tailored prosecution strategies for each will expedite and simplify the prosecution of this complex and multifaceted case, which covers charges ranging from fraud and corruption to murder.' On Sunday, Burger said: 'While I am relieved that justice has finally prevailed, the entire saga has been a harsh and costly lesson marked by immense personal and professional destruction. This is a trauma that cannot be undone.' She said that 'accountability must follow for every cog that aided in this process. Formal complaints have been lodged and acknowledged'. 'If the NPA and the SAPS are truly committed to restoring public trust, they must uphold due process, act within the bounds of the law and respect the rule of law at all times. More importantly, they must respect fundamental constitutional rights, which are rights meant to be enjoyed by all,' she said. 'Without this, no citizen will be safe.' She said she would assist the defence team of her business partner, Conradie. Burger became involved in the investigation at Fort Hare in 2019 and was the lead investigator who put together a docket of information pointing a finger at alleged academic fraud by Eastern Cape Premier Oscar Mabuyane. Conradie previously said he and Burger believed their arrests were linked to their handing over evidence to the Hawks relating to Mabuyane. These allegations had previously been put to Mabuyane, but he failed to respond. In papers before court, he has described the investigation against him as malicious. He also successfully managed to have himself excluded from an initial investigation by the SIU into academic fraud. However, in October 2024, President Cyril Ramaphosa signed an amended proclamation that widened the SIU's investigation, which could now conceivably include Mabuyane. In what Burger and Conradie described as 'an unnecessarily dramatic show', they were arrested on 28 March by about 24 members of the National Task Force and the National Intervention Unit. Social Development Minister to probe alleged grant fraud in Breede Valley

Image: Picture: Henk Kruger / Independent Newspapers SOCIAL Development Minister Sisisi Tolashe is set to probe a fraudulent scheme in which hundreds of Worcester and Rawsonville residents, mostly 18-year-olds, were allegedly unknowingly registered for a R370 monthly poverty grant but never received any payments. The alarm was raised by GOOD councillors in the Breede Valley Municipality who uncovered the alleged fraud while working with community activists on a programme to help destitute residents apply for the South African Social Security Agency's (Sassa) Social Relief of Distress Grant (SRD). 'GOOD submitted a complaint to Sassa and the Hawks together with a dossier of 34 separate affidavits from victims of the scheme and a list detailing more than 300 additional victims. 'In its submission to Sassa and the Hawks, the GOOD Party suggests that the fraud is being committed by an individual or individuals with access to information about recipients of Child Support Grants. The modus operandi appears to use the ID numbers of children when they turn 18, and no longer qualify for the child grant, to apply for the SRD grant. The scale of the fraud is impossible for GOOD to determine. GOOD only became aware of it because its Councillors and party activists were working with the community in the Breede Valley region. The same type of fraud could be occurring across the province or the country,' GOOD secretary-general and MPL, Brett Herron said. The pattern they picked up showed that where hundreds of applicants should qualify for the grant, many of whom recently turned 18-years-old, they had their applications declined on the basis that their ID numbers were already linked to the grant. In other words, according to Sassa's system, they are already receiving the grant. According to the applicants, they have never applied for or received the grant. Many report in their affidavits that telephone numbers on Sassa's system linked to their ID numbers don't belong to them. Video Player is loading. Sassa did not respond to several requests for comment on the matter. Sandi Mbatsha, spokesperson to Tolashe confirmed she would look into the matter. The Hawks said they were assessing the case. Hawks spokesperson, Siyabulela Vukubi said: 'The Hawks are aware of the matter but still need to ascertain if this falls with our mandate. At this stage there is nothing to report.' Last year, Stellenbosch University students uncovered a similar trend: a survey of 60 students found that 58 had active SRD grant applications in Sassa's system, yet 56 said they had never applied, suggesting widespread fraud. The students also analysed data from Sassa's public portal and found nearly 75 000 applications for people born in February 2005, despite StatsSA showing only about 82 000 births that month, which pointed to a suspicious 91% application rate. Further analysis revealed that while the average application rate from those born between 1960 to 2006 was 52%, it jumped to 90% for those born between 2002 and 2006, the age group turning 18 since the grant was introduced in 2020. It raised concerns not only about who was receiving the money, but also about eligible individuals potentially being excluded from the support they need. Tolashe earlier this year said a full investigation would be launched into vulnerabilities across all social grants, after irregularities were uncovered in the SRD system. Tolashe did not respond to further requests for comment on the status of the investigation and what measures have been implemented to curb the incidents. Cape Times
